Els preceptes anul\u00b7lats afecten principalment als grans tenidors d&#8217;habitatge i a la obligaci\u00f3 de facilitar lloguer social.<\/h4>\n<p>&nbsp;<\/p>\n<p>Fent <em><a href=\"https:\/\/afccirculars.cafbl.cat\/Fitxers\/Files\/secretaria\/text%20sent%C3%A8ncia%20TC.pdf\">clic aqu\u00ed<\/a><\/em> podreu accedir a un breu resum de la sent\u00e8ncia que ha preparat el Col\u00b7legi d&#8217;Administradors de Finques de Barcelona i Lleida.<\/p>\n<h5>Destaquem el seg\u00fcents efectes de la sent\u00e8ncia que comentem:<\/h5>\n<ul>\n<li>El Tribunal Constitucional declara la inconstitucionalitat per entendre que la normativa ha estat disposada per un decret llei del Govern quan en tot cas ho hauria d&#8217;haver estat per una llei del Parlament de Catalunya. Aquest fet deixa oberta la possibilitat de que el nou Parlament que surti de les eleccions del 14 de febrer ho torni a regular novament.<\/li>\n<li>La sent\u00e8ncia del Constitucional deixa sense efecte la regulaci\u00f3 per part de la Generalitat dels nous sup\u00f2sits en que cal oferir lloguer social i la pr\u00f2rroga obligat\u00f2ria del contracte d&#8217;arrendament d&#8217;habitatge quan l&#8217;arrendatari tingui dret al lloguer social.<\/li>\n<li>Continua vigent la definici\u00f3 de gran tenidor que ha fet la Generalitat (Persones f\u00edsiques i jur\u00eddiques que siguin titulars de m\u00e9s de 15 habitatges).<\/li>\n<li>Continua vigent la definici\u00f3 d&#8217;habitatge buit que ha fet la Generalitat, que inclou casos es que l&#8217;habitatge ha estat ocupat.<\/li>\n<li>Continua vigent l&#8217;index de refer\u00e8ncia del preu del lloguer que estableix preus m\u00e0xim de renda en poblacions en que falta habitatge de lloguer.<\/li>\n<li>Continua vigent la obligaci\u00f3 de reservar s\u00f2l per construir habitatges de protecci\u00f3 oficial en el planejament del s\u00f2l urb\u00e0 consolidat.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria2_43866341.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-782\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria2_43866341.jpg\" alt=\"\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria2_43866341.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria2_43866341-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<div class=\"mceTemp\"><\/div>\n<h4>Som Administradors de Finques i Agents de la Propietat Immobili\u00e0ria.
