{"id":7248,"date":"2023-03-23T19:36:01","date_gmt":"2023-03-23T17:36:01","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/les-claus-de-la-nova-reforma-de-les-pensions-2023\/"},"modified":"2023-03-23T19:36:01","modified_gmt":"2023-03-23T17:36:01","slug":"les-claus-de-la-nova-reforma-de-les-pensions-2023","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/les-claus-de-la-nova-reforma-de-les-pensions-2023\/","title":{"rendered":"Les claus de la nova reforma de les pensions 2023"},"content":{"rendered":"<h5>Importants novetats en mat\u00e8ria de pensions, entre les quals destaquen l&#8217;increment gradual de les bases m\u00e0ximes de cotitzaci\u00f3, la creaci\u00f3 d&#8217;una quota de solidaritat del 6% per als salaris m\u00e9s alts que superin la base m\u00e0xima de cotitzaci\u00f3, o la modificaci\u00f3 del mecanisme d&#8217;equitat intergeneracional (MEI), al mateix temps que s&#8217;estableix una nova f\u00f3rmula de c\u00f2mput per al c\u00e0lcul de la pensi\u00f3.<\/h5>\n<hr \/>\n<p>S&#8217;ha publicat en el BOE del 17 de mar\u00e7 el <strong><em><span style=\"color: #ff0000;\"><a style=\"color: #ff0000;\" href=\"https:\/\/www.boe.es\/boe\/dias\/2023\/03\/17\/pdfs\/BOE-A-2023-6967.pdf\">Reial decret llei 2\/2023<\/a><\/span><\/em><\/strong>, de 16 de mar\u00e7 que recull novetats importants en mat\u00e8ria de pensions i de cotitzaci\u00f3 a la Seguretat Social. Destaquem les seg\u00fcents:<\/p>\n<h3><strong>Entrada en vigor<\/strong><\/h3>\n<p>La norma entrar\u00e0 en vigor a partir del primer dia del mes seg\u00fcent a la seva publicaci\u00f3 al BOE, \u00e9s a dir, <strong>l&#8217;1 d&#8217;abril de 2023, excepte unes certes disposicions<\/strong> relacionades amb la Llei General de la Seguretat Social, que t\u00e9 altres dates d&#8217;entrada en vigor, <strong>algunes en 2024, 2005 i 2026<\/strong>.<\/p>\n<h3><strong>Les claus de la reforma<\/strong><\/h3>\n<h4><strong>1. Increment gradual de les bases m\u00e0ximes de cotitzaci\u00f3<\/strong><\/h4>\n<p>Entre els anys 2024 i 2050 les bases m\u00e0ximes de cotitzaci\u00f3 als diferents r\u00e8gims de la Seguretat Social s&#8217;actualitzaran cada any conforme al IPC incrementat en 1,2 punts.<\/p>\n<h4><strong>2. Increment gradual del mecanisme d&#8217;equitat intergeneracional (MEI)<\/strong><\/h4>\n<p>Es tracta del nou concepte que es va crear en la Llei 21\/2021, de 28 de desembre, que s&#8217;aplica ja des del 1 de gener de 2023 i que s&#8217;anir\u00e0 incrementant progressivament del 0,6% a l&#8217;1,2%.<\/p>\n<ul>\n<li>L&#8217;any 2023, ser\u00e0 de 0,60 punts percentuals, dels quals el 0,50 correspondr\u00e0 a l&#8217;empresa i el 0,10 al treballador.<\/li>\n<li>L&#8217;any 2024, ser\u00e0 de 0,70 punts percentuals, dels quals el 0,58 correspondr\u00e0 a l&#8217;empresa i el 0,12 al treballador.<\/li>\n<li>L&#8217;any 2025, ser\u00e0 de 0,80 punts percentuals, dels quals el 0,67 correspondr\u00e0 a l&#8217;empresa i el 0,13 al treballador.<\/li>\n<li>L&#8217;any 2026, ser\u00e0 de 0,90 punts percentuals, dels quals el 0,75 correspondr\u00e0 a l&#8217;empresa i el 0,15 al treballador.<\/li>\n<li>L&#8217;any 2027, ser\u00e0 d&#8217;1 punt percentual, del qual el 0,83 correspondr\u00e0 a l&#8217;empresa i el 0,17 al treballador.<\/li>\n<li>L&#8217;any 2028, ser\u00e0 d&#8217;1,1 punts percentuals, dels quals el 0,92 correspondr\u00e0 a l&#8217;empresa i el 0,18 al treballador.<\/li>\n<li>L&#8217;any 2029, ser\u00e0 d&#8217;1,2 punts percentuals, dels quals l&#8217;1,00 correspondr\u00e0 a l&#8217;empresa i el 0,2 al treballador.<\/li>\n<li>Des de l&#8217;any 2030 fins a 2050 es mantindr\u00e0 el mateix percentatge de l&#8217;1,2, amb igual distribuci\u00f3 entre empresari i treballador.<\/li>\n<\/ul>\n<h4>4.- Altres modificacions:<\/h4>\n<ul>\n<li><strong>\u00a0Nou c\u00f2mput per al c\u00e0lcul de la pensi\u00f3 en mat\u00e8ria de treballadors amb cotitzacions irregulars: <\/strong>La base reguladora de la pensi\u00f3 de jubilaci\u00f3 ser\u00e0 el quocient que resulti de dividir entre 378, la suma de les bases de cotitzaci\u00f3 de l&#8217;interessat durant 324 mesos anteriors al del mes previ al del fet causant obtinguts de la forma que s&#8217;indica en la norma. Aquesta modificaci\u00f3 entrar\u00e0 en vigor l&#8217;1 de gener de 2026, si b\u00e9 fins a l&#8217;1 de gener de 2037 s&#8217;aplicaran de manera gradual.<\/li>\n<li><strong>Increment del complement per bretxa de g\u00e8nere: <\/strong>Tindr\u00e0 un increment addicional a la revaloraci\u00f3 anual, del 10% en el bienni 2024-2025.<\/li>\n<li><strong>Treballadors contractats a temps parcial: c\u00f2mput dels per\u00edodes de cotitzaci\u00f3:<\/strong>\u00a0 Es tenen en compte els per\u00edodes cotitzats sigui quina sigui la durada de la jornada realitzada en cadascun d&#8217;ells.<\/li>\n<li><strong>Incapacitat temporal: <\/strong>L&#8217;esgotament del termini de 365 dies sense emissi\u00f3 d&#8217;alta m\u00e8dica suposara passar autom\u00e0ticament a la pr\u00f2rroga d&#8217;incapacitat temporal, sense necessitat de declaraci\u00f3 expressa.<\/li>\n<li><strong>Refor\u00e7 de les pensions m\u00ednimes: <\/strong>La norma tamb\u00e9 busca refor\u00e7ar i millorar les pensions m\u00ednimes, incloses una s\u00e8rie d&#8217;augments de les pensions m\u00e9s baixes, m\u00ednimes i no contributives.<\/li>\n<li><strong>Cotitzaci\u00f3 d&#8217;alumnes en pr\u00e0ctiques:<\/strong>Es regula la inclusi\u00f3 en el sistema de la Seguretat Social d&#8217;alumnes que realitzin pr\u00e0ctiques formatives o pr\u00e0ctiques acad\u00e8miques externes incloses en programes de formaci\u00f3, que inclouen les realitzades per alumnes universitaris i de formaci\u00f3 professional. Aquesta nova normativa entrar\u00e0 en vigor l&#8217;1 d&#8217;octubre de 2023.
