Aix\u00f2 \u00e9s el que ha de saber avui"},"content":{"rendered":"<h1><\/h1>\n<p class=\"image\"><span style=\"font-size: 1.2em; font-weight: bold;\">Si t\u00e9 una hipoteca referenciada a l\u2019IRPH, conv\u00e9 revisar com es va signar. El Tribunal Suprem ha deixat clar que no totes les cl\u00e0usules s\u00f3n iguals i que algunes poden examinar-se amb detall per determinar si els interessos aplicats son abusius.<\/span><\/p>\n<div class=\"summary\">\n<hr \/>\n<\/div>\n<div class=\"content\">\n<p>Durant anys, l&#8217;IRPH (\u00edndex de refer\u00e8ncia de pr\u00e9stecs hipotecaris) ha estat un d&#8217;aquests \u00edndexs que generen m\u00e9s dubtes que certeses. Molts clients se&#8217;l miraven amb desconfian\u00e7a, d&#8217;altres ni sabien que el tenien, i alguns han viscut aut\u00e8ntiques odissees intentant entendre per qu\u00e8 la seva quota pujava m\u00e9s que la del ve\u00ed. Ara, amb les \u00faltimes decisions del Tribunal Suprem (TS), per fi comencem a tenir un mapa m\u00e9s clar. I aix\u00f2 significa una cosa important: avui \u00e9s m\u00e9s senzill saber si la seva hipoteca t\u00e9 recorregut per a reclamar o si est\u00e0 aplicada correctament.<\/p>\n<p>Al nostre despatx fa setmanes que analitzem aquestes resolucions i hi ha una idea clau que conv\u00e9 explicar amb calma:\u00a0<strong>l&#8217;IRPH no s&#8217;anul\u00b7la autom\u00e0ticament, per\u00f2 tampoc \u00e9s v\u00e0lida sense m\u00e9s ni m\u00e9s<\/strong>. Cada cas dep\u00e8n de la informaci\u00f3 que es va lliurar al client quan va signar la hipoteca i de com estava redactada la cl\u00e0usula.<\/p>\n<h3>Aix\u00f2, dit de forma m\u00e9s simple, significa que:<\/h3>\n<ul>\n<li>Pot ser que la seva hipoteca estigui b\u00e9;<\/li>\n<li>Pot ser que tingui dret a reclamar;<\/li>\n<li>O pot ser que el banc no s&#8217;expliqu\u00e9s prou i tingui opcions reals de recuperar diners<\/li>\n<\/ul>\n<p>I per a saber-ho, \u00e9s imprescindible revisar la seva documentaci\u00f3.<\/p>\n<h3><strong>Qu\u00e8 diu avui el Tribunal Suprem?<\/strong><\/h3>\n<p>El Suprem ha deixat clar que no existeix una resposta \u00fanica: no totes les hipoteques amb IRPH s\u00f3n abusives, per\u00f2\u00a0<strong>algunes s\u00ed que poden ser-ho<\/strong>, i dep\u00e8n de si es va informar b\u00e9 el consumidor.<\/p>\n<p>Els jutges estan mirant coses com:<\/p>\n<ul>\n<li>Si li van explicar com es calculava l&#8217;IRPH,<\/li>\n<li>Si va tenir acc\u00e9s a l&#8217;escriptura abans de signar,<\/li>\n<li>Si va entendre el diferencial, la TAE i la f\u00f3rmula de l&#8217;\u00edndex,<\/li>\n<li>Si sabia que l&#8217;IRPH funcionava de manera distinta a l&#8217;Eur\u00edbor,<\/li>\n<li>Si va rebre documentaci\u00f3 pr\u00e8via o si tot es va resumir en &#8220;signi aqu\u00ed&#8221;.<\/li>\n<\/ul>\n<p>Un fet tan b\u00e0sic com haver tingut altres pr\u00e9stecs abans, o haver rebut l&#8217;escriptura uns dies abans de la signatura, pot canviar el resultat. Per aix\u00f2 insistim:\u00a0<strong>cada cas cal mirar-lo amb lupa<\/strong>.<\/p>\n<h3><strong>Qu\u00e8 significa aix\u00f2?<\/strong><\/h3>\n<p>Si t\u00e9 una hipoteca amb IRPH, el l\u00f2gic \u00e9s preguntar-se:\u00a0<strong>puc reclamar? Puc recuperar interessos? La meva cl\u00e0usula era transparent?<\/strong><\/p>\n<p>La resposta ja no la trobem en articles generalistes o en v\u00eddeos apocal\u00edptics. La resposta la trobar\u00e0 a la seva escriptura, a la seva oferta vinculant, als papers que li van lliurar i en el que realment va poder entendre quan es vas asseure davant del notari.<\/p>\n<p>Amb les noves sent\u00e8ncies, hi ha clients que:<\/p>\n<ul>\n<li>no podran reclamar, perqu\u00e8 el seu banc va informar correctament;<\/li>\n<li>s\u00ed que podran reclamar, perqu\u00e8 la informaci\u00f3 va ser insuficient;<\/li>\n<li>i d&#8217;altres que, encara que la cl\u00e0usula no fos del tot transparent, tampoc podran anul\u00b7lar-la si no va existir un desequilibri real en contra seu.<\/li>\n<\/ul>\n<p><strong>No tots guanyen. No tots perden. Per\u00f2 molts poden saber-ho avui amb certesa.<\/strong><\/p>\n<h3><strong>Si t\u00e9 IRPH, aix\u00f2 l&#8217;interessa<\/strong><\/h3>\n<p>Una revisi\u00f3 professional pot ajudar-lo a saber:<\/p>\n<ul>\n<li>Si la seva cl\u00e0usula compleix amb la transpar\u00e8ncia que exigeix la llei;<\/li>\n<li>Si va haver-hi falta d&#8217;informaci\u00f3 en el moment de contractar;<\/li>\n<li>Si existeix un possible desequilibri econ\u00f2mic;<\/li>\n<li>Quant podria recuperar si l&#8217;\u00edndex fos declarat nul en el seu cas;<\/li>\n<li>I si realment val la pena iniciar la reclamaci\u00f3 o no.<\/li>\n<\/ul>\n<p>No tots els casos justifiquen una demanda, per\u00f2 els que s\u00ed que tenen recorregut solen tenir imports importants en joc.<\/p>\n<h3><strong>En qu\u00e8 el podem ajudar<\/strong><\/h3>\n<p>El nostre equip analitza la seva hipoteca:<\/p>\n<ul>\n<li>Revisem tota la documentaci\u00f3,<\/li>\n<li>Estudiem si encaixa en els sup\u00f2sits que els tribunals consideren reclamables,<\/li>\n<li>I li diem de manera clara si val la pena continuar endavant.<\/li>\n<\/ul>\n<p><strong>Sense tecnicismes absurds. Sense falses expectatives. Nom\u00e9s una resposta clara sobre el seu cas real.<\/strong><\/p>\n<p>Tenir o no tenir dret a reclamar no \u00e9s q\u00fcesti\u00f3 de sort. \u00c9s q\u00fcesti\u00f3 de com es va informar el client, quina documentaci\u00f3 va rebre i qu\u00e8 va entendre.<\/p>\n<p>Si t\u00e9 una hipoteca amb IRPH -o si creu que la t\u00e9-, el m\u00e9s prudent \u00e9s revisar-la ara, amb els criteris que estan aplicant els tribunals.
