{"id":3882,"date":"2019-11-15T12:30:59","date_gmt":"2019-11-15T10:30:59","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/garanties-en-la-compra-de-pisos-sobre-planol\/"},"modified":"2019-11-15T12:30:59","modified_gmt":"2019-11-15T10:30:59","slug":"garanties-en-la-compra-de-pisos-sobre-planol","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/garanties-en-la-compra-de-pisos-sobre-planol\/","title":{"rendered":"Garanties en la compra de pisos sobre pl\u00e0nol"},"content":{"rendered":"<p>Es habitual que el comprador d&#8217;un habitatge es vegi obligat a anticipar-li quantitats al promotor i en \u00e8poques en que est\u00e0 augmentant la demanda com ara, tamb\u00e9 es habitual que el promotor exigeix-hi bestretes als compradors a compte de la venda dels pisos que encara s&#8217;han de construir o que estan en construcci\u00f3.<\/p>\n<p>Per tal de protegir al consumidor, la Llei del dret a l&#8217;habitatge de Catalunya obliga al promotor en el seu article 50.2.e), a subscriure una p\u00f2lissa d&#8217;asseguran\u00e7a o un aval que garanteixi la devoluci\u00f3 de les quantitats rebudes a compte del preu total convingut en cas que incompleix-hi les seves obligacions.<\/p>\n<p>Tot i aix\u00ed s&#8217;ha donat casos en que el promotor no ha subscrit l&#8217;asseguran\u00e7a ni ha aconseguit l&#8217;aval i el comprador ha acabat perdent les quantitats que havia donat a compte del pis.<\/p>\n<p>Recentment, el passat 9 de juliol, el Tribunal Suprem, en la seva<em> <a href=\"http:\/\/www.poderjudicial.es\/search\/sentencias\/Prescripcion\/51\/AN\">sent\u00e8ncia 408\/2019<\/a><\/em>, de 9 de juliol, ha posat remei en aquest casos declarant la responsabilitat de l&#8217;entitat banc\u00e0ria que accepti bestretes per habitatges en el compte del promotor sense exigir les garanties que correspongui.<\/p>\n<p><span style=\"color: #0000ff;\"><strong>Resumim com quedaria la regulaci\u00f3 de les quantitats anticipades a compte del preu dels habitatges a la vista d&#8217;aquesta sent\u00e8ncia:<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>Que es considera quantitats anticipades a compte de la compra d&#8217;un pis ?\u00a0 <\/strong><span style=\"color: #000000;\">Tots els imports que el comprador hagu\u00e9s lliurat al promotor abans de l&#8217;entrega de l&#8217;habitatge, ja siguin qualificats amb el nom d&#8217;arres, senyal o reserva o amb qualsevol altra denominaci\u00f3.<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Quina es la obligaci\u00f3 del promotor en cas de rebre quantitats anticipades a compte ?<\/strong><\/span> Subscriure una p\u00f2lissa d&#8217;asseguran\u00e7a o un aval que garanteixi la devoluci\u00f3 de les quantitats rebudes en els casos seg\u00fcents:<\/p>\n<ul>\n<li>Quan s&#8217;incompleixi l&#8217;obligaci\u00f3 de lliurar l&#8217;habitatge en les condicions pactades.<\/li>\n<li>En el cas que les obres no comencin o acabin, sigui per la causa que sigui, en el termini convingut.<\/li>\n<li>En el cas que no s&#8217;obtingui la c\u00e8dula d&#8217;habitabilitat.<\/li>\n<li>En el cas que s&#8217;hagi produ\u00eft una doble venda.<\/li>\n<li>En el cas que l&#8217;habitatge s&#8217;hagi transm\u00e8s a tercers protegits per la publicitat registral.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Quina es la responsabilitat del banc o de qualsevol altra entitat de cr\u00e8dit ?<\/strong><\/span> Respondre de les quantitats ingressades en el compte del promotor pel comprador de l&#8217;habitatge sense haver exigit al promotor l&#8217;obertura d&#8217;un compte especial i l&#8217;asseguran\u00e7a o l&#8217;aval bancari.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2019\/03\/shutterstock_110539220.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-3355\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2019\/03\/shutterstock_110539220.jpg\" alt=\"\" width=\"600\" height=\"600\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #800080;\"><em><strong>Som advocats.
