{"id":14751,"date":"2026-04-17T18:52:41","date_gmt":"2026-04-17T16:52:41","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=14751"},"modified":"2026-04-17T18:52:41","modified_gmt":"2026-04-17T16:52:41","slug":"els-treballadors-interins-de-ladministracio-es-possible-que-passin-a-ser-fixos","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/els-treballadors-interins-de-ladministracio-es-possible-que-passin-a-ser-fixos\/","title":{"rendered":"Els treballadors interins de l&#8217;Administraci\u00f3 es possible que passin a ser fixos"},"content":{"rendered":"<h5>El Tribunal de Just\u00edcia de la Uni\u00f3 Europea (TJUE) obre la porta que l&#8217;Administraci\u00f3 faci fixos els interins i els empleats p\u00fablics que han encadenat contractes temporals durant anys, o a indemnitzar-los per\u00f2 amb una compensaci\u00f3 superior a la m\u00e0xima que hi ha a Espanya de 33 dies per any treballat amb un l\u00edmit de 24 mensualitats.<\/h5>\n<p>Una sent\u00e8ncia recent del TJ de la Uni\u00f3 Europea admet que la Directiva de treball temporal no obliga a Espanya a transformar en indefinits el treballadors interins de les administracions p\u00fabliques, per\u00f2 assenyala que si que l&#8217;imposa articular mesures efectives per evitar abusos. Destaquem el seg\u00fcent:<\/p>\n<h3>Quin es el problema ?<\/h3>\n<p>Durant anys les administracions p\u00fabliques espanyoles han mantingut molts dels seus treballadors, es calcula que a prop de 1.000.000, amb contractes temporals, com interins, sense reconeixer-los el dret a ocupar una pla\u00e7a p\u00fablica.<\/p>\n<p>Alguns dels afectats, es calcula que uns 150.000, han reclamat el seu dret a oupar una pla\u00e7a fixa, en entrendre que, en el seu cas, l&#8217;encadenament de contractes temporals o d&#8217;interinatge no es justificat i constitueix un ab\u00fas de dret per part de l&#8217;Administraci\u00f3.<\/p>\n<h3>Que ha resolt el TJ de la Uni\u00f3 Europea ?<\/h3>\n<p>La sent\u00e8ncia assenyala que cap de les mesures que ha implementat Espanya compleix amb les directives de la Uni\u00f3 Europea. Rebutja, una per una,\u00a0 les solucions que apliquen actualment els tribunals espanyols i les administracions p\u00fabliques per reparar els abusos, i <strong>determina que s&#8217;ha d&#8217;estabilitzar aquests treballadors o se&#8217;ls haur\u00e0 d&#8217;indemnitzar de forma adequada<\/strong>.<\/p>\n<p>La sent\u00e8ncia es mostra contr\u00e0ria a l&#8217;actual sistema d&#8217;indemnitzaci\u00f3 d&#8217;aquests treballadors. La Llei de 2021 per frenar la temporalitat al sector p\u00fablic estableix una compensaci\u00f3 de 20 dies per any treballat i 12 mensualitats nom\u00e9s per a aquells empleats que cessen quan es cobreix la seva pla\u00e7a. <em>&#8220;Indemnitzaci\u00f3 semblant no pot constituir ni la reparaci\u00f3 proporcionada i efectiva de les situacions d&#8217;ab\u00fas que superin una determinada durada ni la reparaci\u00f3 adequada i \u00edntegra dels danys derivats d&#8217;aquests abusos&#8221;.<\/em> Tamb\u00e9 considera por adequada la indemnitzaci\u00f3 per acomiadament improcedent, de 33 dies de salari per any treballat amb un l\u00edmit de 24 mensualitats, en entendre que <em>&#8220;A<span style=\"font-size: 16px;\">questa indemnitzaci\u00f3 tamb\u00e9 t\u00e9 un doble l\u00edmit m\u00e0xim&#8221;<\/span><\/em><\/p>\n<p>Adverteix que aquestes compensacions nom\u00e9s es paguen quan la relaci\u00f3 laboral s&#8217;extingeix per la culminaci\u00f3 del proc\u00e9s selectiu per la qual cosa resulta insuficient per posar remei a tots els casos d&#8217;ab\u00fas &#8220;<em>ja que no sembla que hi tinguin dret els treballadors que es jubilin, dimitin o siguin acomiadats abans que finalitzi el proc\u00e9s selectiu&#8221;<\/em>.<\/p>\n<p>Tamb\u00e9 rebutja que les convocat\u00f2ries per estabilitzar aquests empleats compleixin la seva funci\u00f3, ja que hi participen persones que no estan en situaci\u00f3 d&#8217;ab\u00fas i aquells que ho estan poden no presentar-se o no superar-les. I titlla d&#8217;ambigus els instruments de l&#8217;Administraci\u00f3 per assumir-ne responsabilitats.<\/p>\n<h3>Com s&#8217;interpreta la sent\u00e8ncia ?<\/h3>\n<p>L&#8217;advocat que ha impulsat el cas davant el TJUE ha declarat que la \u00fanica interpretaci\u00f3 possible de la sent\u00e8ncia es que les administracions p\u00fabliques hauran d&#8217;incorporar els afectats com a treballadors fixos.<\/p>\n<p>Tot i aix\u00f2, la interpretaci\u00f3 del Ministeri per a la Transformaci\u00f3 Digital i Funci\u00f3 P\u00fablica va ser la contr\u00e0ria. Va assenyalar que la decisi\u00f3 no obliga Espanya a fer fixos els contractes temporals del sector p\u00fablic. Ha indicat que la sent\u00e8ncia \u00e9s &#8220;merament aclaridora&#8221; i no afecta la normativa nacional ni imposa sanci\u00f3 a l&#8217;Administraci\u00f3 de cap mena.<\/p>\n<p>Ser\u00e0, per tant, el Tribunal Suprem espanyol qui haur\u00e0 de resoldre com s&#8217;ha d&#8217;aplicar la sent\u00e8ncia del TJ de la Uni\u00f3 Europea<\/p>\n<h3>Quina es la conclusi\u00f3 ?<\/h3>\n<p>Segons opinen els analistes, tot i que la sent\u00e8ncia no declara de forma autom\u00e0tica la fixesa per a tots els afectats, s\u00ed que deixa en una posici\u00f3 jur\u00eddicament molt debilitada les solucions que fins ara s&#8217;utilitzaven a Espanya per neutralitzar aquestes reclamacions.<\/p>\n<p>&nbsp;<\/p>\n<h5>Els treballadors de les administracions p\u00fabliques amb contracte inter\u00ed o eventual ens poden consultar i analitzarem la viabilitat d&#8217;exigir que el seu contracte passi a tenir la consideraci\u00f3 de fix.
