{"id":7656,"date":"2019-01-03T19:18:45","date_gmt":"2019-01-03T17:18:45","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/novetats-en-la-jubilacio-parcial-amb-contracte-de-relleu\/"},"modified":"2019-01-03T19:18:45","modified_gmt":"2019-01-03T17:18:45","slug":"novetats-en-la-jubilacio-parcial-amb-contracte-de-relleu","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/en\/novetats-en-la-jubilacio-parcial-amb-contracte-de-relleu\/","title":{"rendered":"Novetats en la jubilaci\u00f3 parcial amb contracte de relleu"},"content":{"rendered":"<p>Ha quedat aprovat el <em><a href=\"https:\/\/www.boe.es\/boe\/dias\/2018\/12\/08\/pdfs\/BOE-A-2018-16791.pdf\"><span style=\"color: #ff0000;\">Reial decret-llei 20\/2018<\/span> <\/a><\/em>de mesures urgents per afavorir la competitivitat del sector industrial, que facilita la jubilaci\u00f3 parcial amb contracte de relleu en la ind\u00fastria manufacturera fins el 31 de desembre del 2022. Destaquem el seg\u00fcent:<\/p>\n<p><span style=\"color: #ff0000;\"><strong>El contracte de relleu. Concepte:\u00a0 <\/strong><\/span><\/p>\n<ul>\n<li>El contracte de relleu \u00e9s aquell que subscriu una empresa amb un treballador en situaci\u00f3 de desocupaci\u00f3 o amb un contracte de durada determinada per substituir a un altre que ha sol\u00b7licitat jubilar-se de manera parcial.<\/li>\n<li>Permet la jubilaci\u00f3 parcial anticipada d&#8217;un treballador veter\u00e0 en una empresa, que queda compensada per l&#8217;entrada en aquest lloc vacant d&#8217;un aturat o treballador amb contracte temporal en l&#8217;empresa. El treballador veter\u00e0 redueix la seva jornada, segueix cobrant el seu salari per la jornada que continua empleat i percep la pensi\u00f3 de jubilaci\u00f3 per la resta. A m\u00e9s, no assumeix cap disminuci\u00f3 en la seva pensi\u00f3 pel fet de percebre-la de manera anticipada.<\/li>\n<li>D&#8217;altra banda, el treballador m\u00e9s jove accedeix a un lloc de treball amb un contracte amb certa estabilitat i adquireix el coneixement de la persona que abandonar\u00e0 el seu lloc. Per a les empreses suposa un estalvi en costos de salaris i, a m\u00e9s, facilita l&#8217;aprenentatge de les noves incorporacions.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Requisits que haur\u00e0 de reunir el treballador que es jubili parcialment:<\/strong><\/span><em><br \/>\n<\/em><\/p>\n<ul>\n<li><span style=\"color: #ff0000;\">Nom\u00e9s poden accedir a la jubilaci\u00f3 parcial els treballadors que realitzin determinades funcions<\/span>: Els treballadors que sol\u00b7licitin l&#8217;acc\u00e9s a la jubilaci\u00f3 parcial han de realitzar directament funcions que requereixin esfor\u00e7 f\u00edsic o alt grau d&#8217;atenci\u00f3 en tasques de fabricaci\u00f3, elaboraci\u00f3 o transformaci\u00f3, aix\u00ed com en les de muntatge, posada en funcionament, manteniment i reparaci\u00f3 especialitzats de maquin\u00e0ria i equip industrial en empreses classificades com a ind\u00fastria manufacturera.<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\"><span style=\"color: #ff0000;\">Antiguitat en l&#8217;empresa d&#8217;almenys 6 anys immediatament anteriors a la data de la jubilaci\u00f3 parcial.<\/span> Es computar\u00e0 l&#8217;antiguitat acreditada en l&#8217;empresa anterior si ha intervingut una successi\u00f3 d&#8217;empresa, o en empreses pertanyents al mateix grup.<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\"><span style=\"color: #ff0000;\">Per\u00edode de cotitzaci\u00f3 de 33 anys (25 per a persones amb discapacitat en grau igual o superior al 33%) en la data del fet causant de la jubilaci\u00f3 parcial<\/span>. Es computar\u00e0 el per\u00edode de prestaci\u00f3 del servei militar obligatori o de la prestaci\u00f3 social substitut\u00f2ria, amb el l\u00edmit m\u00e0xim d&#8217;1 any, i sense que es tingui en compte la part proporcional corresponent per pagues extraordin\u00e0ries.<\/li>\n<\/ul>\n<ul>\n<li class=\"first last\"><span style=\"color: #ff0000;\">Ha de reduir la jornada de treball entre un m\u00ednim d&#8217;un 25% i un m\u00e0xim del 67%, o del 80% per als casos en qu\u00e8 el treballador rellevista sigui contractat a jornada completa mitjan\u00e7ant un contracte indefinit.<\/span> Aquests percentatges s&#8217;entendran referits a la jornada d&#8217;un treballador a temps complet comparable.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Requisits que haur\u00e0 de reunir el treballador rellevista:<\/span> <\/strong><\/p>\n<ul>\n<li><span style=\"color: #ff0000;\">Ha d&#8217;estar en situaci\u00f3 d&#8217;atur o tenir contracte amb l&#8217;empresa de durada determinada.<\/span><\/li>\n<li><span style=\"color: #ff0000;\">Exist\u00e8ncia d&#8217;una correspond\u00e8ncia entre les bases de cotitzaci\u00f3<\/span> del treballador rellevista i del jubilat parcial. La base del treballador rellevista no podr\u00e0 ser inferior al 65% de la mitjana de les bases de cotitzaci\u00f3 corresponents als 6 \u00faltims mesos del per\u00edode de base reguladora de la pensi\u00f3 de jubilaci\u00f3 parcial.<\/li>\n<li><span style=\"color: #ff0000;\">Durada del contracte:<\/span> Indefinida o com a m\u00ednim igual al temps que falti al treballador substitu\u00eft per arribar a l&#8217;edat ordin\u00e0ria de jubilaci\u00f3.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Requisits per les empreses: <\/strong><span style=\"color: #000000;\">E<\/span><\/span>l percentatge de treballadors amb contracte indefinit en el moment del fet causant de la jubilaci\u00f3 parcial ha de superar el 70% del total dels treballadors de la seva plantilla.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral1_20728071.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-800\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral1_20728071.jpg\" alt=\"\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral1_20728071.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral1_20728071-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<p><span style=\"color: #0000ff;\"><em><strong>Som assessors laborals i de la Seguretat Social.
