Destaquem el seg\u00fcent pel que fa als expedient temporals de regulaci\u00f3 d&#8217;ocupaci\u00f3 (ERTO):<\/p>\n<\/div>\n<div class=\"content\">\n<p><strong><span style=\"color: #ff0000;\">Expedients de suspensi\u00f3 temporal de contractes o reducci\u00f3 de jornada per for\u00e7a major (ERTO)<\/span><\/strong>: Tots els ERTO per for\u00e7a major vigents es prorroguen autom\u00e0ticament fins al 31 de gener de 2021.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Expedients de suspensi\u00f3 temporal de contractes o reducci\u00f3 de jornada per causes econ\u00f2miques, t\u00e8cniques, organitzatives i de producci\u00f3 (ETOP)<\/strong><\/span>:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Expedients vigents a 30 de setembre de 2020<\/span>: Es mantenen els termes previstos en la comunicaci\u00f3 final de l&#8217;empresa a l&#8217;autoritat laboral i fins a la data de finalitzaci\u00f3 que s&#8217;hi refereix.<\/li>\n<li><span style=\"color: #0000ff;\">Expedients que s&#8217;inici\u00efn a partir del 30 de setembre de 2020 i fins el el 31 de gener de 2021<\/span>:\n<ul>\n<li>Es tramitaran pel procediment abreujat.<\/li>\n<li>Es podran iniciar a partir d&#8217;un ERTO per for\u00e7a major vigent i retrotreure els efectes inicials a la data en la qual finalitzi l&#8217;ERTO sempre que les causes<strong>\u00a0<\/strong>econ\u00f2miques, t\u00e8cniques, organitzatives o de producci\u00f3 hagin comen\u00e7at a partir del moment en que hagu\u00e9s finalitzat l&#8217;ERTO.<\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #0000ff;\">Pr\u00f2rroga dels expedients que finalitzin abans de 1 de febrer del 2021<\/span>: Es podran prorrogar sempre que s&#8217;assoleixi un acord per a aix\u00f2 en el per\u00edode de consultes, que s&#8217;haur\u00e0 de tramitar davant l&#8217;autoritat laboral.<\/li>\n<li><span style=\"color: #0000ff;\">Exoneraci\u00f3 de cotitzaci\u00f3 a la Seguretat Social en el per\u00edode 1.10.2020 a 31.1.2021<\/span>: Sols se&#8217;n podran beneficiar les empreses dels sectors relacionats en l&#8217;annex de la disposici\u00f3 que comentem, entre les quals:\n<ul>\n<li>Ag\u00e8ncies de viatge i operadors tur\u00edstics.<\/li>\n<li>Transport terrestre, fluvial, mar\u00edtim o aeri de passatgers.<\/li>\n<li>Arts esc\u00e8niques, gesti\u00f3 de sales d&#8217;espectacles i serveis auxiliars o relacionats.<\/li>\n<li>Venda al detall d&#8217;ordinadors i programes inform\u00e0tics.<\/li>\n<li>Fabricaci\u00f3 d&#8217;articles de joieria, bijuteria i similars.<\/li>\n<li>Hotels i allotjaments tur\u00edstics i similars<\/li>\n<li>Impressi\u00f3, arts gr\u00e0fiques i serveis relacionats<\/li>\n<li>Fotocopiat, preparaci\u00f3 de documents i altre activitats auxiliars d&#8217;oficina<\/li>\n<li>Serveis de taxi.<\/li>\n<li>Rentat i neteja de peces t\u00e8xtils i de pell.<\/li>\n<li>Activitats recreatives i d&#8217;entreteniment.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<div class=\"content\">\n<p><strong><span style=\"color: #ff0000;\">ERTO per rebrot (emparat en les mesures adoptades pel RDL 24\/2020, de 26 de juny per evitar la propagaci\u00f3 del Covid-19, )<br \/>\n<\/span><\/strong><\/p>\n<ul>\n<li>Es mantenen vigents en els termes previstos en la resoluci\u00f3 corresponent, expressa o t\u00e0cita, de l&#8217;autoritat laboral.<\/li>\n<li>Se&#8217;ls aplicaran, des del 1 d&#8217;octubre fins al 31 de gener de 2021, les seg\u00fcents exempcions en la cotitzaci\u00f3 a la Seguretat Social:\n<ul>\n<li>100%, quan el 29 de febrer de 2020 l&#8217;empresa hagu\u00e9s tingut menys de 50 treballadors o assimilats en situaci\u00f3 d&#8217;alta en la Seguretat Social.<\/li>\n<li>90% si a 29 de febrer de 2020 l&#8217;empresa hagu\u00e9s tingut 50 treballadors o m\u00e9s o assimilats en situaci\u00f3 d&#8217;alta.<\/li>\n<\/ul>\n<\/li>\n<li>Les empreses afectades estaran subjectes als l\u00edmits relacionats amb repartiment de dividends i transpar\u00e8ncia fiscal i la salvaguarda d&#8217;ocupaci\u00f3.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Nova figura d&#8217;ERTO per impediment<\/span>: <\/strong>Les empreses de qualsevol sector o activitat que vegin impedit el desenvolupament de la seva activitat com a conseq\u00fc\u00e8ncia de les noves restriccions o mesures adoptades a partir del 1 d&#8217;octubre de 2020, tant per autoritats nacionals com estrangeres, es podran acollir als beneficis dels ERTO.<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Durada<\/span>: Quedar\u00e0 restringida a la durada de les mesures d&#8217;impediment.<\/li>\n<li><span style=\"color: #0000ff;\">Exoneraci\u00f3 en les seves cotitzacions a la Seguretat Social durant el per\u00edode de tancament i fins al 31 de gener de 2021<\/span>:\n<ul>\n<li>100%, quan a 29 de febrer de 2020 l&#8217;empresa hagu\u00e9s tingut menys de 50 treballadors o assimilats en situaci\u00f3 d&#8217;alta en la Seguretat Social.<\/li>\n<li>90% si a 29 de febrer de 2020 l&#8217;empresa hagu\u00e9s tingut 50 treballadors o m\u00e9s o assimilats en situaci\u00f3 d&#8217;alta.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Nova figura d&#8217;ERTO per limitaci\u00f3<\/strong><\/span>: Les empreses o entitats que vegin limitat el desenvolupament de la seva activitat en alguns dels seus centres de treball com a conseq\u00fc\u00e8ncia de decisions o mesures adoptades per autoritats espanyoles, podran sol\u00b7licitar a l&#8217;autoritat laboral un\u00a0&#8220;ERTO per limitacions&#8221;. En aquest cas, les exoneracions en les cotitzacions a la Seguretat Social per als treballadors suspesos seran decreixents entre els mesos d&#8217;octubre de 2020 i gener de 2021 sobre la base dels seg\u00fcents percentatges:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Empreses amb menys de 50 treballadors o assimilats<\/span> en situaci\u00f3 d&#8217;alta en la Seguretat Social a 29 de febrer de 2020: 100% a l&#8217;octubre; 90% al novembre; 85% al desembre, i 80% al gener del 2021.<\/li>\n<li><span style=\"color: #0000ff;\">Empreses amb 50 treballadors o m\u00e9s o assimilats<\/span> en situaci\u00f3 d&#8217;alta en la Seguretat Social a 29 de febrer de 2020: 90% a l&#8217;octubre; 80% al novembre; 75% al desembre, i 70% al gener del 2021.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<p><span style=\"color: #ff0000;\"><strong>Manteniment dels l\u00edmits i prohibicions<\/strong><\/span>: La norma mant\u00e9 els compromisos de salvaguarda en relaci\u00f3 amb el repartiment de beneficis i l&#8217;exig\u00e8ncia de transpar\u00e8ncia fiscal\u00a0 respecte de les empreses i entitats que tinguin el seu domicili fiscal en pa\u00efsos o territoris qualificats de paradisos fiscals, aix\u00ed com els establerts en relaci\u00f3 amb el repartiment de dividends per a empreses i societats acollides a determinades mesures de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3. Tampoc podran realitzar hores extraordin\u00e0ries, establir noves externalitzacions de l&#8217;activitat, ni concertar noves contractacions, directes o indirectes excepte per raons de formaci\u00f3 o altres raons objectives i justificades. A m\u00e9s:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Salvaguarda de la ocupaci\u00f3<\/span>: S&#8217;estableix un nou per\u00edode de 6 mesos de\u00a0salvaguarda de l&#8217;ocupaci\u00f3\u00a0per a les empreses que s&#8217;acullin a un nou ERTO exonerat. En cas que exist\u00eds un comprom\u00eds de manteniment d&#8217;ocupaci\u00f3 anterior vigent, l&#8217;inici del nou per\u00edode de salvaguarda comen\u00e7ar\u00e0 quan hagi concl\u00f2s el de l&#8217;ERTO anterior.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<div class=\"content\">\n<div class=\"content\">\n<p><strong><span style=\"color: #ff0000;\">Empreses pertanyents a sectors amb una elevada taxa de cobertura per expedients de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3 i una redu\u00efda taxa de recuperaci\u00f3 d&#8217;activitat<\/span>:<\/strong><\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Empreses afectades<\/span>: Les empreses que, des del principi de la crisi sanit\u00e0ria fins avui, no han arribat a recuperar els treballadors regulats en percentatges significatius (menys del 65 per cent de treballadors recuperats dels expedients de regulaci\u00f3 desocupaci\u00f3) i que a m\u00e9s pertanyen a sectors espec\u00edfics (m\u00e9s del 15 per cent de persones regulades del total d&#8217;afilades al r\u00e8gim general en una activitat de les relaciones en l&#8217;annex de la disposici\u00f3 que comentem, entre les quals las relacionades amb el turisme i l&#8217;hoteleria).<\/li>\n<li><span style=\"color: #0000ff;\">Empreses que formin part de la cadena de valor<\/span>: Aquestes mateixes condicions s&#8217;estendran tamb\u00e9 a les empreses que formin part de la cadena de valor de les especialment afectades. Aquestes entitats hauran de presentar davant l&#8217;autoritat laboral corresponent <strong><span style=\"color: #ff0000;\">entre el 5 i el 19 d&#8217;octubre<\/span><\/strong> la sol\u00b7licitud de declaraci\u00f3 com a empreses dependents o integrants de la cadena de valor d&#8217;una altra empresa, i d&#8217;acord amb un breu procediment establert en la norma.<\/li>\n<li><span style=\"color: #0000ff;\">Concepte de cadena de valor<\/span>: S&#8217;entendr\u00e0 que s\u00f3n integrants de la cadena de valor les empreses la facturaci\u00f3 de les quals durant 2019 s&#8217;hagi generat, almenys, en un 50% en operacions realitzades de manera directa amb &#8220;empreses especialment afectades per la pand\u00e8mia&#8221;, aix\u00ed com aquelles companyies l&#8217;activitat real de les quals depengui indirectament d&#8217;elles.<\/li>\n<li><span style=\"color: #0000ff;\">Exoneraci\u00f3 en la cotitzaci\u00f3 empresarial a la Seguretat Social<\/span>: 85% en el cas d&#8217;empreses de menys de 50 treballadors i del 75% en empreses de m\u00e9s de 50 treballadors.<\/li>\n<li><span style=\"color: #0000ff;\">Abast de l&#8217;exoneraci\u00f3<\/span>: L&#8217;exoneraci\u00f3 inclou els treballadors afectats per l&#8217;ERTO que reinici\u00efn la seva activitat a partir del 1 d&#8217;octubre de 2020 -o que l&#8217;haguessin reiniciat des de l&#8217;entrada en vigor del RDL 18\/2020, de 12 de maig-, i pels per\u00edodes i percentatges de jornada treballats a partir de l&#8217;1 d&#8217;octubre de 2020; com dels treballadors que tinguin les seves activitats suspeses entre el 1 d&#8217;octubre de 2020 i el 31 de gener de 2021, pels per\u00edodes i percentatges de jornada afectats per la suspensi\u00f3.<\/li>\n<li><span style=\"color: #0000ff;\">Manteniment de l&#8217;exoneraci\u00f3<\/span>: Mantindran aquestes mateixes exoneracions en les seves cotitzacions a la Seguretat Social les empreses que figurin en l&#8217;annex de la disposici\u00f3 que comentem o que formin part de la seva cadena de valor i que inici\u00efn un ERTO per causes econ\u00f2miques, t\u00e8cniques, organitzatives o de producci\u00f3 despr\u00e9s de la finalitzaci\u00f3 d&#8217;un ERTO de for\u00e7a major, a partir del 30 de setembre.<\/li>\n<li><span style=\"color: #0000ff;\">Incompatibilitat<\/span>: Aquestes exempcions seran incompatibles amb les de l&#8217;ERTO per impediment i per -rebrot- limitacions, encara que s\u00ed que s&#8217;aplicar\u00e0 la mateixa tramitaci\u00f3 o gesti\u00f3.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/03\/shutterstock_1622495458.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-4186\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/03\/shutterstock_1622495458.jpg\" alt=\"\" width=\"600\" height=\"600\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/03\/shutterstock_1622495458.jpg 600w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/03\/shutterstock_1622495458-300x300.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/03\/shutterstock_1622495458-150x150.jpg 150w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<\/div>\n<\/div>\n<p><strong><span style=\"color: #0000ff;\"><em>Som assessors laborals i de la Seguretat Social.
