Com afecta el coronavirus als arrendaments d&#8217;habitatges i locals"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #ff0000;\">I.- Habitatges<\/span><\/h2>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #0000ff;\">1.- Pr\u00f2rroga extraordin\u00e0ria dels arrendaments d\u2019habitatge habitual i permanent:<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Pr\u00f2rroga de 6 mesos<\/strong><\/span>: L\u2019arrendatari t\u00e9 dret a sol\u00b7licitar a l\u2019arrendador una pr\u00f2rroga de 6 mesos, en els quals continua aplicant el preu i els altres termes i condicions del contracte existent.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Qui la pot demanar ? <\/strong><\/span>La podr\u00e0 demanar qualsevol arrendatari, encara que no tingui la consideraci\u00f3 de persona vulnerable,<\/p>\n<p><strong><span style=\"color: #ff0000;\">Quan la pot demanar ?<\/span><\/strong> La podr\u00e0 demanar l\u2019arrendatari en cas que venci el contracte o la seva pr\u00f2rroga entre els dies 2 d\u2019abril del 2020 i el dia en que faci dos mesos del final de l\u2019estat d\u2019alarma.<\/p>\n<p><strong><span style=\"color: #ff0000;\">Car\u00e0cter obligatori:<\/span><\/strong> L\u2019arrendador vindr\u00e0 obligat a acceptar la pr\u00f2rroga a no ser que arribi a un altra acord amb l\u2019arrendatari.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #0000ff;\">2.- Morat\u00f2ria en el pagament de la renda de l&#8217;habitatge habitual i permanent a favor de persones vulnerables.<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Quins son els arrendataris en situaci\u00f3 de vulnerabilitat econ\u00f2mica ?:<\/strong> <\/span>Es considera arrendataris en situaci\u00f3 de vulnerabilitat econ\u00f2mica aquells que reuneixin tots i cada un dels seg\u00fcents requisits:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">L\u00edmit d\u2019ingressos de l\u2019arrendatari:<\/span> Que els ingressos de la unitat familiar no superin els 1.614,00 \u20ac mensuals (3 vegades l\u2019IPREM). Aquest import s\u2019incrementa en un 10% per cada fill a c\u00e0rrec i per cada major de 65 anys que formi part de la unitat familiar i en un 15% si es tracta d\u2019una unitat familiar monoparental. Tamb\u00e9 s\u2019incrementa fins a 2.152,00 \u20ac mensuals (4 vegades l\u2019IPREM), quan un membre de la unitat familiar tingui una discapacitat de m\u00e9s del 33% i fins a 2,690,00 \u20ac mensuals (5 vegades l\u2019IPREM), quan un membre de la unitat familiar tingui una discapacitat de m\u00e9s del 65%.<\/li>\n<li><span style=\"color: #0000ff;\">Relaci\u00f3 entre renda del pis i ingressos de l\u2019arrendatari<\/span>: Que la suma de la renda del lloguer m\u00e9s les despeses repercutides en la renda i els subministres b\u00e0sics sigui igual o superior al 35% dels ingressos nets del conjunt de la unitat familiar.<\/li>\n<li><span style=\"color: #0000ff;\">Que no disposi de cap altra habitatge<\/span>: Que cap dels membres de la unitat familiar sigui propietari o usufructuari d\u2019un habitatge a Espanya.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Quins son els arrendataris en situaci\u00f3 de vulnerabilitat econ\u00f2mica que podran demanar una morat\u00f2ria en el pagament de la renda ?:<\/strong><\/span> Podran demanar la morat\u00f2ria aquells arrendataris que estiguin en situaci\u00f3 de vulnerabilitat econ\u00f2mica (veure l\u2019apartat anterior) i que en el mes anterior a la sol\u00b7licitud de l\u2019ajornament estiguin alguna d\u2019aquestes situacions:<\/p>\n<ul>\n<li>Atur.<\/li>\n<li>Incl\u00f2s en un ERTO. (Expedient de regulaci\u00f3 temporal d\u2019ocupaci\u00f3).<\/li>\n<li>Reducci\u00f3 de jornada per cura de majors o de menors.<\/li>\n<li>Ser un empresari o aut\u00f2noms que pateix-hi una p\u00e8rdua substancial d\u2019ingressos.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Que s\u2019ent\u00e9n per unitat familiar?\u00a0<\/span><\/strong> S&#8217;ent\u00e9n per unitat familiar la formada per les seg\u00fcents persones que visquin junts:<\/p>\n<ul>\n<li>L\u2019arrendatari.<\/li>\n<li>El seu c\u00f2njuge o parella de fet.<\/li>\n<li>Els fills (independentment de l\u2019edat),<\/li>\n<li>El c\u00f2njuge o parella de fet dels fills.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Com s\u2019acredita la situaci\u00f3 de vulnerabilitat econ\u00f2mica ?\u00a0<\/span><\/strong> L\u2019arrendatari haur\u00e0 de presentar els seg\u00fcents documents:<\/p>\n<ul>\n<li>En cas d\u2019atur, certificat de l\u2019INEM en el que hi consti el que cobra.<\/li>\n<li>En cas que hagi cessat com aut\u00f2nom, certificat de l\u2019Ag\u00e8ncia Tribut\u00e0ria que ho acrediti.<\/li>\n<li>En cas que formi unitat familiar amb altres persones: Llibre de fam\u00edlia i certificat d\u2019empadronament que acrediti la situaci\u00f3 en el moment actual i en els sis mesos anteriors.<\/li>\n<li>En cas de discapacitat: Resoluci\u00f3 que acrediti la discapacitat.<\/li>\n<li>A m\u00e9s, en tots els casos: Nota del servei d\u2019\u00edndex del Registre de la Propietat de tots els membre de la unitat familiar de la resulti que no son propietaris o usufructuaris de cap altra habitatge.<\/li>\n<\/ul>\n<p><span style=\"color: #ff0000;\"><span style=\"color: #0000ff;\">Atenci\u00f3 !<\/span>:<\/span> Tots els documents anteriors els podr\u00e0 substituir l\u2019arrendatari per una declaraci\u00f3 seva en la que consti que compleix tots els requisits, expressi els motius pels quals no pot aportar tots o algun dels documents i es comprometi a aportar els que falti en el termini d\u2019un mes a partir del moment en que finalitzi l\u2019alarma.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Quin es el termini per a demanar la morat\u00f2ria ?<\/strong><\/span> L\u2019arrendatari haur\u00e0 de demanar la morat\u00f2ria entre els dies 2 d\u2019abril al 2 de maig del 2020.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Quins son els considerats grans tenidors d\u2019habitatge ?<\/strong><\/span> Es considera gran tenidor d&#8217;habitatge la persona, f\u00edsica o jur\u00eddica, que sigui titular de m\u00e9s de deu immobles urbans, excloent garatges i trasters, o una superf\u00edcie constru\u00efda de m\u00e9s de 1.500 m2.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Com es gestionar\u00e0 la morat\u00f2ria obligat\u00f2ria en cas que l\u2019arrendador sigui un gran tenidor d\u2019habitatge ?<\/strong><\/span> En cas d\u2019acord entre les dues parts, s\u2019aplicar\u00e0 l\u2019acord a que hagin arribat. En cas de no haver-hi acord l&#8217;arrendador haur\u00e0 de comunicar la seva decisi\u00f3 a l\u2019arrendatari en el termini m\u00e0xim de 7 dies laborables, que haur\u00e0 d\u2019escollir entre les seg\u00fcents alternatives sense que pugui aplicar penalitzaci\u00f3 ni interessos per l\u2019ajornament:<\/p>\n<ul>\n<li>Reducci\u00f3 del 50% de la renda durant el temps que duri l&#8217;estat d&#8217;alarma i les mensualitats seg\u00fcents si aquell termini fos insuficient en relaci\u00f3 amb la situaci\u00f3 de vulnerabilitat, amb un m\u00e0xim en tot cas de quatre mesos.<\/li>\n<li>Ajornament del pagament de la renda durant el mateix per\u00edode, mitjan\u00e7ant el fraccionament de les quotes durant al menys tres anys a partir del moment en qu\u00e8 se superi la situaci\u00f3 de vulnerabilitat, o a partir de la finalitzaci\u00f3 del termini dels quatre mesos abans esmentat, i mentre sigui vigent el contracte.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Com es gestionar\u00e0 la morat\u00f2ria volunt\u00e0ria en cas que l\u2019arrendador NO sigui un gran tenidor d\u2019habitatge ?<\/strong><\/span> En aquest cas l\u2019arrendador podr\u00e0 acceptar o no la morat\u00f2ria demanada per l\u2019arrendatari:<\/p>\n<ul>\n<li>Un cop rebuda la sol\u00b7licitud, l&#8217;arrendador haur\u00e0 de comunicar a l\u2019arrendatari, en el termini m\u00e0xim de 7 dies laborables, les condicions d&#8217;ajornament o de fraccionament ajornat del deute que accepta o, si no, les possibles alternatives que planteja en relaci\u00f3 amb les mateixes .<\/li>\n<li>Si l&#8217;arrendador no accept\u00e9s cap acord sobre l&#8217;ajornament l\u2019arrendatari podr\u00e0 accedir a un programa d&#8217;ajudes transit\u00f2ries de finan\u00e7ament, consistent en un pr\u00e9stec avalat per l\u2019ICO a retornar en 6 anys i prorrogable excepcionalment per altres 4 anys, que tamb\u00e9 podran demanar els arrendataris dels grans tenidors.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #0000ff;\">3.- Arrendament d\u2019habitatges habituals i permanents a favor de persones no vulnerables<\/span><\/h3>\n<p>Entenem que no hi ha cap afectaci\u00f3 derivada del coronavirus, sens perjudici de que s\u2019arribi a algun acord totalment voluntari amb l\u2019arrendatari que convindria documentar per que consti als efectes fiscals.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><strong><span style=\"color: #0000ff;\">4.- Arrendament d\u2019habitatges per temporada<\/span><\/strong><\/h3>\n<p>Entenem que ser\u00e0 d\u2019aplicaci\u00f3 el que direm en l\u2019apartat seg\u00fcent pel que fa a l\u2019arrendament de locals i negocis, en cas que la situaci\u00f3 d\u2019alarma afecti la temporada.<\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #ff0000;\"><strong>II.- Locals de negoci<\/strong><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">No hi ha cap afectaci\u00f3 legal pel coronavirus:<\/span><\/strong> No obstant, l\u2019arrendatari podria demanar que el contracte sigui revisat per for\u00e7a major o en aplicaci\u00f3 del principi general de dret \u201crebus sic stantivus\u201d que permet revisar les condicions del contracte en cas de circumst\u00e0ncies excepcionals que no es podia preveure quan es va formalitzar l\u2019arrendament i que ara l\u2019afecten de manera important.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Revisi\u00f3 volunt\u00e0ria de les condicions de l\u2019arrendament:<\/span><\/strong> Entenem que l\u2019arrendatari podria demanar que el contracte d\u2019arrendament es revisi d\u2019acord amb les noves circumst\u00e0ncies, deixant-ne const\u00e0ncia escrita per evitar problemes fiscals. En tas cas seria convenient que l\u2019arrendador hi acced\u00eds per evitar un litigi. La revisi\u00f3 podria consistir en alguna de les seg\u00fcents alternatives:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Morat\u00f2ria:<\/span> Consistiria en deixar de facturar les quotes que es meriti mentre duri l\u2019estat d\u2019alarma (o durant el per\u00edode que s\u2019acordi) i repercutir les quotes ajornades en 12 terminis del mateix import (o en els terminis que s\u2019acordi) un cop superada l\u2019alarma (o a partir de la data que s\u2019acordi). Les rendes ajornades no meritarien interessos ordinaris.<\/li>\n<li><span style=\"color: #0000ff;\">Condonaci\u00f3:<\/span> Consistiria en dispensar pura i simplement el pagament de la renda corresponent al per\u00edode de l\u2019alarma (o a les mensualitats que s\u2019acordi).<\/li>\n<li><span style=\"color: #0000ff;\">Reducci\u00f3 de la renda:<\/span> Consistiria en una reducci\u00f3 temporal de la renda durant el temps que s\u2019acordi.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/08\/shutterstock_790695424.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-2861\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/08\/shutterstock_790695424.jpg\" alt=\"\" width=\"600\" height=\"600\" \/><\/a><\/p>\n<p><span style=\"color: #ff6600;\"><em><strong>Som administradors de finques i agents immobiliaris.
