{"id":7297,"date":"2023-04-05T18:42:26","date_gmt":"2023-04-05T16:42:26","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/ocupacio-illegal-dhabitatges-amb-alteracio-de-la-convivencia\/"},"modified":"2023-04-24T10:24:07","modified_gmt":"2023-04-24T08:24:07","slug":"ocupacio-illegal-dhabitatges-amb-alteracio-de-la-convivencia","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/ocupacio-illegal-dhabitatges-amb-alteracio-de-la-convivencia\/","title":{"rendered":"Ocupaci\u00f3 il\u00b7legal d&#8217;habitatges amb alteraci\u00f3 de la conviv\u00e8ncia."},"content":{"rendered":"<h5>Es pot obligar als grans tenidors d&#8217;immobles a exercitar accions legals de desnonament quan els seus immobles siguin ocupats il\u00b7legalment i els &#8220;okupes&#8221; alterin la conviv\u00e8ncia.<\/h5>\n<p>Una part de la problem\u00e0tica de les &#8220;okupacions&#8221; deriva del fet que els propietaris que son grans tenidors, com la SAREB, bancs i fons d&#8217;inversi\u00f3, sovint s&#8217;inhibeixen quan s&#8217;ocupen il\u00b7legalment les seves propietats encara que els &#8220;okupes&#8221; alteren la conviv\u00e8ncia del ve\u00efnat.<\/p>\n<p>Per tractar de resoldre-ho, el passat 18 de febrer va entrar en vigor a la<em><span style=\"color: #ff0000;\"><a style=\"color: #ff0000;\" href=\"https:\/\/portaldogc.gencat.cat\/utilsEADOP\/PDF\/8857\/1957582.pdf\"> Llei 1\/2023<\/a> <\/span><\/em>del Parlament de Catalunya, de la que va ser ponent l&#8217;alcaldessa de Girona, Marta Madrenas, de la que destaquem el seg\u00fcent:<\/p>\n<h3>A qui afecta aquesta llei ?<\/h3>\n<p>Afecta als grans tenidors d&#8217;habitatge que tinguin alguna finca ocupada il\u00b7legalment quan els &#8220;okupes&#8221; alterin la conviv\u00e8ncia, o l&#8217;ordre p\u00fablic, o posin en perill la seguretat o la integritat de l&#8217;immoble.<\/p>\n<h3>A qui es considera grans tenidors d&#8217;habitatge ?<\/h3>\n<p>Un gran tenidor \u00e9s un propietari, entenent-se aquest com una persona f\u00edsica o jur\u00eddica, que sigui titular de m\u00e9s de 10 habitatges, excloent garatges i trasters, o que tingui una superf\u00edcie constru\u00efda de m\u00e9s de 1.500 m<sup>2<\/sup>.<\/p>\n<p>Per tant, grans tenidors no son \u00fanicament aquells grans propietaris que sovint s&#8217;inhibeixen de les &#8220;okupacions&#8221; (SAREB, bancs, fons &#8230;) si no tamb\u00e9 aquells propietaris particulars, no tant grans, que tinguin m\u00e9s de 10 habitatges i que solen ser el m\u00e9s interessats en que les seves finques no siguin &#8220;okupades&#8221;.<\/p>\n<h3>A qui pot beneficiar aquesta llei ?<\/h3>\n<p>A les comunitats de propietaris i als ve\u00efns dels immobles &#8220;okupats&#8221;, quan hi hagi alteraci\u00f3 de conviv\u00e8ncia, o de l&#8217;ordre p\u00fablic, o els &#8220;okupes&#8221; posin en perill la seguretat o la integritat de l&#8217;immoble. Casos en que els &#8220;grans&#8221; propietaris tenen la obligaci\u00f3 legal d&#8217;exercitar les accions de desnonament.<\/p>\n<p>En qualsevol d&#8217;aquests casos els ve\u00efns podran denunciar els fets a l&#8217;Ajuntament de la localitat i l&#8217;Ajuntament podr\u00e0 arribar a desnonar els &#8220;okupes&#8221;.<\/p>\n<p>Per acreditar aquestes alteracions caldr\u00e0 quantes m\u00e9s den\u00fancies dels ve\u00efns millor.<\/p>\n<h3>Quin ser\u00e0 el procediment ?<\/h3>\n<ul>\n<li>Un\u00a0 cop l&#8217;Ajuntament tingui per acreditades les alteracions, si el propietari no hagu\u00e9s actuat contra els &#8220;okupes&#8221; el requerir\u00e0, i tamb\u00e9 als ocupants, per que en el termini de 5 dies acreditin que tenen un contracte o un altres t\u00edtol que habiliti a ocupar legalment la finca. Tamb\u00e9 requerir\u00e0 la propietat per que, cas contrari, acrediti haver iniciat accions de desnonament en el termini d&#8217;un mes.<\/li>\n<li>Si el requeriment hagu\u00e9s estat infructu\u00f3s, l&#8217;Ajuntament podr\u00e0 exercitar l&#8217;acci\u00f3 de desnonament en substituci\u00f3 del propietari i al seu c\u00e0rrec, podent sancionar tamb\u00e9 a la propietat.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/Okupes.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-medium wp-image-7298\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/Okupes-300x195.jpg\" alt=\"\" width=\"300\" height=\"195\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/Okupes-300x195.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/Okupes.jpg 640w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<h3><span style=\"color: #3366ff;\"><em>Som Advocats, Administradors de Finques i API.
