Com afectar\u00e0 a les hipoteques?"},"content":{"rendered":"<h1 class=\"text-center\"><\/h1>\n<div class=\"summary\">\n<p>En el BOE de 16 de mar\u00e7 de 2019 s&#8217;ha publicat la <span style=\"color: #ff0000;\"><em><a href=\"https:\/\/www.boe.es\/boe\/dias\/2019\/03\/16\/pdfs\/BOE-A-2019-3814.pdf\"><span style=\"color: #ff0000;\">Llei 5\/2019, de 15 de mar\u00e7<\/span><\/a>,<\/em><\/span> reguladora dels contractes de cr\u00e8dit immobiliari (coneguda com la nova \u201cLlei hipotec\u00e0ria\u201d) que entrar\u00e0 en vigor el 16 de juny de 2019 amb l&#8217;objectiu de reduir les despeses associades a modificacions en els contractes hipotecaris i refor\u00e7ar la transpar\u00e8ncia, i est\u00e9n el seu r\u00e8gim jur\u00eddic a totes les persones f\u00edsiques, amb independ\u00e8ncia que siguin o no consumidors. Resumim i destaquem el seg\u00fcent:<\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div class=\"content\">\n<p><strong><span style=\"color: #ff0000;\">\u00c0mbit d&#8217;aplicaci\u00f3 de la llei:<\/span><\/strong><\/p>\n<ul>\n<li>Aquesta llei tant sols s&#8217;aplica als contractes de pr\u00e9stec que reuneixin les tres caracter\u00edstiques seg\u00fcents:\n<ul>\n<li>Que el pr\u00e9stec sigui concedit per persones f\u00edsiques o jur\u00eddiques que intervinguin, en la seva condici\u00f3 d&#8217;empresaris o professionals, amb finalitat inversora. (Es a dir, bancs, caixes, financeres &#8230;)<\/li>\n<li>Que el prestatari (el client), el fiador o garant sigui una persona f\u00edsica (no necess\u00e0riament consumidor).<\/li>\n<li>Que el contracte tingui per objecte la concessi\u00f3 d&#8217;un pr\u00e9stec amb garantia hipotec\u00e0ria o un altre dret real de garantia sobre un immoble d&#8217;\u00fas residencial o la concessi\u00f3 d&#8217;un pr\u00e9stec\u00a0 per a adquirir o conservar drets de propietat sobre terrenys o immobles constru\u00efts o per construir, sempre que, en aquest cas, el prestatari, el fiador o garant sigui consumidor.<\/li>\n<\/ul>\n<\/li>\n<li>Tamb\u00e9 s&#8217;aplica a la intermediaci\u00f3 dels contractes de pr\u00e9stec.<\/li>\n<li>No s&#8217;aplica als seg\u00fcents contractes de pr\u00e9stec:\n<ul>\n<li>Els concedits per una empresa als seus empleats a tipus d&#8217;inter\u00e8s inferior als de mercat.<\/li>\n<li>Els concedits sense interessos ni altres despeses que els costos directament relacionats amb la garantia del pr\u00e9stec.<\/li>\n<li>Els concedits en forma de facilitat de descobert i que s&#8217;hagin de reemborsar en el termini d&#8217;un mes.<\/li>\n<li>Els que siguin resultat d&#8217;un acord assolit davant un \u00f2rgan jurisdiccional, arbitral, o en un procediment de conciliaci\u00f3 o mediaci\u00f3.<\/li>\n<li>Els relatius al pagament ajornat, sense despeses, d&#8217;un deute existent, sempre que no es tracti de contractes de pr\u00e9stec garantits per una hipoteca sobre b\u00e9ns immobles d&#8217;\u00fas residencial.<\/li>\n<li>Els relatius a la hipoteca inversa.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Informaci\u00f3 precontractual i publicitat dels pr\u00e9stecs immobiliaris<\/span>:<br \/>\n<\/strong><\/p>\n<ul>\n<li>La Llei cont\u00e9 una regulaci\u00f3 detallada de la fase precontractual (inclosa la publicitat) amb la finalitat que el consumidor pugui prendre una decisi\u00f3 fundada sobre la conveni\u00e8ncia de celebrar o no el contracte de pr\u00e9stec.<\/li>\n<li>Tota publicitat relativa als contractes de pr\u00e9stec que indiqui un tipus d&#8217;inter\u00e8s o qualssevol xifres relacionades amb el cost del pr\u00e9stec per al prestatari s&#8217;haur\u00e0 d&#8217;especificar de forma clara, concisa i destacada.<\/li>\n<li>El client disposar\u00e0 del seu contracte un m\u00ednim de deu dies abans de la signatura i, a m\u00e9s, el notari haur\u00e0 de resoldre tots els seus dubtes, comprovar que no hi ha cl\u00e0usules abusives i ratificar que el titular ent\u00e9n el que est\u00e0 contractant.<\/li>\n<li>A m\u00e9s d&#8217;informar m\u00e9s i millor al client, el banc haur\u00e0 d&#8217;avaluar en profunditat la solv\u00e8ncia del futur hipotecat, consultant l&#8217;historial creditici del client en el Banc d&#8217;Espanya. I es limiten els incentius als treballadors per vendre m\u00e9s cr\u00e8dits.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Despeses del pr\u00e9stec<\/span>:<\/strong><\/p>\n<ul>\n<li>Les despeses de taxaci\u00f3 de l&#8217;immoble correspondran a prestatari i els de gestoria al prestador.<\/li>\n<li>El prestador assumir\u00e0 el cost dels aranzels notarials de l&#8217;escriptura de pr\u00e9stec hipotecari i els de les c\u00f2pies els assumir\u00e0 qui les sol\u00b7liciti.<\/li>\n<li>Les despeses d&#8217;inscripci\u00f3 de les garanties en el registre de la propietat correspondran al prestador.<\/li>\n<li>El pagament de l&#8217;impost sobre transmissions patrimonials i actes jur\u00eddics documentats (ITP i AJD) es realitzar\u00e0 de conformitat amb el que s&#8217;estableix en la normativa tribut\u00e0ria aplicable, que en l&#8217;actualitat, considera subjecte passiu en les escriptures de pr\u00e9stec hipotecari al prestador).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Comissi\u00f3 d&#8217;obertura<\/span>: <\/strong>La llei preveu la possibilitat de pactar una comissi\u00f3 d&#8217;obertura, que es reportar\u00e0 una sola vegada i englobar\u00e0 la totalitat de les despeses d&#8217;estudi, tramitaci\u00f3 o concessi\u00f3 del pr\u00e9stec o d&#8217;altres de similars inherents a l&#8217;activitat del prestadora ocasionada per la concessi\u00f3 del pr\u00e9stec.<\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<div class=\"content\">\n<p><strong><span style=\"color: #ff0000;\">Reemborsament anticipat<\/span>: <\/strong>Es limita la compensaci\u00f3 que el prestatari haur\u00e0 de pagar pel reembors anticipat del pr\u00e9stec, que no podr\u00e0 superar els seg\u00fcents imports:<\/p>\n<ul>\n<li>Pr\u00e9stecs a interes variable. Es permet pactar una d&#8217;aquestes dues condicions:\n<ul>\n<li>Durant els cinc primers anys de vig\u00e8ncia del pr\u00e9stec, no podr\u00e0 excedir del 0,15% del capital reemborsat anticipadament.<\/li>\n<li>Durant els tres primers anys de vig\u00e8ncia del pr\u00e9stec, no podr\u00e0 excedir del 0,25% del capital reemborsat anticipadament.<\/li>\n<\/ul>\n<\/li>\n<li>Novaci\u00f3 del pr\u00e9stec o de subrogaci\u00f3 del creditor, sempre que suposi la conversi\u00f3 del pr\u00e9stec de tipus variable a tipus fix:\n<ul>\n<li>Durant els tres primers anys de vig\u00e8ncia del pr\u00e9stec, no podr\u00e0 excedir del 0,15% del capital reemborsat anticipadament.<\/li>\n<li>Despr\u00e9s dels tres primers anys de vig\u00e8ncia del pr\u00e9stec, no es podr\u00e0 exigir cap compensaci\u00f3.<\/li>\n<\/ul>\n<\/li>\n<li>Pr\u00e9stecs a interes fix:\n<ul>\n<li>Durant els deu primers anys de vig\u00e8ncia del pr\u00e9stec, no podr\u00e0 excedir del 2% del capital reemborsat anticipadament.<\/li>\n<li>A partir dels deu primers anys de vig\u00e8ncia, no podr\u00e0 excedir del 1,5% del capital reemborsat anticipadament.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Interessos de demora<\/span>: <\/strong>En cas de demora s&#8217;aplicar\u00e0 l&#8217;interes ordinari pactat m\u00e9s tres punts.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Desnonaments o cl\u00e0usula de venciment anticipat<\/span>:<\/strong><\/p>\n<ul>\n<li class=\"first last\">El valor de taxaci\u00f3 de la finca a efectes de subhasta no podr\u00e0 ser\u00a0 inferior al valor assenyalat en la taxaci\u00f3 que es va fer per concedir el pr\u00e9stec.<\/li>\n<li>Es produir\u00e0 el venciment anticipat del contracte i es podr\u00e0 exercitar l&#8217;acci\u00f3 hipotec\u00e0ria, si concorren conjuntament els requisits seg\u00fcents:\n<ul>\n<li>Que la quantia de les quotes ven\u00e7udes i no satisfetes equivalguin almenys al tres per cent (3%) de la quantia del capital concedit, si la mora es produ\u00eds dins de la primera meitat de la durada del pr\u00e9stec o al set per cent (7%) de la quantia del capital concedit, si la mora es produ\u00eds dins de la segona meitat de la durada del pr\u00e9stec.<\/li>\n<li>Que el prestador hagi requerit el pagament al prestatari concedint-li un termini d&#8217;almenys un mes per al seu compliment i advertint-li que, si no \u00e9s at\u00e8s, reclamar\u00e0 el reemborsament total del pr\u00e9stec.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Pr\u00e0ctica de vendes vinculades i combinades<\/span>: <\/strong>La llei prohibeix, amb car\u00e0cter general, les pr\u00e0ctiques vinculades (ofertes en les quals el pr\u00e9stec no es pot contractar sense la contractaci\u00f3 d&#8217;un altre producte ofert conjuntament pel prestador), excepte en determinats casos.<\/p>\n<ul>\n<li>L&#8217;excepci\u00f3 m\u00e9s rellevant \u00e9s la possibilitat que el prestador exigeixi la subscripci\u00f3 de p\u00f2lisses d&#8217;asseguran\u00e7a en garantia del compliment de les obligacions de pagament, aix\u00ed com d&#8217;una asseguran\u00e7a de danys de l&#8217;immoble hipotecat. En aquest cas, el prestador haur\u00e0 d&#8217;acceptar p\u00f2lisses alternatives d&#8217;altres prove\u00efdors que ofereixin unes condicions i nivell de prestacions equivalents.<\/li>\n<li>D&#8217;altra banda, es permeten les pr\u00e0ctiques combinades (ofertes en les quals el pr\u00e9stec es pot contractar, encara que a un preu m\u00e9s car per al consumidor, sense la contractaci\u00f3 d&#8217;un altre producte ofert conjuntament pel prestador). Els productes s&#8217;hauran d&#8217;oferir clarament per separat perqu\u00e8 el prestatari pugui advertir la difer\u00e8ncia entre totes dues ofertes.<\/li>\n<li>En tots dos casos, la llei estableix obligacions de transpar\u00e8ncia espec\u00edfiques per a aquest tipus de pr\u00e0ctiques i els elements concrets sobre els quals s&#8217;ha d&#8217;informar el prestatari (que es tracta d&#8217;una pr\u00e0ctica vinculada o combinada, el cost, benefici i risc de p\u00e8rdues del producte, els efectes de la seva no contractaci\u00f3 o de la cancel\u00b7laci\u00f3 del pr\u00e9stec i les difer\u00e8ncies entre oferta combinada i per separat).<\/li>\n<\/ul>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div class=\"content\">\n<p><strong><span style=\"color: #ff0000;\">Cl\u00e0usules terra<\/span>: <\/strong>Queden prohibides, de manera que no es pot fixar un l\u00edmit per sota del qual el client no pot beneficiar-se de les rebaixes dels tipus d&#8217;inter\u00e8s.<\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div class=\"content\">\n<p><strong><span style=\"color: #ff0000;\">Novaci\u00f3 i subrogaci\u00f3<\/span>:<br \/>\n<\/strong><\/p>\n<ul>\n<li>Per canviar un pr\u00e9stec de tipus variable a un de tipus fix dintre la mateixa entitat: Comissi\u00f3 m\u00e0xima del 0,15% durant els tres primers anys de vida de la hipoteca.<\/li>\n<li>El client podr\u00e0 subrogar sense costos i portar lliurement la seva hipoteca a un altre banc ja que entre les entitats s&#8217;establir\u00e0 un mecanisme de compensaci\u00f3 basat en els interessos cobrats i els pendents de cobrament per evitar el robatori de clients.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Nou paper del notari: <\/span><\/strong>Una vegada el consumidor hagi decidit quina \u00e9s l&#8217;entitat financera i el cr\u00e8dit m\u00e9s adequat als seus interessos haur\u00e0 de comunicar al banc el nom del notari que hagi triat perqu\u00e8 li remetin, per mitjans telem\u00e0tics, tota la documentaci\u00f3 relacionada amb el pr\u00e9stec. \u00c9s llavors quan el notari haur\u00e0 d&#8217;explicar al consumidor els aspectes m\u00e9s rellevants del pr\u00e9stec i contestar a totes les seves preguntes, de manera que aquest pugui tenir, amb el seu assessorament imparcial, un coneixement complet del contracte i, per tant, dels seus drets i obligacions. Seguidament redactar\u00e0 una acta notarial que ser\u00e0 gratu\u00efta, en la qual deixar\u00e0 const\u00e0ncia dels fets comprovats i de les explicacions donades al consumidor, aix\u00ed com de les preguntes que li hagi plantejat amb les seves respostes.<\/p>\n<\/div>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria4_62062521.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-708\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria4_62062521.jpg\" alt=\"\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria4_62062521.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria4_62062521-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<p><span style=\"color: #800080;\"><em><strong>Som advocats i defensem els vostres drets.
