{"id":4135,"date":"2020-03-06T13:39:34","date_gmt":"2020-03-06T11:39:34","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/linquili-pot-resoldre-el-contracte-darrendament-abans-del-termini-pactat\/"},"modified":"2020-03-06T13:39:34","modified_gmt":"2020-03-06T11:39:34","slug":"linquili-pot-resoldre-el-contracte-darrendament-abans-del-termini-pactat","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/linquili-pot-resoldre-el-contracte-darrendament-abans-del-termini-pactat\/","title":{"rendered":"L&#8217;inquil\u00ed pot resoldre el contracte d&#8217;arrendament abans del termini pactat?"},"content":{"rendered":"<p>Totes les parts hauran de complir el que digui el contracte, per\u00f2 l&#8217;article 11 de la Llei d&#8217;Arrendaments Urbans (LAU) permet que en el cas d&#8217;arrendament d&#8217;habitatge habitual i permanent, l&#8217;arrendatari pugui desistir el contracte i deixar l&#8217;habitatge abans del termini acordat complint els seg\u00fcents requisits:<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Transcurs de sis mesos<\/strong><\/span>: Hauran d&#8217;haver transcorregut almenys sis mesos des de la formalitzaci\u00f3 del contracte.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Comunicaci\u00f3<\/strong><\/span>:<\/p>\n<ul>\n<li>L&#8217;inquil\u00ed haur\u00e0 de comunicar-li a l&#8217;arrendador el seu desig d&#8217;abandonar l&#8217;habitatge abans de la finalitzaci\u00f3 del contracte, almenys amb una antelaci\u00f3 m\u00ednima de 30 dies. Cas contrari, haur\u00e0 d&#8217;indemnitzar l&#8217;arrendador amb l&#8217;import equivalent a una mensualitat de renda.<\/li>\n<li>\u00c9s aconsellable que aquesta comunicaci\u00f3 es realitzi de manera fefaent, exemple: burofax certificat i amb av\u00eds de recepci\u00f3.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Indemnitzaci\u00f3<\/span><\/strong>:<\/p>\n<ul>\n<li>La indemnitzaci\u00f3 a favor de l&#8217;arrendador pel desistiment del contracte per l&#8217;arrendatari no \u00e9s obligat\u00f2ria.
