Aquesta limitaci\u00f3 ha estat disposada en la<em> <a href=\"https:\/\/portaldogc.gencat.cat\/utilsEADOP\/PDF\/8229\/1812918.pdf\">Llei 11\/2020, de 18 de setembre<\/a><\/em>, publicada en el DOG del dia 21 i va entrar en\u00a0 vigor el passat dia 22. Destaquem el seg\u00fcent:<\/p>\n<p><span style=\"color: #ff0000;\"><strong>\u00c0mbit d&#8217;aplicaci\u00f3<\/strong><\/span>:<\/p>\n<ul>\n<li>Lloguers d\u2019habitatge permanent que estiguin situats en zones considerades de mercat\u00a0 d\u2019habitatge tens (en les que s&#8217;ha detectat la necessitat d&#8217;habitatge de lloguer en condicions assequibles).<\/li>\n<li>A les comarques de Girona, pel moment i amb una durada m\u00e0xima de cinc anys, afecta a les poblacions de Blanes, Figueres. Girona. Olot, Palafrugell, Salt i Sant Feliu de Gu\u00edxols.<\/li>\n<li>Tamb\u00e9 afectar\u00e0 a les poblacions amb m\u00e9s de 20.000 habitants que disposen d\u2019un \u00edndex de refer\u00e8ncia de preus amb rendes que, entre els anys 2014 i 2019, han experimentat un increment superior a un 20%. Aquesta declaraci\u00f3 t\u00e9 una durada m\u00e0xima d\u2019un any.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Quantia m\u00e0xima de la renda inicial<\/strong><\/span>:<\/p>\n<ul>\n<li>\u00a0La quantia m\u00e0xima de la renda que pot ser convinguda en el moment de formalitzar el contracte no pot ultrapassar el preu de refer\u00e8ncia d\u2019un habitatge de caracter\u00edstiques an\u00e0logues, incrementat o minorat, com a m\u00e0xim en un 5%.<\/li>\n<li>La renda tampoc podr\u00e0 ultrapassar el preu del lloguer fixat en el darrer contracte d\u2019arrendament , en el sup\u00f2sit que l\u2019habitatge hagi estat arrendat dins dels cinc anys anteriors, amb els increments i les excepcions que indica la llei mateixa.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Arrendament d&#8217;habitatges nous i rehabilitats, durant els cinc anys posteriors a la data de final d&#8217;obres<\/strong><\/span>:<\/p>\n<ul>\n<li>La renda pactada a l&#8217;inici del contracte no podr\u00e0 ultrapassar el marge superior de l&#8217;\u00edndex de refer\u00e8ncia de preus de lloguer d&#8217;habitatges per a un habitatge de caracter\u00edstiques an\u00e0logues en el mateix entorn urb\u00e0, excepte en cas que s&#8217;hagin obtingut subvencions p\u00fabliques.<\/li>\n<li>En aquest cas la limitaci\u00f3 de rendes no entrar\u00e0 en vigor fins el 22 de setembre del 2023.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Obres de millora en els habitatges arrendats<\/strong><\/span>: L&#8217;arrendador que faci obres de millora en l&#8217;habitatge podr\u00e0, un cop transcorregut el termini legal m\u00ednim de durada obligat\u00f2ria del contracte, incrementar la renda, en els termes previstos per llei.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Actualitzaci\u00f3 de la renda<\/strong><\/span>: L\u2019increment anual de la renda no podr\u00e0 ser superior a l\u2019IPC.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Ofertes d&#8217;arrendament d&#8217;habitatges ubicats en les poblacions afectades<\/strong><\/span>: Cal informar de l&#8217;aplicaci\u00f3 del valor que correspongui de l&#8217;\u00edndex de refer\u00e8ncia de preus de lloguer d&#8217;habitatges i, si escau, de l&#8217;import de la renda del darrer contracte d&#8217;arrendament vigent en aquell mateix habitatge.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Obres de millora en l&#8217;habitatge realitzades per l&#8217;arrendador<\/strong><\/span>: L&#8217;arrendador que faci obres de millora en l&#8217;habitatge podr\u00e0, un cop transcorregut el termini legal m\u00ednim de durada obligat\u00f2ria del contracte, incrementar la renda per aquest motiu sense que li sigui d&#8217;aplicaci\u00f3 el l\u00edmit regulat en aquesta disposici\u00f3.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Soluci\u00f3 de conflictes<\/strong><\/span>: Aquesta Llei tamb\u00e9 estableix un sistema de soluci\u00f3 de conflictes, a l\u2019hora de dirimir les controv\u00e8rsies sobre la determinaci\u00f3 i el reemborsament de les quanties pagades indegudament en els contractes d\u2019arrendament d\u2019habitatge subjectes al regim de contenci\u00f3 de rendes<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Observacions<\/strong><\/span>:<\/p>\n<ul>\n<li>Aquesta Llei t\u00e9 el seu precedent en el Decret Llei 9\/2019, de 21 de maig, el qual no va ser validat pel Ple del Parlament i va ser derogat.<\/li>\n<li>Es possible que la Llei que comentem sigui objecte de recurs\u00a0 davant el Tribunal Constitucional.
