{"id":12281,"date":"2024-05-03T12:50:41","date_gmt":"2024-05-03T10:50:41","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=12281"},"modified":"2024-05-06T10:27:15","modified_gmt":"2024-05-06T08:27:15","slug":"obligatorietat-dels-reconeixements-medics-laborals","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/obligatorietat-dels-reconeixements-medics-laborals\/","title":{"rendered":"Obligatorietat dels reconeixements m\u00e8dics laborals"},"content":{"rendered":"<h5>Els treballadors poden estar obligats a sotmetre&#8217;s a revisions m\u00e8diques en l&#8217;\u00e0mbit laboral, encara que existeixen excepcions i matisos.<\/h5>\n<hr \/>\n<h3><strong>Dret a la salut i seguretat en el treball<\/strong><\/h3>\n<p>L&#8217;article 22 de l&#8217;Estatut dels treballadors especifica que l&#8217;empresari ha de garantir la vigil\u00e0ncia peri\u00f2dica de l&#8217;estat de salut dels treballadors, sempre subjecte al seu consentiment, excepte en uns certs casos espec\u00edfics que es detallen a continuaci\u00f3.<\/p>\n<h3><strong>Quan \u00e9s obligatori el reconeixement m\u00e8dic?<\/strong><\/h3>\n<ul>\n<li><strong>Avaluaci\u00f3 de condicions de treball:<\/strong> \u00e9s obligatori quan cal avaluar els efectes de les condicions laborals en la salut dels treballadors. Aix\u00f2 \u00e9s aplicable en ambients de treball amb riscos elevats, com a exposici\u00f3 a subst\u00e0ncies t\u00f2xiques o nivells de soroll alts.<\/li>\n<li><strong>Verificaci\u00f3 de l&#8217;estat de salut del treballador:<\/strong> quan la condici\u00f3 f\u00edsica o psicol\u00f2gica del treballador pugui representar un risc per a si mateix, per a altres treballadors, o per a tercers, \u00e9s imprescindible fer reconeixements m\u00e8dics.<\/li>\n<li><strong>Disposicions legals espec\u00edfiques:<\/strong> alguns sectors regulats espec\u00edficament per la llei requereixen ex\u00e0mens m\u00e8dics obligatoris, com aquells que involucren treball amb radiacions ionitzants o subst\u00e0ncies perilloses.<\/li>\n<li><strong>Condicions estipulades per conveni:<\/strong> depenent del conveni col\u00b7lectiu aplicable, pot haver-hi estipulacions que exigeixin reconeixements m\u00e8dics regulars en uns certs tipus de treballs o ind\u00fastries.<\/li>\n<\/ul>\n<h3><strong>Negativa del treballador<\/strong><\/h3>\n<ul>\n<li><strong>Consentiment:<\/strong> Cal el previ consentiment del treballador) per fer el reconeixement m\u00e8dic en virtut al dret a la intimitat (Article 18.1 de la Constituci\u00f3 espanyola), en determinades situacions existeix l&#8217;obligaci\u00f3 de fer-lo.<\/li>\n<li><strong>Negativa del treballador en els casos en que el reconeixement m\u00e8dic es obligatori<\/strong>: \u00c9s fonamental que com a ocupador documenti correctament l&#8217;oferiment d&#8217;aquests reconeixements i, en cas de negativa per part del treballador, asseguri l&#8217;obtenci\u00f3 d&#8217;un document signat que acrediti aquesta ren\u00fancia.<\/li>\n<\/ul>\n<h3><strong>Periodicitat i execuci\u00f3<\/strong><\/h3>\n<p>Els reconeixements han de ser programats de manera peri\u00f2dica, normalment de forma anual, encara que la llei no especifica una freq\u00fc\u00e8ncia obligat\u00f2ria.<\/p>\n<h3><strong>Protecci\u00f3 de dades i confidencialitat<\/strong><\/h3>\n<p>Nom\u00e9s el personal m\u00e8dic i les autoritats sanit\u00e0ries tenen acc\u00e9s a la informaci\u00f3 detallada de l&#8217;estat de salut del treballador.
