{"id":6411,"date":"2022-02-17T18:41:29","date_gmt":"2022-02-17T16:41:29","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/com-queden-els-contractes-temporals-despres-de-la-reforma-laboral\/"},"modified":"2022-02-17T18:41:29","modified_gmt":"2022-02-17T16:41:29","slug":"com-queden-els-contractes-temporals-despres-de-la-reforma-laboral","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/com-queden-els-contractes-temporals-despres-de-la-reforma-laboral\/","title":{"rendered":"Com queden els contractes temporals despr\u00e9s de la reforma laboral?"},"content":{"rendered":"\n<h5 class=\"wp-block-heading\">A partir del 30 de mar\u00e7 de 2022, amb la desaparici\u00f3 dels contractes temporals nom\u00e9s es podran subscriure els contracte de treball de durada determinada per circumst\u00e0ncies de la producci\u00f3 o per substituci\u00f3 de treballadors.<\/h5>\n\n\n\n<p>Destaquem el seg\u00fcent: <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Contracte de treball de durada determinada per circumst\u00e0ncies de la producci\u00f3. <\/h3>\n\n\n\n<p>Aquesta modalitat es podr\u00e0 utilitzar per les seg\u00fcents causes:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Causes conjunturals d&#8217;oscil\u00b7lacions productives imprevisibles:<\/h4>\n\n\n\n<p><strong>Durada<\/strong>: Es permet una durada m\u00e0xima de sis mesos ampliable per conveni col\u00b7lectiu a dotze mesos.<\/p>\n\n\n\n<p><strong>Les oscil\u00b7lacions productives hauran de ser imprevisibles<\/strong>: En cas d&#8217;augments temporals del volum d&#8217;activitat, per\u00f2 que es repeteixin cada temporada (per exemple una botiga que incrementa les seves vendes durant el per\u00edode de Nadal), <strong>no es podr\u00e0 utilitzar<\/strong> aquest contracte, i s&#8217;haur\u00e0 de rec\u00f3rrer a un contracte fix-discontinu o a un d&#8217;indefinit a temps parcial.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Causes ocasionals i previsibles: <\/h4>\n\n\n\n<p><strong>Durada:<\/strong> L&#8217;empresa podr\u00e0 utilitzar durant un per\u00edode de noranta dies a l&#8217;any, en aquests contractes es penalitza la seva durada inferior a trenta dies amb una cotitzaci\u00f3 addicional.<\/p>\n\n\n\n<p><strong>L&#8217;increment haur\u00e0 de ser previsible<\/strong>: Respecte a l&#8217;increment ocasional previsible, <strong>no es podr\u00e0 contractar<\/strong> un treballador de l&#8217;1 de gener a 31 de mar\u00e7, per ser dies continuats. <strong>Tampoc es podr\u00e0 contractar<\/strong> un treballador al gener, un altre al mar\u00e7, un altre a l&#8217;abril i un altre a l&#8217;octubre, ja que s&#8217;excedeixen els noranta dies.\u00a0 <strong>En canvi, s\u00ed <\/strong>que ser\u00e0 possible contractar cinc treballadors al gener i deu a la segona quinzena d&#8217;agost.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Contracte de substituci\u00f3<\/h3>\n\n\n\n<p>Equival a l&#8217;anterior\u00a0<strong>contracte d&#8217;interinitat passa a denominar-se de substituci\u00f3<\/strong>, per\u00f2 mant\u00e9 els mateixos sup\u00f2sits de formalitzaci\u00f3.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Contracte per obra o servei<\/h3>\n\n\n\n<p><strong>Desapareix.&nbsp;<\/strong>El contracte temporal per a activitats amb substantivitat pr\u00f2pia (per exemple, per a la realitzaci\u00f3 de neteja en una empresa del sector de les telecomunicacions) ha desaparegut. Aquesta eliminaci\u00f3 entrar\u00e0 en vigor el 30 de mar\u00e7 de 2022, i s&#8217;aplica el r\u00e8gim transitori que s&#8217;indica en el seg\u00fcent par\u00e0graf.<\/p>\n\n\n\n<p><strong>R\u00e8gim transitori<\/strong><\/p>\n\n\n\n<p>Els contractes d&#8217;obra i servei, eventuals o d&#8217;interinitat subscrits abans del 31-12-2021 es mantindran vigents fins a la seva durada m\u00e0xima, encara que es produeixi amb posterioritat al 30-03-2022, i es regiran per la normativa anterior. Els contractes d&#8217;obra i servei o eventuals subscrits entre el 31-12-2021 i el 30-03-2022 es regiran per la normativa anterior, per\u00f2 la seva durada no podr\u00e0 ser superior a sis mesos. A partir del 30-03-2022 nom\u00e9s es podran subscriure nous contractes segons la nova normativa.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Altres modificacions a tenir en compte<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Predomini del contracte indefinit<\/strong>: Tot contracte de treball es presumeix, en principi, indefinit i es prohibeix els contractes temporals per a la realitzaci\u00f3 dels treballs en el marc de<strong>\u00a0<\/strong>contractes, subcontractes o concessions administratives\u00a0que constitueixin l&#8217;activitat ordin\u00e0ria de l&#8217;empresa.<\/li><li><strong>Sancions<\/strong>: S&#8217;endureix el r\u00e8gim sancionador i les multes aniran d&#8217;un m\u00ednim de 1.000 \u20ac a un m\u00e0xim de 10.000 \u20ac (per treballador).<\/li><li><strong>Cotitzaci\u00f3 addicional<\/strong>: Es\u00a0modifica el sistema de cotitzaci\u00f3 addicional per als contractes temporals\u00a0que passa de penalitzar nom\u00e9s les contractacions inferiors a cinc dies a aplicar-se a tots els contractes inferiors a trenta dies.
