La Direcci\u00f3 General de Treball ha publicat una guia que, sense ser vinculant, serveix com a br\u00faixola per a aplicar correctament aquesta obligaci\u00f3.<\/h5>\n<hr \/>\n<p>Les empreses estan obligades a portar un control diari i objectiu de la jornada laboral de cada treballador i la Direcci\u00f3 General de Treball ha publicat una<span style=\"color: #ff0000;\"><em> <a style=\"color: #ff0000;\" href=\"https:\/\/www.mites.gob.es\/ficheros\/ministerio\/GuiaRegistroJornada.pdf\">guia informativa<\/a> <\/em><\/span>que, sense ser jur\u00eddicament vinculant, ofereix criteris clars sobre com s&#8217;ha d&#8217;aplicar aquest registre. Destaquem el seg\u00fcent:<\/p>\n<h4><strong>1. A qui s&#8217;aplica l&#8217;obligaci\u00f3 de registrar la jornada?<\/strong><\/h4>\n<p>A tots els treballadors per compte d&#8217;altri, independentment de la seva categoria, grup professional, sector o jornada (completa o parcial). \u00c9s igual si es treballa en oficina, en remot o en mobilitat. L&#8217;obligaci\u00f3 recau sobre l&#8217;ocupador, que ha de garantir que el sistema funciona i s&#8217;aplica di\u00e0riament.<\/p>\n<h4><strong>2. Hi ha excepcions a aquesta obligaci\u00f3?<\/strong><\/h4>\n<p>S\u00ed. El registre diari no s&#8217;aplica a:<\/p>\n<ul>\n<li>Alts directius, emparats per l&#8217;article 2.1.a de l&#8217;Estatut dels Treballadors.<\/li>\n<li>Aut\u00f2noms, fins i tot si treballen per a una empresa client.<\/li>\n<\/ul>\n<p><strong>Atenci\u00f3. <\/strong>Altres col\u00b7lectius amb normativa sectorial pr\u00f2pia (per exemple, treballadors de la mar o del transport) poden tenir particularitats que cal consultar-les cas a cas.<\/p>\n<h4><strong>3. Qu\u00e8 ha de reflectir el registre?<\/strong><\/h4>\n<p>L&#8217;inici i final de la jornada di\u00e0ria de cada treballador. No n&#8217;hi ha prou amb indicar el nombre d&#8217;hores. Es requereix hora concreta d&#8217;entrada i sortida. Aix\u00f2 permet comprovar si es respecta la jornada pactada, el descans entre jornades i els l\u00edmits legals.<\/p>\n<h4><strong>4. S&#8217;han d&#8217;anotar pauses?<\/strong><\/h4>\n<p>No \u00e9s obligatori, per\u00f2 s\u00ed altament recomanable, sobretot si formen part de la jornada efectiva. Incloure pauses ajuda a justificar desviacions i evita conflictes. Si no es registren, es pot assumir que tot el temps transcorregut entre entrada i sortida \u00e9s temps treballat.<\/p>\n<h4><strong>5. S&#8217;ha de reflectir el temps de treball efectiu?<\/strong><\/h4>\n<p>S\u00ed, indirectament. Encara que la llei no obliga a desglossar quina part del temps \u00e9s efectiu, el c\u00f2mput d&#8217;entrada i sortida permet inferir-lo. L&#8217;empresari haur\u00e0 de ser capa\u00e7 de justificar temps de descans o no treball efectiu si vol excloure&#8217;ls del c\u00f2mput.<\/p>\n<h4><strong>6. Puc registrar gen\u00e8ricament una jornada est\u00e0ndard?<\/strong><\/h4>\n<p>No. La jornada s&#8217;ha de registrar dia a dia. Models predefinits o gen\u00e8rics, sense marca hor\u00e0ria real, no s\u00f3n v\u00e0lids, tret que coincideixin exactament amb l&#8217;horari pactat i no hi hagi desviacions. En la pr\u00e0ctica, \u00e9s arriscat.<\/p>\n<h4><strong>7. Qu\u00e8 passa si hi ha flexibilitat hor\u00e0ria?<\/strong><\/h4>\n<p>S&#8217;ha de registrar igualment. El registre no entra a valorar si la jornada \u00e9s flexible o no, sin\u00f3 si es compleix el c\u00f2mput d&#8217;hores i els descansos legals. La flexibilitat no elimina l&#8217;obligaci\u00f3, nom\u00e9s modifica el patr\u00f3.<\/p>\n<h4><strong>8. Val un document signat di\u00e0riament?<\/strong><\/h4>\n<p>S\u00ed, sempre que reflecteixi l&#8217;inici i la fi de la jornada d&#8217;aquest dia. No n&#8217;hi ha prou amb un full signat setmanalment o mensual. El car\u00e0cter diari \u00e9s essencial.<\/p>\n<h4><strong>9. Hi ha un model oficial de registre?<\/strong><\/h4>\n<p>No. El Ministeri no ha aprovat ni exigit un format \u00fanic. Cada empresa pot implementar el sistema que consideri adequat, sempre que sigui objectiu, fiable i accessible per a inspecci\u00f3, treballador i representants legals.<\/p>\n<h4><strong>10. Es pot fer a m\u00e0?<\/strong><\/h4>\n<p>S\u00ed, encara que no \u00e9s l&#8217;ideal. Els registres manuals signats s\u00f3n v\u00e0lids si s\u00f3n diaris, complets i estan degudament conservats. No obstant aix\u00f2, no ofereixen la mateixa tra\u00e7abilitat ni seguretat que els digitals, i poden generar dubtes sobre la seva integritat.<\/p>\n<h4><strong>11. S\u00f3n v\u00e0lides les apps o eines digitals?<\/strong><\/h4>\n<p>S\u00ed. Moltes empreses fan servir sistemes digitals, apps m\u00f2bils o targetes RFID. L&#8217;important \u00e9s que el sistema no permeti alteracions i garanteixi la tra\u00e7abilitat dels registres.<\/p>\n<h4><strong>12. Qui ha de custodiar els registres?<\/strong><\/h4>\n<p>L&#8217;empresa \u00e9s la responsable, i ha de garantir la seva integritat, disponibilitat i acc\u00e9s immediat en cas d&#8217;inspecci\u00f3.<\/p>\n<h4><strong>13. Quines caracter\u00edstiques ha de tenir el sistema?<\/strong><\/h4>\n<ul>\n<li>Fiable (no manipulable).<\/li>\n<li>Objectiu (reflecteix la jornada real).<\/li>\n<li>Accessible (inspecci\u00f3 o treballador poden consultar-lo).<\/li>\n<li>Segur (compleix normativa de protecci\u00f3 de dades).<\/li>\n<\/ul>\n<h4><strong>14. Cal lliurar c\u00f2pia di\u00e0ria al treballador?<\/strong><\/h4>\n<p>No \u00e9s obligatori, tret que aix\u00ed ho exigeixi el conveni col\u00b7lectiu o es pacti expressament. No obstant aix\u00f2, el treballador t\u00e9 dret a accedir als seus registres quan els sol\u00b7liciti.<\/p>\n<h4><strong>15. Quant temps cal conservar els registres?<\/strong><\/h4>\n<p>Quatre anys. I durant aquest temps han d&#8217;estar disponibles de manera immediata per a la Inspecci\u00f3 de Treball.<\/p>\n<h4><strong>16. On s&#8217;han de conservar?<\/strong><\/h4>\n<p>Al centre de treball o en un suport digital accessible des d&#8217;ell. No cal mantenir una carpeta f\u00edsica, per\u00f2 s\u00ed que ha d&#8217;haver-hi un mode immediat d&#8217;acc\u00e9s.<\/p>\n<h4><strong>17. Qui pot veure el registre?<\/strong><\/h4>\n<ul>\n<li>La Inspecci\u00f3 de Treball<\/li>\n<li>El treballador (les seves dades).<\/li>\n<li>Els representants legals, per\u00f2 nom\u00e9s amb acc\u00e9s al resum de jornada col\u00b7lectiva, excepte acord distint.<\/li>\n<\/ul>\n<h4><strong>18. Quins drets tenen els representants dels treballadors ?<\/strong><\/h4>\n<p>Poden accedir als registres per a verificar el compliment de la normativa laboral. No tenen acc\u00e9s a dades individualitzades excepte consentiment del treballador o pacte expr\u00e9s.<\/p>\n<h4><strong>19. Com registrar els treballadors en mobilitat o teletreball?<\/strong><\/h4>\n<p>Amb mitjans adequats a la seva situaci\u00f3: apps, plataformes, autocertificacions verificables&#8230; L&#8217;essencial \u00e9s que el sistema funcioni amb independ\u00e8ncia del lloc des del qual es treballi.<\/p>\n<h4><strong>20. I si el treballador es nega a fitxar?<\/strong><\/h4>\n<p>Cal instruir el treballador sobre l&#8217;obligatorietat. Si persisteix la negativa, podr\u00e0 considerar-se una infracci\u00f3 laboral, amb possibilitat de mesures disciplin\u00e0ries.<\/p>\n<h4><strong>21.
