Segons una recent sent\u00e8ncia del Tribunal de Just\u00edcia de la Uni\u00f3 Europea s\u00b4hauran  d&#8217;indemnitzar els interins i els temporals en la mateixa forma que els fixes&#8221;"},"content":{"rendered":"<p>La redacci\u00f3 actual de l&#8217;Estatut dels Treballadors, estableix tres nivells d&#8217;indemnitzaci\u00f3 per finalitzaci\u00f3 de contracte:<\/p>\n<ul>\n<li>Contractes fixos o indefinits: 20 dies de salari per any treballat<\/li>\n<li>Contractes temporals: 12 dies de salari per any treballat<\/li>\n<li>Contractes d&#8217;interinitat: sense indemnitzaci\u00f3.<\/li>\n<\/ul>\n<p>El passat 14 de setembre del 2016 la Sala 10\u00aa del Tribunal de Just\u00edcia de la Uni\u00f3 Europea va dictar una <span style=\"text-decoration: underline;\"><em><span style=\"color: #ff0000;\"><a style=\"color: #ff0000; text-decoration: underline;\" href=\"http:\/\/curia.europa.eu\/juris\/document\/document_print.jsf?doclang=ES&amp;text=&amp;pageIndex=0&amp;part=1&amp;mode=DOC&amp;docid=183301&amp;occ=first&amp;dir=&amp;cid=453002\">sent\u00e8ncia<\/a><\/span><\/em><\/span> en la que declara textualment el que segueix:<\/p>\n<ul>\n<li><em><span style=\"text-decoration: underline;\">El mero hecho de que este trabajador haya prestado sus servicios en virtud de un contrato de interinidad no puede constituir una raz\u00f3n objetiva que permita justificar la negativa a que dicho trabajador tenga derecho a la mencionada indemnizaci\u00f3n<\/span>&#8220;<\/em><\/li>\n<\/ul>\n<p>En definitiva, aquesta sent\u00e8ncia considera que la regulaci\u00f3 sobre indemnitzaci\u00f3 per acomiadament no pot tractar de forma discriminat\u00f2ria als treballadors temporals i fixos, i que, a m\u00e9s, la legislaci\u00f3 nacional no pot establir una indemnitzaci\u00f3 per extinci\u00f3 de contracte d&#8217;un treballador inter\u00ed diferent a la d&#8217;un treballador fix acomiadat.\u00a0 Defensa, per tant, que les indemnitzacions per acomiadament han de ser iguals per a tots, tret que hi hagi \u201craons objectives\u201d, entre les quals no es troba el fet de ser indefinit o no.<\/p>\n<p>Es molt probable que a conseq\u00fc\u00e8ncia d&#8217;aquesta sent\u00e8ncia es modifiqui la legislaci\u00f3 espanyola y que, entre tant, prosperin les demandes de treballadors afectats que en acabar el contracte reclamin que els hi siguin reconegudes indemnitzacions de 20 dies de salari per any treballat, encara que el contracte no els hi reconegui el dret a indemnitzaci\u00f3, en cas dels interins, o que els hi reconegui una indemnitzaci\u00f3 de tant sols 12 dies per any treballat , en els cas dels temporals.<\/p>\n<p>Precisament, prova de que aix\u00f2 ser\u00e0 aix\u00ed, en el moment de tancar aquest article hem tingut coneixement de que ahir, dia 5 d&#8217;octubre, el Tribunal Superior de Just\u00edcia de Madrid acaba de recon\u00e8ixer, en base a la sent\u00e8ncia comentada, una indemnitzaci\u00f3 de 20 dies per any d&#8217;antiguitat a una treballadora interina.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica3_16012911.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-795\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica3_16012911.jpg\" alt=\"juridica3\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica3_16012911.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica3_16012911-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<h3><span style=\"color: #ff00ff;\"><em>Som assessors laborals i advocats.
