{"id":12225,"date":"2024-04-25T17:20:13","date_gmt":"2024-04-25T15:20:13","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=12225"},"modified":"2024-05-23T16:54:02","modified_gmt":"2024-05-23T14:54:02","slug":"regulacio-del-lloguer-de-temporada-i-el-dhabitacions","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/regulacio-del-lloguer-de-temporada-i-el-dhabitacions\/","title":{"rendered":"Regulaci\u00f3 del lloguer de temporada i el d&#8217;habitacions"},"content":{"rendered":"<h5>Tal com ens informa el Col\u00b7legi API de Girona, el DOGC del 25 d&#8217;abril publica el<a href=\"https:\/\/apigirona.us6.list-manage.com\/track\/click?u=c9fec421edc4397c1b3515da6&amp;id=d70d2e4299&amp;e=1758055e75\"><em><span style=\"color: #ff0000;\"> decret llei 6\/2024<\/span><\/em><\/a> que obliga a distingir els tipus d\u2019arrendaments no en funci\u00f3 de la durada, sin\u00f3 en funci\u00f3 de l\u2019\u00fas al qual es destinin obligant que en els contractes de lloguer hi consti la causa o finalitat de l\u2019arrendament. Si no es diu, es considera habitatge permanent.<\/h5>\n<p>Els lloguers de temporada estacional i els d\u2019usos recreatius, queden fora d\u2019aquesta protecci\u00f3, havent de presentar la documentaci\u00f3 que ho justifiqui i el dip\u00f2sit de la fian\u00e7a a l\u2019Institut Catal\u00e0 del Sol.<\/p>\n<p>Dstaquem el seg\u00fcent<\/p>\n<h3><strong>Regulaci\u00f3 del lloguer d\u2019habitacions<\/strong><\/h3>\n<p>La suma del preu de totes les habitacions no podr\u00e0 superar el l\u00edmit del preu del lloguer de l&#8217;habitatge.<\/p>\n<h3><strong>Anunci d\u2019oferta d\u2019arrendament<\/strong><\/h3>\n<p>S\u2019obliga a incorporar en els anuncis d\u2019habitatges de lloguer i en els contractes d\u2019arrendament la seg\u00fcent informaci\u00f3:<\/p>\n<ul>\n<li>El preu de lloguer que resulti de l&#8217;aplicaci\u00f3 del sistema d&#8217;\u00edndexs de preus de refer\u00e8ncia que correspongui aplicar.<\/li>\n<li>El preu de l&#8217;\u00faltima renda del contracte d&#8217;arrendament que hagi estat vigent en els darrers cinc anys en el mateix habitatge.<\/li>\n<li>En el seu cas, la condici\u00f3 de gran tenidor de la propietat de l&#8217;habitatge, sempre que l&#8217;habitatge estigui ubicat en una zona de mercat residencial tensat.<\/li>\n<\/ul>\n<h3><strong>R\u00e8gim sancionador<\/strong><\/h3>\n<p>Les sancions que poden arribar fins a un m\u00e0xim de 900.000 euros.<\/p>\n<h3><strong>Entrada en vigor<\/strong><\/h3>\n<p>El 26 d&#8217;abril, si b\u00e9 el Parlament l&#8217;haur\u00e0 de convalidar en el termini m\u00e0xim de un mes.<\/p>\n<p><em><strong><span style=\"color: #ff0000;\">ATENCIO:<\/span><\/strong><\/em><\/p>\n<p><em><strong><span style=\"color: #ff0000;\">Aquesta disposici\u00f3 no ha estat validada i, per tant, els contractes d\u2019arrendament de temporada tornen a regir-se per la Llei d\u2019Arrendaments Urbans.
