{"id":6702,"date":"2022-08-09T13:37:01","date_gmt":"2022-08-09T11:37:01","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/nova-llei-integral-per-a-la-igualtat-de-tracte-i-la-no-discriminacio\/"},"modified":"2022-08-09T13:37:01","modified_gmt":"2022-08-09T11:37:01","slug":"nova-llei-integral-per-a-la-igualtat-de-tracte-i-la-no-discriminacio","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/nova-llei-integral-per-a-la-igualtat-de-tracte-i-la-no-discriminacio\/","title":{"rendered":"Nova llei integral per a la igualtat de tracte i la no discriminaci\u00f3."},"content":{"rendered":"\n<h5 class=\"wp-block-heading\">La nova llei per protegir la igualtat de tracte i la no discriminaci\u00f3 t\u00e9 impacte en l&#8217;\u00e0mbit laboral, especialment en el cas de les baixes m\u00e8diques i els acomiadaments.<\/h5>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.comunicado.es\/media\/backoffice\/files\/images\/pexels-photo-6322366.jpeg\" alt=\"\"\/><\/figure>\n\n\n\n<p>El passat 14 de juliol va entrar en vigor la <a href=\"https:\/\/www.boe.es\/boe\/dias\/2022\/07\/13\/pdfs\/BOE-A-2022-11589.pdf\"><em>Llei 15\/2022, de 12 de juliol<\/em><\/a>, que descriu els diferents tipus i sup\u00f2sits de discriminaci\u00f3 que poden apreciar-se, les mesures de defensa de la no discriminaci\u00f3 i el r\u00e8gim d&#8217;infraccions i sancions en aquesta mat\u00e8ria. La gran novetat en l&#8217;\u00e0mbit laboral consisteix en que s&#8217;ha incl\u00f2s com un sup\u00f2sit de discriminaci\u00f3 \u00ab<em>la malaltia o condici\u00f3 de salut, estat serol\u00f2gic o predisposici\u00f3 gen\u00e8tica a sofrir patologia i trastorns<\/em>\u00bb, extrem que fins al moment no estava reconegut com una de les causes de discriminaci\u00f3 recollides en l&#8217;article 14 de la Constituci\u00f3 Espanyola, fet que  tindr\u00e0 un clar impacte en la qualificaci\u00f3 dels acomiadaments que s&#8217;efectuen a treballadors que sofreixen algun tipus de quadre patol\u00f2gic o m\u00e8dic i, especialment, als treballadors que es troben en situaci\u00f3 de baixa per incapacitat temporal (IT) en l&#8217;empresa.<\/p>\n\n\n\n<p><strong>En l&#8217;\u00e0mbit laboral, la norma incorpora una s\u00e8rie de previsions<\/strong>, entre les quals destaquem les seg\u00fcents:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Igualtat de tracte i prohibici\u00f3 de discriminaci\u00f3<\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li> No es podran establir limitacions, segregacions o exclusions per a l&#8217;acc\u00e9s a l&#8217;ocupaci\u00f3 per compte d&#8217;altri, inclosos els criteris de selecci\u00f3, en la formaci\u00f3 per a l&#8217;ocupaci\u00f3, en la promoci\u00f3 professional, en la retribuci\u00f3, en la jornada i altres condicions de treball, aix\u00ed com en la suspensi\u00f3, l&#8217;acomiadament o altres causes d&#8217;extinci\u00f3 del contracte de treball.<\/li><li>S&#8217;entendran discriminatoris els criteris i sistemes d&#8217;acc\u00e9s a l&#8217;ocupaci\u00f3, o en les condicions de treball que produeixin situacions de discriminaci\u00f3 indirecta.<\/li><li><strong>L&#8217;ocupador no podr\u00e0 preguntar sobre les condicions de salut de l&#8217;aspirant al lloc<\/strong>.<\/li><li>La representaci\u00f3 legal dels treballadors i l&#8217;empresa vetllaran pel compliment del dret a la igualtat de tracte i no discriminaci\u00f3 i, en particular, en mat\u00e8ria de mesures d&#8217;acci\u00f3 positiva i de la consecuci\u00f3 dels seus objectius.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Responsabilitat social<\/h3>\n\n\n\n<p>Les empreses podran assumir la realitzaci\u00f3 d&#8217;accions de responsabilitat social consistents en mesures per a promoure condicions d&#8217;igualtat de tracte i no discriminaci\u00f3 de les quals informar\u00e0 els representants dels treballadors. Aquestes accions podran ser concertades amb la representaci\u00f3 dels treballadors. Les empreses podran fer \u00fas publicitari de les seves accions de responsabilitat en mat\u00e8ria d&#8217;igualtat.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Garanties <\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Responsabilitat per l&#8217;incompliment<\/strong>: L&#8217;incompliment de les mesures preventives i d&#8217;aquelles que siguin  adequades per al cessament de les situacions discriminat\u00f2ries,  donar\u00e0 lloc a responsabilitats administratives, aix\u00ed com, si \u00e9s el cas, penals i civils pels danys i perjudicis que puguin derivar-se.<\/li><li><strong>Obligaci\u00f3 de reparar el mal causat:<\/strong> La persona f\u00edsica o jur\u00eddica que causi discriminaci\u00f3 reparar\u00e0 el mal causat proporcionant una indemnitzaci\u00f3 i restituint a la v\u00edctima a la situaci\u00f3 anterior a l&#8217;incident discriminatori, quan sigui possible. <strong>Seran igualment responsables del mal causat els ocupadors quan la discriminaci\u00f3, incl\u00f2s l&#8217;assetjament, es produeixi en el seu \u00e0mbit d&#8217;organitzaci\u00f3 o direcci\u00f3 i no hagin complert les obligacions previstes en el par\u00e0graf precedent.<\/strong><\/li><li><strong>Nul\u00b7litat:<\/strong> Seran nuls de ple dret les disposicions, actes o cl\u00e0usules dels negocis jur\u00eddics que constitueixin o causin discriminaci\u00f3.<\/li><li><strong>Tutela judicial:<\/strong> El dret a la tutela judicial del dret a la igualtat de tracte i no discriminaci\u00f3 comprendr\u00e0 mesures necess\u00e0ries per posar fi a la discriminaci\u00f3, dirigides al cessament immediat, mesures cautelars, indemnitzaci\u00f3 dels danys i perjudicis causats i el restabliment de la persona perjudicada.<\/li><li><strong>Inversi\u00f3 de la c\u00e0rrega de la prova<\/strong>: D&#8217;acord amb el que es preveu en les lleis processals i reguladores dels procediments administratius, quan la part al\u00b7legui discriminaci\u00f3 i aporti indicis fundats sobre la seva exist\u00e8ncia, correspondr\u00e0 a la part demandada l&#8217;aportaci\u00f3 d&#8217;una justificaci\u00f3 objectiva i raonable, prou provada, de les mesures adoptades i de la seva proporcionalitat.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Autoritat independent<\/h3>\n\n\n\n<p>Es crea l&#8217;Autoritat independent per a la igualtat de tracte i la no discriminaci\u00f3, encarregada de protegir i promoure la igualtat de tracte i no discriminaci\u00f3 tant en el sector p\u00fablic com en el privat.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sancions<\/h3>\n\n\n\n<p>La llei tamb\u00e9 recull el\u00a0<strong>r\u00e8gim d&#8217;infraccions i sancions<\/strong>\u00a0en aquesta mat\u00e8ria (t\u00edtol IV) si b\u00e9 s&#8217;ha de tenir en compte que en l&#8217;ordre social el r\u00e8gim aplicable ser\u00e0 el regulat per la Llei sobre infraccions i sancions en l&#8217;ordre social i, en relaci\u00f3 amb les persones amb discapacitat, s&#8217;aplicar\u00e0 el que es preveu en la Llei general de drets de les persones amb discapacitat i de la seva inclusi\u00f3 social.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Som assessors laborals i de la Seguretat Social.
