{"id":3899,"date":"2019-11-18T13:42:58","date_gmt":"2019-11-18T11:42:58","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/substituir-un-treballador-per-un-robot-es-acomiadament-improcedent\/"},"modified":"2019-11-18T13:42:58","modified_gmt":"2019-11-18T11:42:58","slug":"substituir-un-treballador-per-un-robot-es-acomiadament-improcedent","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/substituir-un-treballador-per-un-robot-es-acomiadament-improcedent\/","title":{"rendered":"SUBSTITUIR UN TREBALLADOR PER UN ROBOT ES ACOMIADAMENT IMPROCEDENT"},"content":{"rendered":"<p>El passat dia 23 de setembre de 2019, el Jutjat Social n\u00famero 10 de Las Palmas, ha dictat sentencia en la qual declara que \u00e9s improcedent l\u2019acomiadament d\u2019una treballadora\u00a0 d\u2019una multinacional tur\u00edstica.<\/p>\n<p>L&#8217;empresa va intentar justificar l\u2019acomiadament\u00a0 basant-se en la conveni\u00e8ncia de substituir la treballadora per un robot, en aquest cas, per un programa inform\u00e0tic robotitzat, per tal de prevenir p\u00e8rdues en el futur.<\/p>\n<p>El jutge ha considerat que no es procedent acomiadar una treballadora per aquest motiu i ho ha <span style=\"color: #ff0000;\"><strong>argumentat en la forma seg\u00fcent:<\/strong><\/span><\/p>\n<ul>\n<li>Per acomiadar un treballador per aquestes causes cal acreditar que les dificultats de l&#8217;empresa son actuals i no futures.<\/li>\n<li>L&#8217;automatitzaci\u00f3 mitjan\u00e7ant robots no es m\u00e9s que una excusa per reduir costos i fer l&#8217;empresa m\u00e9s competitiva i aquest no pot ser l&#8217;\u00fanic argument per acomiadar un treballador.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/administracions5_17413399-Copia.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-618\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/administracions5_17413399-Copia.jpg\" alt=\"\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/administracions5_17413399-Copia.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/administracions5_17413399-Copia-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<p><em><span style=\"color: #800080;\"><strong>Som advocats i estem especialitzats en dret laboral.
