La llei distingeix entre retards puntuals i retards continuats, i no tots tenen la mateixa gravetat.<\/span><\/p>\n<div class=\"summary\">\n<hr \/>\n<\/div>\n<div class=\"content\">\n<p>Quan una empresa passa per un sot de tresoreria, la n\u00f2mina \u00e9s l&#8217;\u00faltim que es vol tocar&#8230; per\u00f2, a vegades, no queda m\u00e9s remei.\u00a0 El preocupant \u00e9s que, des del punt de vista legal, aquests retards estan molt lluny de considerar-se un &#8220;simple problema puntual&#8221;.<\/p>\n<p>La normativa laboral \u00e9s bastant clara: <strong>el salari cal pagar-lo a temps i amb regularitat<\/strong>. No \u00e9s un aspecte negociable ni una cosa que es pugui ajornar . La llei ent\u00e9n que el sou \u00e9s la base de l&#8217;estabilitat del treballador i, quan aquesta base falla, activa mecanismes bastant contundents.<\/p>\n<h3>Interessos:<\/h3>\n<p>Quan el deute salarial \u00e9s clar, exigible, ven\u00e7ut i l\u00edquid, i no hi ha controv\u00e8rsia rellevant sobre la seva proced\u00e8ncia o quantia, l&#8217;empresari ve obligat a pagar tamb\u00e9 al treballador un\u00a0 inter\u00e8s del 10% anual sobre la quantitat deguda, d&#8217;acord amb l&#8217;article 29.3 de l&#8217;Estatut dels treballador.<\/p>\n<h3>Situacions que poden comportar, a m\u00e9s, l&#8217;extinci\u00f3 del contracte de treball i haver d&#8217;indemnitzar el treballador:<\/h3>\n<ul>\n<li>Quan el treballador arriba a acumular\u00a0<strong>tres mensualitats sense cobrar<\/strong>\u00a0en el mateix any, encara que no siguin seguides;<\/li>\n<li>O quan l&#8217;empresa es retarda\u00a0<strong>m\u00e9s de quinze dies<\/strong>\u00a0en el pagament del salari i aix\u00f2 succeeix\u00a0<strong>sis vegades<\/strong> dins de l&#8217;any.<\/li>\n<\/ul>\n<p>Si succeeix qualsevol de les dues coses, el treballador t\u00e9 dret a <strong style=\"font-size: 16px;\">posar fi a la relaci\u00f3 laboral i marxar amb la indemnitzaci\u00f3 pr\u00f2pia d&#8217;un acomiadament improcedent, <\/strong>a m\u00e9s de tenir dret al salari degut i als interessos corresponents.<\/p>\n<div class=\"n4sEPd\">\n<div class=\"QFw9Te BLojaf\">\n<div id=\"ow13\" class=\"NQSJo\"><span style=\"font-size: 16px;\">La indemnitzaci\u00f3 per acomiadament improcedent es calcula, amb car\u00e0cter general, a ra\u00f3 de 33 dies de salari per any de servei, amb un m\u00e0xim de 24 mensualitats, encara que per a contractes iniciats abans del 12 de febrer del 2012 s&#8217;aplica una f\u00f3rmula mixta que distingeix entre els per\u00edodes anteriors i posteriors a aquesta data.<\/span><\/div>\n<\/div>\n<\/div>\n<h3>Recomanem:<\/h3>\n<p>Si existeix un problema real de liquiditat, conv\u00e9 anticipar-lo, explicar-lo de manera transparent, avaluar alternatives i, sobretot, evitar que els retards es converteixin en h\u00e0bit. Quan una situaci\u00f3 aix\u00ed comen\u00e7a a repetir-se, ja no dep\u00e8n de la comprensi\u00f3 del treballador: dep\u00e8n de la llei, i la llei aqu\u00ed \u00e9s especialment estricta.<\/p>\n<h3>Punts clau que les empreses han de tenir molt presents<\/h3>\n<ul>\n<li>Tres mensualitats sense pagar en un any poden permetre que el treballador extingeixi el seu contracte amb indemnitzaci\u00f3 m\u00e0xima.<\/li>\n<li>Pagaments amb m\u00e9s de quinze dies de retard, repetits sis vegades l&#8217;any, tenen el mateix efecte.<\/li>\n<li>L&#8217;inter\u00e8s per mora del 10% anual s&#8217;activa autom\u00e0ticament.<\/li>\n<li>La Inspecci\u00f3 pot considerar la conducta greu o molt greu segons la reiteraci\u00f3 i pot sancionar l&#8217;empresa.<\/li>\n<li>Els procediments judicials per impagament de salaris solen resoldre&#8217;s r\u00e0pid.<\/li>\n<li>La falta de pagament no es cobreix al\u00b7legant dificultats econ\u00f2miques: la llei no ho admet.<\/li>\n<\/ul>\n<p><img decoding=\"async\" src=\"https:\/\/www.comunicado.es\/media\/backoffice\/files\/images\/pexels-photo-8171200-1763539933_1763541931image.jpeg\" alt=\"\" \/><\/p>\n<h5><span style=\"color: #3366ff;\"><em>Som assessors laborals i de la Seguretat Social.
