{"id":12027,"date":"2024-03-19T19:41:40","date_gmt":"2024-03-19T18:41:40","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=12027"},"modified":"2024-03-20T19:03:33","modified_gmt":"2024-03-20T18:03:33","slug":"ha-entrat-en-vigor-la-limitacio-en-el-preu-del-lloguer-dhabitatges","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/ha-entrat-en-vigor-la-limitacio-en-el-preu-del-lloguer-dhabitatges\/","title":{"rendered":"Ha entrat en vigor la limitaci\u00f3 en el preu del lloguer d&#8217;habitatges en les zones declarades de mercat residencial tensionat"},"content":{"rendered":"<h5>Segons ens informa el Col\u00b7legi API de Girona, el BOE del 15 de mar\u00e7 ha publicat la Resoluci\u00f3 de 14 de mar\u00e7 de 2024, de la Secretaria d&#8217;Estat d&#8217;Habitatge i Agenda Urbana, per la qual es determina el <span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000;\" href=\"https:\/\/apigirona.us6.list-manage.com\/track\/click?u=c9fec421edc4397c1b3515da6&amp;id=7b7ca438ce&amp;e=1758055e75\" target=\"_blank\" rel=\"noopener\">sistema d&#8217;\u00edndex de preus de refer\u00e8ncia.<\/a><\/em><\/span><\/h5>\n<p>Destaquem el seg\u00fcent:<\/p>\n<h3>Entrada en vigor<\/h3>\n<p>Va entrar en vigor el passat dia <strong>16 de mar\u00e7.<\/strong><\/p>\n<h3>Zones de mercat residencial tensionat. \u00c0rees tenses<\/h3>\n<p>Tamb\u00e9 ha estat publicada la<em><span style=\"color: #ff0000;\">\u00a0<\/span><\/em><a href=\"https:\/\/apigirona.us6.list-manage.com\/track\/click?u=c9fec421edc4397c1b3515da6&amp;id=7a40fcca6f&amp;e=1758055e75\" target=\"_blank\" rel=\"noopener\"><em><span style=\"color: #ff0000;\">relaci\u00f3 de zones de mercat residencial tensionat<\/span><\/em><\/a> que inclou les seg\u00fcents poblacions de les comarques gironines: \u00a0Banyoles, La Bisbal d&#8217;Empord\u00e0, Blanes, Figueres, Girona, Lloret de Mar, Olot, Palafrugell, Palam\u00f3s, Porqueres, Puigcerd\u00e0, Ripoll, Salt, Sant Feliu de Gu\u00edxols, Santa Coloma de Farners i Sarri\u00e0 de Ter.<\/p>\n<h3>Preus de lloguer de refer\u00e8ncia<\/h3>\n<p>Aquest sistema ofereix un rang de valors de preus de lloguer d&#8217;habitatges en les zones de mercat residencial tensionat. Es pot obtenir un certificat informatiu accedint al seg\u00fcent enlla\u00e7:\u00a0 <span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000;\" href=\"https:\/\/apigirona.us6.list-manage.com\/track\/click?u=c9fec421edc4397c1b3515da6&amp;id=d007867e0a&amp;e=1758055e75\" target=\"_blank\" rel=\"noopener\">https:\/\/serpavi.mivau.gob.es\/<\/a><\/em><\/span><\/p>\n<h3>Preu m\u00e0xim en zones de mercat residencial tensionat<\/h3>\n<p>El preu m\u00e0xim dels nous contractes de lloguer en zones declarades tensionades afectar\u00e0 als seg\u00fcents arrendadors:<\/p>\n<ul>\n<li>Grans tenidors d&#8217;habitatges, tal com els definim en l&#8217;apartat seg\u00fcent.<\/li>\n<li>Titulars d&#8217;habitatges que portin fora del mercat d&#8217;arrendament com a habitatge habitual en els darrers cinc anys, com podrien ser els habitatges tur\u00edstics que tornin a la residencial tradicional.<\/li>\n<\/ul>\n<h3>Consideraci\u00f3 de gran tenidor a\u00a0 Catalunya<\/h3>\n<ul>\n<li>Persona f\u00edsica o jur\u00eddica que sigui titular dins d&#8217;alguna de les \u00e0rees tenses de cinc o m\u00e9s immobles urbans d\u2019\u00fas residencial.<\/li>\n<li>La persona f\u00edsica o jur\u00eddica que sigui titular a tota Espanya de m\u00e9s de deu immobles urbans d\u2019\u00fas residencial o una superf\u00edcie constru\u00efda de m\u00e9s de 1.500 m2 d\u2019\u00fas residencial, excloent en tot cas garatges i trasters.<\/li>\n<\/ul>\n<h3>Pr\u00f2rroga dels contractes signats a partir del 26 de maig de 2023 en zona tensa<strong>. <\/strong><\/h3>\n<p>A les zones de mercat residencial tensionat, quan finalitzin els contractes signats a partir del 26 de maig de 2023 en que va entrar en vigor la Llei estatal d\u2019habitatge, i si perviu en aquell moment l\u2019habitatge dins de l\u2019\u00e0rea tensa, l\u2019arrendatari podr\u00e0 sol\u00b7licitar una pr\u00f2rroga de tres anys. Els contractes vigents, signats amb anterioritat a l\u2019entrada en vigor de la llei estatal d\u2019habitatge, no poden demanar aquesta pr\u00f2rroga.<\/p>\n<h3>Habitatge ubicat en zona NO tensa<\/h3>\n<p><span style=\"font-size: 16px;\">\u00a0Quan l\u2019habitatge NO es troba en una zona declarada tensionada, independentment que l\u2019arrendador sigui un gran tenidor o un petit tenidor, i que l\u2019habitatge hagi estat arrendat o no els darrers cinc anys, la renda del nou contracte de lloguer ser\u00e0 la que fixin lliurement les parts.<\/span><\/p>\n<h3>Habitatge ubicat en zona tensa quan l&#8217;arrendador no sigui gran tenidor<\/h3>\n<p><span style=\"font-size: 16px;\">En els nous contractes, la renda de lloguer no podr\u00e0 excedir la darrera renda de contracte d\u2019arrendament d\u2019habitatge habitual que hagu\u00e9s estat vigent en els \u00faltims cinc anys en el mateix habitatge, una vegada aplicada la cl\u00e0usula d\u2019actualitzaci\u00f3 anual de la renda del contracte anterior, sense que es puguin fixar noves condicions que estableixin la repercussi\u00f3 a l\u2019arrendatari de quotes o despeses que no estiguessin recollides al contracte anterior.\u00a0<\/span><\/p>\n<p>Es permet incrementar un 10% addicional quan es pugui acreditar algun dels seg\u00fcents casos:<\/p>\n<ul>\n<li><span style=\"font-size: 16px;\">Quan l\u2019habitatge hagu\u00e9s estat objecte d\u2019una actuaci\u00f3 de rehabilitaci\u00f3 que hagu\u00e9s finalitzat els dos anys anteriors a la data de la celebraci\u00f3 del nou contracte d\u2019arrendament.<\/span><\/li>\n<li><span style=\"font-size: 16px;\">Quan en els dos anys anteriors a la data de la celebraci\u00f3 del nou contracte d\u2019arrendament s\u2019haguessin finalitzat actuacions de rehabilitaci\u00f3 o millora de l\u2019habitatge on s\u2019hagi acreditat un estalvi d\u2019energia prim\u00e0ria no renovable del 30%.<\/span><\/li>\n<li><span style=\"font-size: 16px;\"> Quan en els dos anys anteriors a la data de la celebraci\u00f3 del nou contracte d\u2019arrendament haguessin finalitzat actuacions de millora de l\u2019accessibilitat. <\/span><\/li>\n<li><span style=\"font-size: 16px;\">Quan el contracte d\u2019arrendament se signi per un per\u00edode de deu anys o m\u00e9s, o b\u00e9 estableixi un dret de pr\u00f2rroga al qual es pugui acollir volunt\u00e0riament l\u2019arrendatari que li permeti de manera potestativa prorrogar el contracte en els mateixos termes i condicions durant un per\u00edode de deu anys o m\u00e9s.<\/span><\/li>\n<\/ul>\n<h3>Habitatge ubicat en zona tensa, que ha estat arrendat com habitatge en els darrers 5 anys i l&#8217;arrendador es un gran tenidor<\/h3>\n<p><span style=\"font-size: 16px;\">Cal calcular dues rendes i s&#8217;aplica la de menor import:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 16px;\">La primera d\u2019acord amb el que s\u2019ha exposat en l\u2019apartat anterior<\/span><\/li>\n<li><span style=\"font-size: 16px;\">La segona que no excedeix-hi el l\u00edmit m\u00e0xim del preu aplicable d\u2019acord amb el nou sistema d\u2019\u00edndexs de preus estatal. https:\/\/serpavi.mivau.gob.es\/ <\/span><\/li>\n<\/ul>\n<h3>Reduccions fiscals a l&#8217;IRPF<\/h3>\n<p>Amb efectes per als contractes d\u2019arrendament d\u2019habitatge celebrats a partir de l\u2019entrada en vigor de la Llei, s\u2019introdueixen les seg\u00fcents reduccions del rendiment net positiu aplicables a l\u2019impost sobre la renda de les persones f\u00edsiques als arrendaments d\u2019immobles destinats a habitatge.<\/p>\n<ul>\n<li><strong>En zona declarada tensa<\/strong>:\n<ul>\n<li>Un 90 % de la reducci\u00f3 del rendiment net positiu si el nou contracte minora la renda de lloguer m\u00e9s d\u2019un 5 % respecte de la darrera renda del contracte anterior + el valor de la cl\u00e0usula d\u2019actualitzaci\u00f3. (no distingeix si la persona f\u00edsica \u00e9s o no gran tenidor o petit tenidor, \u00e9s una reducci\u00f3 de car\u00e0cter general per a tots els titulars)<\/li>\n<li>Un 70 % de la reducci\u00f3 del rendiment net positiu si l\u2019habitatge \u00e9s el primer arrendament en zona tensa i l\u2019arrendatari t\u00e9 una edat compresa entre 18 i 35 anys, o quan l\u2019arrendatari sigui una administraci\u00f3 p\u00fablica o entitat sense \u00e0nim de lucre, amb determinades condicions.<\/li>\n<\/ul>\n<\/li>\n<li><strong>En zones declarades tenses o no:\u00a0\u00a0<\/strong>\n<ul>\n<li>60 % quan l\u2019habitatge hagu\u00e9s estat objecte d\u2019una actuaci\u00f3 de rehabilitaci\u00f3 en els dos anys anteriors a la celebraci\u00f3 contracte arrendament.<\/li>\n<li>Un 50 % a la resta dels casos.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-medium wp-image-7745\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/Limitacio-preu-arrendament-300x291.jpg\" alt=\"\" width=\"300\" height=\"291\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/Limitacio-preu-arrendament-300x291.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/Limitacio-preu-arrendament-768x744.jpg 768w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/Limitacio-preu-arrendament.jpg 800w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<h3><span style=\"color: #3366ff;\"><em>Som agents immobiliaris, API i Administradors de Finques.
