Ens trobem davant un delicat equilibri entre el dret de l&#8217;ocupador a supervisar les tasques dels seus treballadors i la protecci\u00f3 de la intimitat personal, un principi innegociable garantit constitucionalment.<\/h5>\n<hr \/>\n<p>La videovigil\u00e0ncia laboral \u00e9s una eina poderosa, per\u00f2 ha d&#8217;emprar-se amb prud\u00e8ncia i respecte als drets fonamentals. El principi de proporcionalitat guia la seva validesa:<\/p>\n<ul>\n<li>Ha d&#8217;existir una finalitat clara i justificada.<\/li>\n<li>Les c\u00e0meres no poden envair \u00e0rees privades o de descans.<\/li>\n<li>La seva instal\u00b7laci\u00f3 i abast han de ser comunicats als treballadors, amb excepcions concretes.<\/li>\n<\/ul>\n<p>Els tribunals han marcat els l\u00edmits: la vigil\u00e0ncia desproporcionada o invasiva s&#8217;invalida, fins i tot quan les gravacions proven fets irregulars. La clau resideix a equilibrar el control empresarial amb el respecte a la intimitat i dignitat dels empleats.<\/p>\n<p>Per tant, la videovigil\u00e0ncia laboral \u00e9s un tema delicat que enfronta dos drets en aparent conflicte: el <strong>dret de l&#8217;ocupador<\/strong> a supervisar el compliment laboral i protegir els seus b\u00e9ns, i el <strong>dret a la intimitat i privacitat<\/strong> dels treballadors. La normativa espanyola, juntament amb la jurisprud\u00e8ncia nacional i internacional, ha anat marcant l\u00edmits clars per al seu \u00fas i assenyalant les excepcions en les quals pot justificar-se.<\/p>\n<p>A continuaci\u00f3, analitzarem els <strong>criteris legals<\/strong> per a instal\u00b7lar sistemes de videovigil\u00e0ncia, les excepcions m\u00e9s rellevants i les \u00faltimes sent\u00e8ncies que han establert precedents.<\/p>\n<h3><strong>1. Instal\u00b7laci\u00f3 de c\u00e0meres: obligacions i l\u00edmits<\/strong><\/h3>\n<p>Segons la Llei org\u00e0nica 3\/2018 (LOPDGDD), qualsevol sistema de videovigil\u00e0ncia ha de complir amb els seg\u00fcents requisits:<\/p>\n<ul>\n<li><strong>Informaci\u00f3 pr\u00e8via<\/strong>: l&#8217;empresa ha d&#8217;informar els treballadors i, si \u00e9s el cas, als seus representants, de manera <strong>expressa, clara i concisa<\/strong> sobre l&#8217;exist\u00e8ncia de c\u00e0meres.<\/li>\n<li><strong>Proporcionalitat<\/strong>: la mesura ha de ser adequada i necess\u00e0ria, respectant el <strong>principi de proporcionalitat<\/strong>.<\/li>\n<li><strong>\u00c0rees sensibles<\/strong>: les c\u00e0meres no han d&#8217;instal\u00b7lar-se en <strong>vestidors, lavabos, menjadors<\/strong> o altres espais destinats al descans o privacitat.<\/li>\n<\/ul>\n<h3><strong>2. Videovigil\u00e0ncia desproporcionada: un \u00fas abusiu<\/strong><\/h3>\n<p>El TSJ de Castella-la Manxa (02-11-2023) ofereix un exemple clau de vigil\u00e0ncia desmesurada. Encara que les c\u00e0meres no gravaven \u00e0rees privades, capturaven zones sensibles com a <strong>taquilles, accessos a banys i menjadors<\/strong>. A m\u00e9s, el control efectuat era <strong>excessiu<\/strong>, en supervisar detalladament els moviments i gestos dels empleats.<\/p>\n<p>Per al Tribunal, la videovigil\u00e0ncia va vulnerar el dret a la intimitat per la seva <strong>intensitat desproporcionada<\/strong>, obligant l&#8217;empresa a retirar les c\u00e0meres i a indemnitzar als treballadors.<\/p>\n<ul>\n<li><strong>Atenci\u00f3. <\/strong>\u00a0El control empresarial no pot excedir els l\u00edmits raonables; fins i tot una instal\u00b7laci\u00f3 legal pot invalidar-se si el seu \u00fas resulta abusiu.<\/li>\n<\/ul>\n<h3><strong>3. Videovigil\u00e0ncia durant el descans: una excepci\u00f3 v\u00e0lida<\/strong><\/h3>\n<p>El Tribunal Suprem (TS 13-10-2021) va considerar procedent l&#8217;acomiadament d&#8217;un conductor que, durant el seu descans, va fumar a l&#8217;autob\u00fas, va orinar a l&#8217;exterior i va interactuar de manera indeguda amb una passatgera. Les raons de validesa foren aquestes:<\/p>\n<ul>\n<li>La <strong>finalitat<\/strong> de les c\u00e0meres era garantir la <strong>seguretat<\/strong> del vehicle i les persones.<\/li>\n<li>Els treballadors estaven <strong>informats<\/strong> de la seva exist\u00e8ncia mitjan\u00e7ant distintius visibles.<\/li>\n<li>No es requeria consentiment del treballador en tractar-se de <strong>mesures de seguretat<\/strong>.<\/li>\n<\/ul>\n<p><strong>Atenci\u00f3.<\/strong> La vigil\u00e0ncia amb finalitats de seguretat en per\u00edodes de descans \u00e9s v\u00e0lida si respecta els l\u00edmits i la proporcionalitat.<\/p>\n<h4><strong>4. C\u00e0meres ocultes: quan s\u00f3n legals<\/strong><\/h4>\n<p>Encara que la norma general exigeix <strong>informar<\/strong> de la instal\u00b7laci\u00f3 de c\u00e0meres, existeixen <strong>excepcions<\/strong> en casos d&#8217;irregularitats greus. Aquestes situacions han de complir dos requisits:<\/p>\n<ol>\n<li><strong>Sospites fonamentades<\/strong>: ha d&#8217;existir una justificaci\u00f3 raonable que s&#8217;estan cometent actes il\u00b7l\u00edcits.<\/li>\n<li><strong>Mesura necess\u00e0ria<\/strong>: no han d&#8217;existir altres alternatives menys intrusives.<\/li>\n<\/ol>\n<p><strong>Exemple. <\/strong>Una fam\u00edlia va instal\u00b7lar una c\u00e0mera oculta al seu domicili despr\u00e9s de sofrir robatoris per valor de 30.000 euros. Les imatges van captar a la seva empleada de llar manipulant la caixa forta, la qual cosa va permetre justificar el seu acomiadament. La mesura va ser considerada proporcionada i necess\u00e0ria.<\/p>\n<p>La instal\u00b7laci\u00f3 de c\u00e0meres ocultes \u00e9s v\u00e0lida quan existeix una necessitat justificada i no hi ha mitjans menys invasius per a verificar els fets.<\/p>\n<h3><strong>5. La gravaci\u00f3 d&#8217;\u00e0udio: un l\u00edmit infranquejable<\/strong><\/h3>\n<p>El TSJ de Burgos (02-05-2024) va declarar nul\u00b7la la gravaci\u00f3 d&#8217;una treballadora que havia com\u00e8s un furt. Encara que la instal\u00b7laci\u00f3 de c\u00e0meres de videovigil\u00e0ncia era v\u00e0lida, la gravaci\u00f3 inclo\u00efa \u00e0udio, un aspecte que no va ser informat.<\/p>\n<p>Per al Tribunal, la gravaci\u00f3 de sons requereix consentiment previ dels treballadors, excepte en casos excepcionals relacionats amb la seguretat.<\/p>\n<p><strong>Atenci\u00f3. <\/strong>La gravaci\u00f3 d&#8217;\u00e0udio \u00e9s m\u00e9s intrusiva que la videovigil\u00e0ncia i requereix un major grau de justificaci\u00f3 i transpar\u00e8ncia.<\/p>\n<h3><strong>6. C\u00e0meres en vestidors i zones de descans: un terreny prohibit<\/strong><\/h3>\n<p>El TSJ de Catalunya (29-06-2023) va resoldre el cas d&#8217;una treballadora acomiadada despr\u00e9s de ser gravada orinant en recipients de cuina en l&#8217;obrador. La zona servia tamb\u00e9 com a vestidor, per la qual cosa el tribunal va declarar improcedent l&#8217;acomiadament.<\/p>\n<p>Per al Tribunal, la videovigil\u00e0ncia en <strong>\u00e0rees de privacitat<\/strong> (vestidors o zones de descans) est\u00e0 prohibida, fins i tot quan existeixi una finalitat disciplin\u00e0ria.<\/p>\n<ul>\n<li><strong>Atenci\u00f3. <\/strong>Les c\u00e0meres no han de col\u00b7locar-se en espais que comprometin la intimitat personal, per molt justificada que sigui la mesura.<\/li>\n<\/ul>\n<p>En definitiva, la videovigil\u00e0ncia en l&#8217;\u00e0mbit laboral \u00e9s una eina v\u00e0lida, per\u00f2 el seu \u00fas ha d&#8217;ajustar-se estrictament a la legalitat i respectar els drets fonamentals dels treballadors.<\/p>\n<ul>\n<li>La <strong>informaci\u00f3 pr\u00e8via<\/strong> i el <strong>principi de proporcionalitat<\/strong> s\u00f3n requisits indispensables.<\/li>\n<li>Les <strong>c\u00e0meres ocultes<\/strong> s\u00f3n excepcionals i nom\u00e9s es justifiquen davant sospites fundades i la inexist\u00e8ncia d&#8217;alternatives menys invasives.<\/li>\n<li>La <strong>gravaci\u00f3 d&#8217;\u00e0udio<\/strong> requereix consentiment expl\u00edcit.<\/li>\n<li>Els <strong>espais privats<\/strong> com a vestidors, lavabos o zones de descans estan fora dels l\u00edmits permesos.<\/li>\n<\/ul>\n<p>El desafiament per a les empreses \u00e9s <strong>protegir els seus interessos sense vulnerar la dignitat i privacitat<\/strong> dels treballadors.
