{"id":6450,"date":"2022-03-09T13:01:29","date_gmt":"2022-03-09T11:01:29","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/arrendament-dhabitatges-mes-dificultats-pels-arrendadors\/"},"modified":"2022-03-09T13:01:29","modified_gmt":"2022-03-09T11:01:29","slug":"arrendament-dhabitatges-mes-dificultats-pels-arrendadors","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/arrendament-dhabitatges-mes-dificultats-pels-arrendadors\/","title":{"rendered":"Arrendament d&#8217;habitatges: M\u00e9s dificultats pels arrendadors"},"content":{"rendered":"\n<h5 class=\"wp-block-heading\"><\/h5>\n\n\n\n<p>El Diari Oficial de la Generalitat del 7 de mar\u00e7 publica la <em><a href=\"https:\/\/portaldogc.gencat.cat\/utilsEADOP\/PDF\/8620\/1894033.pdf\">Llei 1\/2022 <\/a><\/em>que ha entrat en vigor el 8 de mar\u00e7 i modifica la Llei 18\/2007 del dret a l&#8217;habitatge, la Llei 24\/2015, de mesures per afrontar la pobresa energ\u00e8tica, i la Llei 4\/2016 de protecci\u00f3 a persones en risc d&#8217;exclusi\u00f3. Destaquem el seg\u00fcent: <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Modificacions de la Llei 18\/2007 del dret a l&#8217;habitatge.<\/h3>\n\n\n\n<p><strong>Incompliment de la funci\u00f3 social de la propietat:<\/strong> Es considerar\u00e0 que hi ha incompliment de la funci\u00f3 social de la propietat quan un habitatge estigui desocupat de manera permanent i injustificada durant un per\u00edode de m\u00e9s de dos anys. No es considera causa justificada la ocupaci\u00f3 il\u00b7legal ni la transmissi\u00f3 de la propietat a favor d&#8217;una persona jur\u00eddica. <\/p>\n\n\n\n<p><strong>Utilitzaci\u00f3 an\u00f2mala d&#8217;un habitatge: <\/strong>Es considera utilitzaci\u00f3 an\u00f2mala d\u2019un habitatge la desocupaci\u00f3 permanent i injustificada. S&#8217;assimila a aquesta utilitzaci\u00f3 an\u00f2mala la dels edificis inacabats que estiguin destinats a habitatge amb m\u00e9s del 80% de les obres de construcci\u00f3 executades quan hagi transcorregut m\u00e9s de dos anys des de que hagu\u00e9s finalitzat el termini per acabar-les. <\/p>\n\n\n\n<p><strong>Registre de gran tenidors que siguin persona jur\u00eddica<\/strong>: Es crea el registre de grans tenidors d\u2019habitatge  al qual s&#8217;han d&#8217;inscriure les persones jur\u00eddiques que tinguin aquesta condici\u00f3. La inscripci\u00f3 al Registre s&#8217;ha de fer fins el 8 d&#8217;abril com a data l\u00edmit, que tamb\u00e9 han de comunicar a l&#8217;Ag\u00e8ncia de l&#8217;Habitatge el nombre i la relaci\u00f3 d&#8217;habitatges de que son titulars.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Modificaci\u00f3 de la Llei 24\/2015, del 29 de juliol, de mesures urgents en l&#8217;\u00e0mbit de l&#8217;habitatge i la pobresa energ\u00e8tica.<\/h3>\n\n\n\n<p><strong>S&#8217;amplia el concepte de &#8220;gran tenidor&#8221; d&#8217;habitatge<\/strong>: Es passa a considerar grans tenidors d&#8217;habitatge les persones jur\u00eddiques que tenen la titularitat de m\u00e9s de deu d&#8217;habitatges. (Fins ara, 15 habitatges eren el m\u00ednim per que una societat fos considerada &#8220;gran tenidor&#8221;). En conseq\u00fc\u00e8ncia i en l\u00ednies generals, a partir d&#8217;ara es consideren grans tenidor d&#8217;habitatge:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li> Les entitats financeres, les filials immobili\u00e0ries d&#8217;aquestes entitats, els fons d&#8217;inversi\u00f3 i les entitats de gesti\u00f3 d&#8217;actius.<\/li><li><strong>Les persones jur\u00eddiques <\/strong>que siguin titulars de<strong> m\u00e9s de deu<\/strong> habitatges. <\/li><li>Els fons de capital risc i de titulitzaci\u00f3 d&#8217;actius.<\/li><li><strong>Les persones f\u00edsiques <\/strong>que siguin propiet\u00e0ries de <strong>m\u00e9s de quinze <\/strong>habitatges, o copropiet\u00e0ries si la seva quota de participaci\u00f3 en la comunitat representa m\u00e9s de 1.500 metres quadrats de s\u00f2l destinat a habitatge.<\/li><\/ul>\n\n\n\n<p><strong>Obligaci\u00f3 d&#8217;oferir o renovar lloguer social<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>S&#8217;ha d&#8217;oferir lloguer social abans d&#8217;interposar demandes judicials per reclamar deutes hipotecaris i demandes de desnonament per a finalitzaci\u00f3 de contracte o per manca de contracte en determinades circumst\u00e0ncies.<\/li><li>Els contractes de lloguer social s&#8217;hauran de renovar obligat\u00f2riament si al final de la seva durada els ocupants de l&#8217;habitatge segueixen dins els par\u00e0metres legals d&#8217;exclusi\u00f3 residencial.<\/li><li>Les obligacions d&#8217;oferir i de renovar un lloguer social s\u00f3n aplicables tamb\u00e9 en el cas que els procediments judicials corresponents s&#8217;hagin iniciat abans de l&#8217;entrada en vigor d&#8217;aquesta llei i encara estiguin en tramitaci\u00f3.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Modificaci\u00f3 de la Llei 4\/2016, del 23 de desembre, de mesures de protecci\u00f3 del dret a l&#8217;habitatge de les persones en risc d&#8217;exclusi\u00f3 residencial<\/h3>\n\n\n\n<p><strong>Expropiaci\u00f3 temporal d&#8217;habitatges buits per causa d&#8217;inter\u00e8s social<\/strong>: Per poder aplicar l&#8217;expropiaci\u00f3 for\u00e7osa per incompliment de la funci\u00f3 social de la propietat caldr\u00e0 la concurr\u00e8ncia dels requisits seg\u00fcents:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li> Que els immobles estiguin situats en les \u00e0rees de demanda residencial forta i acreditada, o en els municipis que el Govern declari per decret, atenent les necessitats d&#8217;habitatge i el parc d&#8217;habitatges disponibles.<\/li><li>Que els habitatges estiguin inscrits en el Registre d&#8217;habitatges buits i d&#8217;habitatges ocupats sense t\u00edtol habilitant, o siguin susceptibles d&#8217;estar-hi inscrits, o pertanyin a persones jur\u00eddiques que els hagin adquirit d&#8217;un titular d&#8217;habitatges inscrits en el Registre en primera o ulteriors transmissions encara que el titular actual sigui un fons de titulitzaci\u00f3 d\u2019actius.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria7_42165816-Copia.jpg\"><img fetchpriority=\"high\" decoding=\"async\" width=\"658\" height=\"325\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria7_42165816-Copia.jpg\" alt=\"blog assessoria integral girona i figueres | RM Assessors\" class=\"wp-image-651\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria7_42165816-Copia.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria7_42165816-Copia-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/figure>\n\n\n\n<h5 class=\"wp-block-heading\">Som administradors de finques i agents immobiliaris.
