Pel que fa als arrendaments d&#8217;habitatges la Llei determina quines son les conseq\u00fc\u00e8ncies de la resoluci\u00f3 anticipada del contracte per part de l&#8217;arrendatari, per\u00f2 en el cas dels arrendaments de locals de negoci el que preveu la Llei es que s&#8217;haur\u00e0 d&#8217;estar al que haguessin acordat arrendador i arrendatari en el moment de fer el contracte d&#8217;arrendament.<\/p>\n<p>Uns dels problemes en l&#8217;aplicaci\u00f3 de la Llei s&#8217;originava quan en un arrendament de local de negoci les parts no havien previst les conseq\u00fc\u00e8ncies de la resoluci\u00f3 anticipada o quan, tot hi haver-les previst, la cl\u00e0usula esdevenia nul\u00b7la per que la seva redacci\u00f3 era confosa i no s&#8217;entenia el que les parts volien dir, o per qualsevol altra causa. En tots aquest casos els tribunals venien aplicant, per analogia, la mateixa soluci\u00f3 que la Llei d&#8217;Arrendaments Urbans havia previst per l&#8217;arrendament d&#8217;habitatges en que es permet que una vegada transcorreguts sis mesos de contracte l&#8217;arrendatari el pugui resoldre en qualsevol moment avisant l&#8217;arrendador amb trenta dies d&#8217;antelaci\u00f3.<\/p>\n<p><span id=\"result_box\" class=\"\" lang=\"ca\"><span title=\"Sin embargo, este criterio parece haber cambiado a ra\u00edz de la Sentencia del TS de 3 Octubre 2017, de la Sala de lo Civil, en la que, analizando una acci\u00f3n relativa al cumplimiento del plazo de un contrato de arrendamiento para uso distinto de vivienda,\">No obstant aix\u00f2, aquest criteri sembla haver canviat arran de la Sent\u00e8ncia de la Sala Civil del Tribunal Suprem de 3 d&#8217;octubre 2017 en la que el Tribunal ha declarat que en cas de resoluci\u00f3 anticipada del contracte d&#8217;arrendament de local de negoci s&#8217;haur\u00e0 d&#8217;estar al que les parts haguessin pactat, i que si no varen pactar res s&#8217;haur\u00e0 de complir \u00edntegrament el termini previst en el contracte sense que valgui aplicar per analogia el previst per l&#8217;arrendament d&#8217;habitatges i seguidament dona una <\/span><\/span><span id=\"result_box\" class=\"\" lang=\"ca\"><span title=\"Dando un paso m\u00e1s, el Tribunal Supremo establece una clasificaci\u00f3n de los supuestos que pueden darse en relaci\u00f3n con el desistimiento unilateral en los contratos de uso distinto a vivienda: \">classificaci\u00f3 dels sup\u00f2sits que es poden produir.:<br \/>\n<\/span><\/span><\/p>\n<ul>\n<li><span style=\"color: #ff0000;\">En el cas que en el contracte hi consta que la part arrendat\u00e0ria pot rescindir el contracte abans del seu venciment pagant a l&#8217;arrendador una quantitat en concepte de penalitzaci\u00f3<\/span>: En aquest el jutjat podria acordar una reducci\u00f3 de penalitzaci\u00f3 si consider\u00e9s que en cas contrari l&#8217;arrendador s&#8217;enriquiria injustament.<\/li>\n<\/ul>\n<ul>\n<li><span style=\"color: #ff0000;\">En el cas que en el contracte no hi const\u00e9s la facultat que la part arrendat\u00e0ria pugui resoldre el contracte anticipadament i no obstant, aix\u00f2, reclam\u00e9s <\/span><span style=\"color: #ff0000;\">la seva finalitzaci\u00f3 anticipada:<br \/>\n<\/span><\/p>\n<ul>\n<li><span style=\"color: #ff0000;\">En cas que la part arrendadora s&#8217;hi opos\u00e9s i exig\u00eds el compliment del contracte<\/span>, el jutjat hauria d&#8217;obligar l&#8217;arrendatari a pagar totes les rendes fins a la finalitzaci\u00f3 del contracte.<\/li>\n<li><span style=\"color: #ff0000;\">En cas que la part arrendadora s&#8217;avingu\u00e9s a extingir anticipadament el contracte per\u00f2 exig\u00eds una indemnitzaci\u00f3 pels danys i perjudicis soferts<\/span>, l&#8217;arrendadora hauria d&#8217;acreditar quin perjudici econ\u00f2mic li ocasiona la resoluci\u00f3 anticipada del contracte (lucre cessant) i el jutjat podr\u00e0 reduir (moderar) la indemnitzaci\u00f3 si consider\u00e9s que no est\u00e0 prou justificada la quantitat reclamada.<span id=\"result_box\" class=\"\" lang=\"ca\"><\/span><br \/>\n<span id=\"result_box\" class=\"\" lang=\"ca\"><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span id=\"result_box\" class=\"\" lang=\"ca\"><span title=\"Por tanto, en el caso de arrendamientos de uso distinto a vivienda, ante un eventual desistimiento unilateral del arrendatario, debemos analizar detenidamente la redacci\u00f3n del contrato, para saber en qu\u00e9 supuesto de los tres citados nos encontramos, porque, como puede comprobarse, las consecuencias\">Per tant, en el cas d&#8217;arrendaments de locals de negoci, davant un eventual desistiment unilateral de l&#8217;arrendatari, haurem d&#8217;analitzar detingudament la redacci\u00f3 del contracte per saber en quin sup\u00f2sit ens trobem, donat que les conseq\u00fc\u00e8ncies <\/span><span title=\"son muy distintas en uno y otro caso.\">s\u00f3n molt diferents en un i altre cas.<\/span><\/span><\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2017\/06\/RM_Assessors_Foto_11.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-medium wp-image-2193\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2017\/06\/RM_Assessors_Foto_11-300x194.jpg\" alt=\"\" width=\"300\" height=\"194\" \/><\/a><\/p>\n<p><span style=\"color: #800080;\"><em><strong>Som advocats.
