{"id":7168,"date":"2023-02-10T13:57:52","date_gmt":"2023-02-10T12:57:52","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/arrendament-dhabitatge-habitual-prorroga-obligatoria-dels-contractes-per-sis-mesos-mes\/"},"modified":"2023-04-24T10:26:50","modified_gmt":"2023-04-24T08:26:50","slug":"arrendament-dhabitatge-habitual-prorroga-obligatoria-dels-contractes-per-sis-mesos-mes","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/arrendament-dhabitatge-habitual-prorroga-obligatoria-dels-contractes-per-sis-mesos-mes\/","title":{"rendered":"Arrendament d&#8217;habitatge habitual. pr\u00f2rroga obligat\u00f2ria dels contractes per sis mesos m\u00e9s"},"content":{"rendered":"<h5>Una disposici\u00f3 del passat 10 de gener permet que els arrendataris puguin for\u00e7ar una pr\u00f2rroga extraordin\u00e0ria, per un per\u00edode m\u00e0xim de sis mesos, dels contractes d&#8217;arrendament d&#8217;habitatge habitual que es trobin en la t\u00e0cita reconducci\u00f3 de l\u2019article 1566 del Codi Civil.<\/h5>\n<p>En el BOE del passat 11 de gener es va publicar el <span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000;\" href=\"https:\/\/www.boe.es\/boe\/dias\/2023\/01\/11\/pdfs\/BOE-A-2023-625.pdf\">Real Decreto-ley 1\/2023<\/a><\/em><\/span>, on es va incloure una modificaci\u00f3 legislativa que permet que l&#8217;arrendatari d&#8217;un habitatge pugui exigir la pr\u00f2rroga del seu arrendament un cop hagi esgotat la seva durada m\u00e0xima. Destaquem el seg\u00fcent:<\/p>\n<h3>Quina es la durada m\u00e0xima de l&#8217;arrendament d&#8217;un habitatge ?<\/h3>\n<p>Podem distingir 3 fases:<\/p>\n<ul>\n<li><strong>Durada inicial<\/strong>: La durada inicial es la que figura en el contracte com a durada del arrendament lliurament pactada per les dues parts. Si aquesta fos inferior a cinc anys\u00a0 (set anys si l&#8217;arrendador es una persona jur\u00eddica), l&#8217;arrendatari podr\u00e0 exigir pr\u00f2rrogues anuals fins assolir aquesta durada total de 5 o 7 anys.<\/li>\n<li><strong>Pr\u00f2rroga legal<\/strong>: En el cas que l&#8217;arrendador no hagues notificat a l&#8217;arrendatari la seva voluntat de no renovar el contracte amb una antelaci\u00f3 m\u00ednima de 4 mesos al final del per\u00edode anterior, l&#8217;arrendatari podr\u00e0 exigir novament la pr\u00f2rroga de l&#8217;arrendament per per\u00edodes anuals, amb un m\u00e0xim de 3.<\/li>\n<li><strong>T\u00e0cita reconducci\u00f3<\/strong>: Esgotada la pr\u00f2rroga legal, si l&#8217;arrendatari segueix a l&#8217;habitatge durant 15 dies amb la conformitat de l&#8217;arrendador s&#8217;entendr\u00e0 que el contracte ha quedat prorrogat per un any quan s&#8217;hagi fixat un lloguer anual, per un mes quan el lloguer sigui mensual, o per dies quan el lloguer sigui diari.<\/li>\n<\/ul>\n<h3>En quin moment i en quines condicions es podr\u00e0 exigir la nova pr\u00f2rroga obligat\u00f2ria per sis mesos m\u00e9s ?<\/h3>\n<ul>\n<li><strong>Moment:<\/strong> Quan el contracte d&#8217;arrendament hagi entrat en t\u00e0cita reconducci\u00f3 i abans del 30 de juny de 2023.<\/li>\n<li><strong>Efectes:<\/strong> El propietari estar\u00e0 obligat a acceptar la pr\u00f2rroga sol\u00b7licitada per l\u2019arrendatari, excepte:<br \/>\n\u2022 Que per acord d\u2019ambdues parts s\u2019hagin fixat altres condicions.<br \/>\n\u2022 Que l\u2019arrendador, pr\u00e8viament, hagu\u00e9s comunicat a l\u2019arrendatari la necessitat d\u2019ocupar l\u2019habitatge arrendada per ell o per un familiar<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria8_328771481.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-788\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria8_328771481.jpg\" alt=\"\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria8_328771481.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/immobiliaria8_328771481-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<h3><span style=\"color: #3366ff;\"><em>Som agents immobiliaris, Administradors de finques i API.
