{"id":7420,"date":"2016-04-30T13:39:32","date_gmt":"2016-04-30T11:39:32","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/totes-les-empreses-han-de-dur-un-registre-de-la-jornada-dels-seus-treballadors\/"},"modified":"2016-04-30T13:39:32","modified_gmt":"2016-04-30T11:39:32","slug":"totes-les-empreses-han-de-dur-un-registre-de-la-jornada-dels-seus-treballadors","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/totes-les-empreses-han-de-dur-un-registre-de-la-jornada-dels-seus-treballadors\/","title":{"rendered":"&#8221; Totes les empreses han de dur un registre de la jornada dels seus treballadors&#8221;"},"content":{"rendered":"<p>El passat 30 d&#8217;abril us varem informar que l&#8217;Audi\u00e8ncia Nacional va declarar, en dues sent\u00e8ncies, de dates 4\/12\/2015 i 19\/2\/2016, que l&#8217;obligaci\u00f3 de registre de la jornada de cada treballador que estableix l&#8217;article 35.5 de l&#8217;Estatut dels Treballadors (ET) &#8220;a l&#8217;efecte del c\u00f2mput d&#8217;hores extraordin\u00e0ries&#8221; s&#8217;est\u00e9n a tots els casos, tant si es tracta de treballadors contractats a temps parcial com si ho estan a temps complet\u00a0 i no queda condicionada a la realitzaci\u00f3 efectiva d&#8217;hores extres i\/o complement\u00e0ries.<\/p>\n<p>Havent-se donat casos de sancions a empreses i a la llum de l&#8217;experi\u00e8ncia recollida durant aquests mesos, hem considerar oport\u00fa revisar i reiterar la comunicaci\u00f3 anterior i <span style=\"text-decoration: underline; color: #3366ff;\"><strong>Destaquem el seg\u00fcent:<br \/>\n<\/strong><\/span><\/p>\n<ul>\n<li><strong><span style=\"text-decoration: underline;\"><span style=\"color: #3366ff; text-decoration: underline;\">Obligaci\u00f3 de registrar la jornada:<\/span><\/span> <\/strong>El registre de jornada ha d&#8217;existir en tots els centres de treball, de forma obligat\u00f2ria, independentment de la seva activitat o dimensi\u00f3, sigui a trav\u00e9s de mitjans mec\u00e0nics o b\u00e9 manuals.<\/li>\n<li><span style=\"text-decoration: underline;\"><span style=\"color: #3366ff; text-decoration: underline;\"><strong>Contingut del registre:<\/strong><\/span><\/span> <span style=\"color: #3366ff;\"><span style=\"color: #000000;\">En el registre hi ha de constar la<\/span><\/span> concreta jornada\u00a0 realitzada cada dia per tots i cada un dels treballadors en plantilla, especificant hora d&#8217;entrada i de sortida. Si el registre es manual, es aconsellable que hi consti la signatura del treballador. No hi ha obligaci\u00f3 de conservar el registre una vegada lliurat al treballador el resum mensual, per\u00f2 fins aquell moment el registre s&#8217;haur\u00e0 de conservar en\u00a0 el centre de treball i a disposici\u00f3 dels inspectors de treball<\/li>\n<li><strong><span style=\"text-decoration: underline; color: #3366ff;\">Resum mensual de la jornada realitzada: <\/span><\/strong>Junt amb la n\u00f2mina mensual s&#8217;ha de lliurar als treballadors un resum de la jornada realitzada durant el mes i l&#8217;empresa s&#8217;ha de quedar una c\u00f2pia del resum. El resum de la jornada tamb\u00e9 es pot consignar en la pr\u00f2pia n\u00f2mina. Si el resum es lliura al treballador per separat es aconsellable fer signar una c\u00f2pia per tenir const\u00e0ncia del lliurament. Els resums mensuals de jornada s&#8217;han de conservar en el centre de treball durant 4 anys.<\/li>\n<li><span style=\"text-decoration: underline;\"><span style=\"color: #3366ff; text-decoration: underline;\"><strong>Incompliment de la obligaci\u00f3:<\/strong><\/span><\/span> <span style=\"color: #3366ff;\"><span style=\"color: #000000;\">L&#8217;incompliment de dur el registre diari de jornada o de lliurar al treballador el resum mensual de jornada podr\u00e0 ser sancionat com infracci\u00f3 greu, amb multa de 626 a 6.250 \u20ac.\u00a0<\/span><\/span>En cas de contractes a temps parcial, si no hi hagu\u00e9s prova en contrari de que efectivament es un treball a temps parcial, es presumir\u00e0 que el treball es a temps complet, el treballador podr\u00e0 reclamar difer\u00e8ncies salarials i l&#8217;inspector de treball podr\u00e0 liquidar difer\u00e8ncies de Seguretat Social amb rec\u00e0rrec a partir del 22 de desembre del 2013.<\/li>\n<li><span style=\"text-decoration: underline;\"><span style=\"color: #3366ff;\"><strong>Excessos de jornada<\/strong><\/span><\/span>: En el. cas que del registre de jornada resulti que s&#8217;ha excedit la jornada ordin\u00e0ria, cal tenir en compte que la llei permet distribuci\u00f3 irregularment la jornada al llarg de l&#8217;any (Art. 34 D.L. 24.3.1995) i que durant l&#8217;any els treballadors poden realitzar un m\u00e0xim de 80 hores extra, que es poden compensar amb dies de festa duran els quatre mesos seg\u00fcents (Art. 35 D.L. 24.3.1995).<\/li>\n<\/ul>\n<p><strong><span style=\"text-decoration: underline; color: #3366ff;\">\u00a0<\/span><\/strong><\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral3_168790421.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-802\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral3_168790421.jpg\" alt=\"laboral3\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral3_168790421.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral3_168790421-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<h3><em><span style=\"color: #3366ff;\">Som assessors laborals.
