{"id":13736,"date":"2025-04-30T19:07:43","date_gmt":"2025-04-30T17:07:43","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=13736"},"modified":"2025-04-30T19:12:34","modified_gmt":"2025-04-30T17:12:34","slug":"infraccions-i-sancions-en-materia-de-lloguer-i-venda-dhabitatges","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/infraccions-i-sancions-en-materia-de-lloguer-i-venda-dhabitatges\/","title":{"rendered":"Infraccions i sancions en mat\u00e8ria de lloguer i venda d&#8217;habitatges pel que fa refer\u00e8ncia a la certificaci\u00f3 energ\u00e8tica i c\u00e9dula d&#8217;habitabilitat."},"content":{"rendered":"<h5>Tal com ens recorda el Col\u00b7legi API de Girona, hi ha tot un seguit d&#8217;accions relacionades amb la certificaci\u00f3 d&#8217;efici\u00e8ncia energ\u00e8tica dels edificis i c\u00e9dula d&#8217;habitabilitat\u00a0que estan penalitzades pel <span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000;\" href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11723\">Reial Decret Legislatiu 7\/2015<\/a><\/em><\/span>, del 30 d&#8217;octubre, pel qual s&#8217;aprova el text ref\u00f3s de la Llei de S\u00f2l i Rehabilitaci\u00f3 Urbana.<\/h5>\n<hr \/>\n<h3>Quines accions estan penalitzades ?<\/h3>\n<h4>a) Constitueixen infraccions lleus:<\/h4>\n<ul>\n<li>Fer publicitat de la venda o el lloguer d&#8217;edificis o unitats d&#8217;edificis que hagin de disposar de certificat d&#8217;efici\u00e8ncia energ\u00e8tica sense fer menci\u00f3 de la qualificaci\u00f3 d&#8217;efici\u00e8ncia energ\u00e8tica.<\/li>\n<li>No exhibir l&#8217;etiqueta d&#8217;efici\u00e8ncia energ\u00e8tica en els casos en qu\u00e8 sigui obligatori.<\/li>\n<li>L&#8217;expedici\u00f3 de certificats d&#8217;efici\u00e8ncia energ\u00e8tica que no inclou la informaci\u00f3 m\u00ednima exigida.<\/li>\n<li>Incomplir les obligacions de renovaci\u00f3 o actualitzaci\u00f3 de certificats d&#8217;efici\u00e8ncia energ\u00e8tica.<\/li>\n<li>L&#8217;exhibici\u00f3 d&#8217;etiqueta d&#8217;efici\u00e8ncia energ\u00e8tica sense el format i el contingut m\u00ednim establerts legalment.<\/li>\n<li>Publicitar la qualificaci\u00f3 obtinguda a la certificaci\u00f3 d&#8217;efici\u00e8ncia energ\u00e8tica del projecte, quan ja es disposa del certificat d&#8217;efici\u00e8ncia energ\u00e8tica de l&#8217;edifici acabat.<\/li>\n<\/ul>\n<h4>b) Constitueixen infraccions greus:<\/h4>\n<ul>\n<li>Incomplir l&#8217;obligaci\u00f3 de presentar el certificat d&#8217;efici\u00e8ncia energ\u00e8tica davant l&#8217;\u00f2rgan competent de la comunitat aut\u00f2noma en mat\u00e8ria de certificaci\u00f3 energ\u00e8tica d&#8217;on s&#8217;ubiqui l&#8217;edifici, per registrar-lo.<\/li>\n<li>Exhibir una etiqueta que no correspongui amb el certificat d&#8217;efici\u00e8ncia energ\u00e8tica v\u00e0lidament em\u00e8s, registre i en vigor.<\/li>\n<li>Vendre o llogar un immoble sense que el venedor o l&#8217;arrendador lliuri el certificat d&#8217;efici\u00e8ncia energ\u00e8tica, v\u00e0lid, registre i en vigor, al comprador o arrendatari.<\/li>\n<\/ul>\n<h4>c) Constitueixen infraccions molt greus:<\/h4>\n<ul>\n<li>Falsejar la informaci\u00f3 a l&#8217;expedici\u00f3 o registre de certificats d&#8217;efici\u00e8ncia energ\u00e8tica.<\/li>\n<li>Publicitar en la venda o el lloguer d&#8217;edificis o part d&#8217;edificis, una qualificaci\u00f3 d&#8217;efici\u00e8ncia energ\u00e8tica que no recolzada per un certificat en vigor degudament registrat.<\/li>\n<\/ul>\n<h3>\u00a0Qui es considera responsable ?<\/h3>\n<p>&nbsp;<\/p>\n<p>S\u00f3n subjectes responsables de les infraccions tipificades en aquesta disposici\u00f3, les persones f\u00edsiques o jur\u00eddiques i les comunitats de b\u00e9ns que les cometin, encara que un t\u00edtol de simple inobservan\u00e7a.<\/p>\n<h3>Sancions en mat\u00e8ria de certificaci\u00f3 energ\u00e8tica d&#8217;edificis i graduaci\u00f3:<\/h3>\n<p>a) Les infraccions lleus, amb multa de 300 a 600 euros.<br \/>\nb) Les infraccions greus, amb una multa de 601 a 1.000 euros.<br \/>\nc) Les infraccions molt greus, amb una multa de 1.001 a 6.000 euros.<\/p>\n<h3>Recordatori sobre la vig\u00e8ncia de les c\u00e8dules d&#8217;habitabilitat<\/h3>\n<p>Les c\u00e8dules d&#8217;habitabilitat tenen una vig\u00e8ncia de 15 anys. Les c\u00e8dules expedides amb anterioritat a l&#8217;any 2003 caduquen al cap de 10 anys.<\/p>\n<p>La llei determina que \u00e9s una infracci\u00f3 greu llogar, vendre o cedir un habitatge que no garanteix les condicions d&#8217;habitabilitat relatives a la seguretat i la c\u00e8dula \u00e9s obligat\u00f2ria.
