Casos de nul\u00b7litat&#8221;"},"content":{"rendered":"<p style=\"text-align: justify;\">Segons una recent Sent\u00e8ncia de 01 de desembre de 2016 del Tribunal de Just\u00edcia de la Uni\u00f3 Europea, es consideren nuls els acomiadaments derivats d\u2019una incapacitat de llarga durada. \u00c9s a dir, no hi cap la extinci\u00f3 amb indemnitzaci\u00f3 i l\u00b4empresa vindr\u00e0 obligada a la readmissi\u00f3 del treballador amb pagament de salaris de tramitaci\u00f3.<\/p>\n<p style=\"text-align: justify;\">Arrel de la senyalada sent\u00e8ncia, els Jutjats Socials s\u2019estan pronunciant en la l\u00ednia de l\u2019\u00f2rgan europeu. A tall d\u00b4exemple trobem la recent sent\u00e8ncia dictada el dia 23 de desembre de 2016 pel Jutjat del Social n\u00fam. 33 de Barcelona que tamb\u00e9 va declarar nul un acomiadament efectuat 53 dies despr\u00e9s d\u00b4un accident laboral. .<\/p>\n<p style=\"text-align: justify;\">Els tribunals han equiparat en aquests sup\u00f2sits, una incapacitat de llarga durada amb una discapacitat, atenent al fet que la incapacitat de llarga durada respon a una limitaci\u00f3 de la capacitat del treballador a llarg termini, com si d\u2019una discapacitat es tract\u00e9s.
