Algunes arriben sense av\u00eds i exigeixen una resposta immediata. El perm\u00eds per for\u00e7a major familiar respon a una necessitat concreta: estar on s&#8217;ha d&#8217;estar quan succeeix l&#8217;inesperat.<\/h5>\n<hr \/>\n<p>L&#8217;article 37.9 de l&#8217;Estatut dels Treballadors (ET) reconeix al treballador el dret a absentar-se de la feina quan concorren situacions de for\u00e7a major per motius familiars urgents, vinculades a malaltia o accident i que fan indispensable la seva pres\u00e8ncia immediata.<\/p>\n<p>No es tracta d&#8217;un perm\u00eds ordinari ni d&#8217;una abs\u00e8ncia planificable. \u00c9s una resposta legal a situacions que, senzillament, no s&#8217;esperen.<\/p>\n<h4>For\u00e7a major<\/h4>\n<p>La for\u00e7a major, en aquest context, no es refereix a grans cat\u00e0strofes ni a situacions excepcionals en sentit estricte. Parlem de fets imprevistos, inesperats i urgents, que trenquen la normalitat del dia a dia.<\/p>\n<p>N&#8217;hi ha prou que existeixi una malaltia o un accident que faci imprescindible que el treballador hi sigui present de manera immediata. No cal que la situaci\u00f3 sigui greu en termes m\u00e8dics.<\/p>\n<ul>\n<li><strong>Atenci\u00f3.<\/strong> No s&#8217;exigeix un comunicat de gravetat, sin\u00f3 una urg\u00e8ncia que no admet demora.<\/li>\n<\/ul>\n<h4>A qui protegeix aquest perm\u00eds?<\/h4>\n<p>A difer\u00e8ncia d&#8217;altres permisos de l&#8217;article 37 de l&#8217;ET, aquest dret no limita de manera expressa el grau de parentiu. S&#8217;est\u00e9n a:<\/p>\n<ul>\n<li><strong>Familiars<\/strong>, sense delimitaci\u00f3 legal de grau.<\/li>\n<li><strong>Persones convivents<\/strong>, encara que no existeixi vincle familiar.<\/li>\n<\/ul>\n<p>Aquest enfocament respon a la realitat social actual, on les responsabilitats de cura no sempre encaixen en esquemes familiars tradicionals.<\/p>\n<p>La conviv\u00e8ncia efectiva pot ser tan rellevant com el parentiu.<\/p>\n<h4>Com es gaudeix el perm\u00eds?<\/h4>\n<p>Aquest perm\u00eds no es gaudeix per dies complets, sin\u00f3 per hores d&#8217;abs\u00e8ncia, que permet crear una bossa anual equivalent a quatre dies de treball.<\/p>\n<p>La concreci\u00f3 pr\u00e0ctica (fraccionament, control, \u00fas de la bossa) pot desenvolupar-se en:<\/p>\n<ul>\n<li>Convenis col\u00b7lectius.<\/li>\n<li>Acords entre empresa i representaci\u00f3 legal dels treballadors.<\/li>\n<\/ul>\n<p>En tot cas, dins del l\u00edmit legal, el perm\u00eds \u00e9s retribu\u00eft.<\/p>\n<ul>\n<li><strong>Atenci\u00f3.<\/strong> No \u00e9s un &#8220;dia lliure&#8221;, sin\u00f3 hores justificades per una necessitat concreta.<\/li>\n<\/ul>\n<h4>Retribuci\u00f3 sense retallades encobertes<\/h4>\n<p>La retribuci\u00f3 d&#8217;aquest perm\u00eds no pot suposar discriminacions indirectes, especialment per ra\u00f3 de sexe. Aix\u00f2 implica que no poden excloure&#8217;s conceptes salarials de manera injustificada.<\/p>\n<p>La finalitat del perm\u00eds \u00e9s permetre atendre una urg\u00e8ncia sense penalitzaci\u00f3 econ\u00f2mica.<\/p>\n<ul>\n<li><strong>Atenci\u00f3.<\/strong> Excloure complements salarials pot generar conflictes i reclamacions.<\/li>\n<\/ul>\n<h4>Cal avisar abans?<\/h4>\n<p>La norma \u00e9s clara: no s&#8217;exigeix av\u00eds previ. I t\u00e9 sentit. Quan parlem d&#8217;urg\u00e8ncies familiars, moltes vegades no hi ha marge per a comunicar res abans d&#8217;absentar-se.<\/p>\n<p>Aix\u00f2 s\u00ed, pot exigir-se acreditaci\u00f3 posterior del motiu, sense perjudici del que estableixin convenis o acords col\u00b7lectius.<\/p>\n<p>El control \u00e9s posterior, no previ, excepte regulaci\u00f3 espec\u00edfica.<\/p>\n<h4>\u00c9s necessari haver comen\u00e7at la jornada?<\/h4>\n<p>Una de les q\u00fcestions m\u00e9s discutides ha estat el significat de l&#8217;expressi\u00f3 &#8220;dret a absentar-se&#8221;. \u00c9s necessari haver iniciat la jornada laboral per a poder exercir aquest dret?<\/p>\n<p>El Tribunal Superior de Just\u00edcia de Catalunya, en la seva Sent\u00e8ncia 6341\/2025, de 28 de novembre de 2025 ha declarat que <strong>no \u00e9s necessari<\/strong>.<\/p>\n<p>Interpretar que nom\u00e9s \u00e9s possible el perm\u00eds si el treballador ja \u00e9s al lloc de feina, conduiria a situacions absurdes i contr\u00e0ries a la finalitat del dret. El perm\u00eds cobreix tant les urg\u00e8ncies que sorgeixen durant la jornada com les que apareixen abans d&#8217;incorporar-se a la feina.<\/p>\n<p>El Tribunal Superior de Just\u00edcia de Catalunya subratlla que restringir el perm\u00eds nom\u00e9s als qui ja han iniciat la jornada buidaria de contingut els drets de conciliaci\u00f3 i afectaria de forma especialment negativa als qui assumeixen majorit\u00e0riament les tasques de cura.<\/p>\n<h4>Negociaci\u00f3 col\u00b7lectiva<\/h4>\n<p>La Llei permet que, a trav\u00e9s de convenis col\u00b7lectius, plans d&#8217;igualtat i acords d&#8217;empresa que s&#8217;ampli\u00ef, concreti o moduli l&#8217;\u00fas de la borsa d&#8217;hores i la forma d&#8217;acreditaci\u00f3 de les abs\u00e8ncies.<\/p>\n<p>Aix\u00f2 s\u00ed, sempre respectant el m\u00ednim legal i la finalitat del perm\u00eds.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-medium wp-image-14236\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2025\/10\/1pexels-photo-3184611-1759306433_1759311981image-300x167.jpeg\" alt=\"\" width=\"300\" height=\"167\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2025\/10\/1pexels-photo-3184611-1759306433_1759311981image-300x167.jpeg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2025\/10\/1pexels-photo-3184611-1759306433_1759311981image-768x427.jpeg 768w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2025\/10\/1pexels-photo-3184611-1759306433_1759311981image-600x333.jpeg 600w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2025\/10\/1pexels-photo-3184611-1759306433_1759311981image.jpeg 810w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<h5><em>Som assessors laborals i de la Seguretat Social.
