{"id":13030,"date":"2024-10-14T12:20:21","date_gmt":"2024-10-14T10:20:21","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=13030"},"modified":"2024-10-14T12:31:13","modified_gmt":"2024-10-14T10:31:13","slug":"les-comunitats-de-propietaris-poden-prohibir-els-lloguers-turistics-per-majoria-de-tres-cinquens-2","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/les-comunitats-de-propietaris-poden-prohibir-els-lloguers-turistics-per-majoria-de-tres-cinquens-2\/","title":{"rendered":"Les comunitats de propietaris poden prohibir els lloguers tur\u00edstics per majoria de tres cinquens"},"content":{"rendered":"<h5>El Tribunal Suprem ha avalat que les comunitats de propietaris prohibeixin per majoria de 3\/5 els lloguers tur\u00edstics, descartant aix\u00ed que s\u2019hagi d&#8217;acordar per unanimitat, com s&#8217;havia interpretat fins ara per la majoria de les audi\u00e8ncies provincials.<\/h5>\n<hr \/>\n<p>El Tribunal Suprem ha establert recentment que aquestes comunitats <em>poden prohibir els lloguers tur\u00edstics mitjan\u00e7ant una votaci\u00f3 majorit\u00e0ria de tres cinquens, sense necessitat d&#8217;unanimitat<\/em>, com s&#8217;havia interpretat anteriorment en moltes ocasions.<\/p>\n<ul>\n<li><strong>Atenci\u00f3.<\/strong> Aquesta decisi\u00f3 del Suprem se suma a l&#8217;adoptada a la fi de 2023 sobre el seu suport al veto d&#8217;aquesta mena d&#8217;activitats si estan prohibides en els estatuts de les comunitats de propietaris.<\/li>\n<\/ul>\n<h3><strong>Prohibici\u00f3 dels lloguers tur\u00edstics<\/strong><\/h3>\n<p>El Tribunal Suprem, en les seves sent\u00e8ncies del 3 d&#8217;octubre de 2024, ha resolt que les comunitats de propietaris tenen la facultat de prohibir l&#8217;activitat de lloguers tur\u00edstics amb l&#8217;acord d&#8217;una majoria de tres cinquens dels propietaris presents en la junta de ve\u00efns. Aix\u00f2 significa que no ser\u00e0 necessari l&#8217;acord un\u00e0nime de tots els propietaris, com es pensava pr\u00e8viament.<\/p>\n<h3><strong>Decisi\u00f3 del Tribunal Suprem<\/strong><\/h3>\n<p>Aquesta decisi\u00f3 es fonamenta en la interpretaci\u00f3 de l&#8217;article 17.12 de la Llei de propietat horitzontal, modificat pel Reial decret llei 7\/2019, que regula les decisions de les juntes de propietaris. El Tribunal Suprem ha aclarit que aquesta norma permet limitar o prohibir l&#8217;\u00fas dels pisos per a lloguer tur\u00edstic sense necessitat d&#8217;unanimitat, sempre que s&#8217;aconsegueixi la majoria refor\u00e7ada de tres cinquens.<\/p>\n<h3><strong>Facultats de les comunitats de propietaris<\/strong><\/h3>\n<p>Aquesta decisi\u00f3 atorga m\u00e9s poder a les comunitats de ve\u00efns per a regular l&#8217;\u00fas dels immobles dins de l&#8217;edifici i protegir la conviv\u00e8ncia.
