Aquests drets, tamb\u00e9 coneguts com a condicions m\u00e9s beneficioses, asseguren que les condicions laborals una vegada concedides no puguin ser modificades unilateralment en perjudici del treballador.<\/h5>\n<hr \/>\n<h3><strong>Qu\u00e8 s\u00f3n els drets adquirits?<\/strong><\/h3>\n<p>Son beneficis o condicions que els treballadors han obtingut durant la relaci\u00f3 laboral, ja sigui per concessi\u00f3 expl\u00edcita de l&#8217;empresari o per la pr\u00e0ctica continuada i consistent. Exemples d&#8217;aquests poden incloure un salari superior al conveni, m\u00e9s dies de vacances, jornades redu\u00efdes, entre altres.<\/p>\n<h3><strong>Consolidaci\u00f3 dels drets adquirits<\/strong><\/h3>\n<p>Perqu\u00e8 un benefici es consideri un dret adquirit consolidat, \u00e9s essencial considerar la repetici\u00f3 temporal del benefici, la voluntat clara de l&#8217;empresari de concedir-lo, i que suposi una millora sobre les condicions est\u00e0ndard establertes per contracte o conveni.<\/p>\n<h3><strong>Reconeixement legal dels drets adquirits<\/strong><\/h3>\n<p>L&#8217;Estatut dels Treballadors (ET), en l&#8217;article 3.1, garanteix que les condicions de treball no poden ser alterades en detriment del ja concedit sense un acord clar o situacions excepcionals justificades.<\/p>\n<p>Una de les claus per ser considerat com a dret adquirit \u00e9s que es porti cert temps gaudint de manera continuada d&#8217;un dret determinat.<\/p>\n<p>No obstant aix\u00f2, com ha establert la jurisprud\u00e8ncia en la sent\u00e8ncia del Tribunal Suprem de 7 de juliol de 2010 o de 22 de setembre de 2011, la mera persist\u00e8ncia o repetici\u00f3 en el temps no \u00e9s causa suficient, sin\u00f3 que \u00e9s necessari que aquesta actuaci\u00f3 persistent en el temps determini la voluntat de l&#8217;empresari de concedir el dret de manera indefinida.<\/p>\n<p>Un exemple molt t\u00edpic d&#8217;una condici\u00f3 m\u00e9s beneficiosa \u00e9s el lliurament per part de l&#8217;empresa d&#8217;una cistella de Nada, tal com ha reiterat la jurisprud\u00e8ncia en diverses ocasions.<\/p>\n<h3><strong>Qu\u00e8 pot fer el treballador davant la p\u00e8rdua d&#8217;un dret adquirit?<\/strong><\/h3>\n<ul>\n<li>Impugnar la modificaci\u00f3 en seu judicial en el termini de vint dies des de la seva notificaci\u00f3, mitjan\u00e7ant la corresponent demanda.<\/li>\n<li>O b\u00e9 sol\u00b7licitar l&#8217;extinci\u00f3 del contracte, sempre que els drets adquirits afectats siguin els recollits en l&#8217;art. 41.1 de l&#8217;ET.<\/li>\n<\/ul>\n<h3><strong>Llista de control que recomanem per a que l&#8217;empresa gestioni els drets adquirits<\/strong><\/h3>\n<ul>\n<li><input type=\"checkbox\" \/>\u00a0Verificar l&#8217;exist\u00e8ncia de beneficis reiterats i el seu reconeixement com a drets adquirits.<\/li>\n<li><input type=\"checkbox\" \/>\u00a0Avaluar la legalitat de les condicions laborals actuals enfront dels est\u00e0ndards del contracte i el conveni.<\/li>\n<li><input type=\"checkbox\" \/>\u00a0Consultar amb representants legals abans de procedir a la modificaci\u00f3 de qualsevol dret adquirit.<\/li>\n<li><input type=\"checkbox\" \/>\u00a0Notificar adequadament a totes les parts involucrades sobre canvis proposats o necessaris segons la situaci\u00f3 econ\u00f2mica i legal de l&#8217;empresa.<\/li>\n<li><input type=\"checkbox\" \/>\u00a0Assegurar-se que totes les modificacions es facin de conformitat amb els requisits legals i amb el respecte degut als drets dels treballadors.<\/li>\n<\/ul>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-medium wp-image-3030\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Poltica-Qualitat-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Poltica-Qualitat-300x200.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Poltica-Qualitat-1024x683.jpg 1024w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Poltica-Qualitat-768x512.jpg 768w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Poltica-Qualitat-1536x1024.jpg 1536w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Poltica-Qualitat-600x400.jpg 600w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Poltica-Qualitat.jpg 1920w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<h3><em><span style=\"color: #3366ff;\">Som assessors laborals i de la Seguretat Social.
