Aquesta cl\u00e0usula perjudica greument als consumidors en un moment, com l&#8217;actual, de baixos interessos, en que el que paguen els bancs pels nostres estalvis s&#8217;acosta al 0%.<\/p>\n<p>Tant el Tribunal de Just\u00edcia de la Uni\u00f3 Europea com els Tribunals espanyols han declarat la nul\u00b7litat de la cl\u00e0usula sol. Davant d&#8217;aix\u00f2, quan el client acudeix al seu banc per exigir l&#8217;eliminaci\u00f3 de la cl\u00e0usula, li solen proposar uns pactes que poden ser abusius, tals com:<\/p>\n<ul>\n<li>Reduir la cl\u00e0usula s\u00f2l a canvi de signar una declaraci\u00f3 de con\u00e8ixer perfectament les conseq\u00fc\u00e8ncies i riscos que t\u00e9 aquesta cl\u00e0usula.<\/li>\n<li>Eliminar temporalment la cl\u00e0usula s\u00f2l per per\u00edodes que oscil\u2022len entre els 2 i els 20 anys. Despr\u00e9s, la cl\u00e0usula torna a les seves condicions inicials.<\/li>\n<li>Eliminaci\u00f3 total del s\u00f2l a canvi de l&#8217;augment del diferencial del tipus d&#8217;inter\u00e8s.<\/li>\n<li>Obligar a\u00a0 contractar amb l&#8217;entitat banc\u00e0ria productes com assegurances de vida o assegurances de protecci\u00f3 de pagaments.<\/li>\n<li>Convertir temporalment la hipoteca d&#8217;inter\u00e8s variable a inter\u00e8s fix.<\/li>\n<\/ul>\n<p>A tot aix\u00f2 cal afegir les males pr\u00e0ctiques en qu\u00e8 sovint incorren algunes entitats banc\u00e0ries:<\/p>\n<ul>\n<li>Prohibir al consumidor treure de la sucursal el document amb l&#8217;oferta.<\/li>\n<li>Impedir veure el contracte abans de la signatura.<\/li>\n<li>Exigir confidencialitat.<\/li>\n<\/ul>\n<p>Es important que tots els consumidors s\u00e0piguen:<\/p>\n<ul>\n<li>Que el seu banc no t\u00e9 dret a imposar-lis cap condici\u00f3 per eliminar la cl\u00e0usula sol.<\/li>\n<li>Que tenen dret a exigir la devoluci\u00f3 dels interessos que hagin pagat de m\u00e9s,<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica4_33796361.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-796\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica4_33796361.jpg\" alt=\"juridica4\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica4_33796361.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica4_33796361-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<h3><span style=\"color: #993366;\"><em>Som assessors jur\u00eddics.
