{"id":13263,"date":"2025-01-07T18:51:29","date_gmt":"2025-01-07T17:51:29","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=13263"},"modified":"2025-01-09T12:57:35","modified_gmt":"2025-01-09T11:57:35","slug":"aprovades-novetats-laborals-per-a-2025","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/aprovades-novetats-laborals-per-a-2025\/","title":{"rendered":"Aprovades novetats laborals per a 2025"},"content":{"rendered":"<h5>A la fi de l&#8217;any 2024, s&#8217;han aprovat diverses novetats laborals amb gran transcend\u00e8ncia pr\u00e0ctica per a l&#8217;any 2025, com \u00e9s la modificaci\u00f3 del r\u00e8gim de la jubilaci\u00f3 parcial i els contractes de relleu, l&#8217;ampliaci\u00f3 de la jubilaci\u00f3 parcial de la ind\u00fastria manufacturera fins al 31 de desembre de 2029, la pr\u00f2rroga del Salari M\u00ednim Interprofessional (SMI) o l&#8217;actualitzaci\u00f3 de les bases de cotitzaci\u00f3.<\/h5>\n<hr \/>\n<p>L&#8217;inici de l&#8217;any 2025 comporta una s\u00e8rie de reformes en l&#8217;\u00e0mbit laboral i de Seguretat Social que tenen impacte tant a les empreses com als treballadors. A continuaci\u00f3, presentem un resum de les principals novetats introdu\u00efdes per les \u00faltimes normatives publicades.<\/p>\n<h3><strong>1. Compatibilitat de la pensi\u00f3 de jubilaci\u00f3 amb el treball<\/strong><\/h3>\n<p>El <span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000;\" href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2024-26917\">Reial decret llei 11\/2024<\/a><\/em><\/span> introdueix modificacions en la Llei General de la Seguretat Social (LGSS) per a incentivar la prolongaci\u00f3 de la vida laboral. Aquestes mesures, que <strong>entren en vigor l&#8217;1 d&#8217;abril de 2025<\/strong>, estableixen noves regles per a la compatibilitat entre treball i pensi\u00f3.<\/p>\n<ul>\n<li><strong>Compatibilitat de la pensi\u00f3 activa: <\/strong>Elimina el requisit d&#8217;acreditar prou cotitzacions per a aconseguir el 100% de la base reguladora.<\/li>\n<li><strong>Quantia de la pensi\u00f3 activa. <\/strong>La pensi\u00f3 activa\u00a0variar\u00e0 entre el 45% i el 100%, segons els anys de demora des de l&#8217;edat ordin\u00e0ria de jubilaci\u00f3.<\/li>\n<li><strong style=\"font-size: 1.3em;\">Increments per demora: <\/strong><span style=\"font-size: 16px;\">S&#8217;afegeix un percentatge addicional del 2% per als qui demorin la seva jubilaci\u00f3 dos anys complets o m\u00e9s.<\/span><\/li>\n<li><strong style=\"font-size: 16px;\">Jubilaci\u00f3 parcial: <\/strong>\n<ul>\n<li>S&#8217;amplia la reducci\u00f3 de jornada fins a un 75%.<\/li>\n<li>Els contractes de relleu hauran de ser indefinits i a temps complet, mantenint-se per almenys dos anys.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><strong>2. Revaloraci\u00f3 de pensions\u00a0<\/strong><\/h3>\n<p>El <span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000;\" href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2024-26915\">Reial decret llei 9\/2024<\/a><\/em><\/span> estableix diverses mesures rellevants:<\/p>\n<ul>\n<li><strong>Increment general<\/strong>: les pensions contributives del sistema de la Seguretat Social i les ordin\u00e0ries i extraordin\u00e0ries de classes passives es revaloraran un<strong> 2,8%<\/strong> respecte a l&#8217;import vigent al 31 de desembre de 2024.<\/li>\n<\/ul>\n<ul>\n<li><strong>Quanties espec\u00edfiques<\/strong>:\n<ul>\n<li><span style=\"font-size: 16px;\"><strong>Pensions no contributives<\/strong>: tindran un import anual de <strong>7.905,80 euros<\/strong>.<\/span><\/li>\n<li><span style=\"font-size: 16px;\"><strong>Subsidi de mobilitat<\/strong>: augmentar\u00e0 a 1.002 euros anuals.<\/span><\/li>\n<li><strong>Complement de bretxa de g\u00e8nere<\/strong>: ser\u00e0 de 35,90 euros mensuals.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><strong>3. <\/strong><strong>Bases de cotitzaci\u00f3 a la Seguretat Social.\u00a0<\/strong><\/h3>\n<ul>\n<li><strong>Base m\u00ednima<\/strong>: s&#8217;ajustar\u00e0 autom\u00e0ticament a l&#8217;increment del salari m\u00ednim interprofessional (SMI) m\u00e9s un sis\u00e8.<\/li>\n<\/ul>\n<ul>\n<li><strong>Base m\u00e0xima:<\/strong> s&#8217;incrementar\u00e0 aplicant un percentatge equivalent a l&#8217;increment de les pensions m\u00e9s un 1,2%, la qual cosa la situa en una pujada del 4% en total.<\/li>\n<\/ul>\n<ul>\n<li><strong>Quota del mecanisme d&#8217;equitat intergeneracional<\/strong>: pujar\u00e0 al 0,80% del salari, distribu\u00efts entre l&#8217;ocupador (0,67%) i l&#8217;empleat (0,13%).<\/li>\n<\/ul>\n<h3><strong>4. Cotitzaci\u00f3 d&#8217;aut\u00f2noms per a 2025<\/strong><\/h3>\n<ul>\n<li><span style=\"font-size: 16px;\">La<\/span><strong style=\"font-size: 16px;\"> base m\u00ednima<\/strong><span style=\"font-size: 16px;\"> s&#8217;ajustar\u00e0 autom\u00e0ticament a l&#8217;increment del salari m\u00ednim interprofessional (SMI) de 2025, m\u00e9s un sis\u00e8 addicional.<\/span><\/li>\n<li><span style=\"font-size: 16px;\">La <\/span><strong style=\"font-size: 16px;\">base m\u00e0xima<\/strong><span style=\"font-size: 16px;\"> augmentar\u00e0 un 4%, reflectint l&#8217;increment general de les pensions contributives (2,8%) i un ajust addicional (1,2%).<\/span><\/li>\n<li><span style=\"font-size: 16px;\"><strong>Els aut\u00f2noms amb ingressos que superin la base m\u00e0xima de cotitzaci\u00f3<\/strong> estaran subjectes a una quota addicional aplicada nom\u00e9s sobre la fracci\u00f3 d&#8217;ingressos que excedeixi aquest topall.<\/span><\/li>\n<li><strong style=\"font-size: 16px;\">Reintegrament per pluriactivitat<\/strong><span style=\"font-size: 16px;\">:<\/span>\n<ul>\n<li><strong style=\"font-size: 16px;\">Els aut\u00f2noms amb ocupaci\u00f3 per compte d&#8217;altri<\/strong><span style=\"font-size: 16px;\"> tindran dret al reintegrament del 50% de l&#8217;exc\u00e9s de cotitzaci\u00f3 per conting\u00e8ncies comunes si aquestes superen els 16.672,66 \u20ac anuals, amb un topall m\u00e0xim del 50% de les quotes ingressades.<\/span><\/li>\n<li><strong style=\"font-size: 16px;\">Els socis de cooperatives<\/strong><span style=\"font-size: 16px;\"> inclosos en el RETA podran triar bases mensuals igual o superiors al m\u00ednim del tram 1, sense regularitzaci\u00f3 posterior.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><strong style=\"font-size: 16px;\">Cotitzaci\u00f3 esperada per a 2025:<\/strong><span style=\"font-size: 16px;\"> el c\u00e0lcul de les quotes estar\u00e0 vinculat als trams d&#8217;ingressos reals declarats, amb ajustos previstos segons la reforma del sistema de cotitzaci\u00f3. Les xifres exactes de cada tram seran confirmades despr\u00e9s de l&#8217;ajust final de l&#8217;SMI i els acords en el di\u00e0leg social.<\/span><\/li>\n<\/ul>\n<h3><strong>5. Condicions per a ajudes i ERTO<\/strong><\/h3>\n<ul>\n<li><strong>Comprom\u00eds d&#8217;ocupaci\u00f3<\/strong>: les empreses benefici\u00e0ries d&#8217;ajudes p\u00fabliques o exempcions en cotitzaci\u00f3 hauran de mantenir els treballadors afectats durant un m\u00ednim de sis mesos i fins dos anys despr\u00e9s de l&#8217;ERTO.<\/li>\n<\/ul>\n<ul>\n<li><strong>Prohibici\u00f3 d&#8217;acomiadaments per augment de costos<\/strong>: les empreses que justifiquin acomiadaments per increments energ\u00e8tics hauran de retornar les ajudes rebudes si no compleixen amb els requisits establerts.<\/li>\n<\/ul>\n<h3><strong>6. Quota addicional de solidaritat<\/strong><\/h3>\n<p>Des de l&#8217;1 de gener de 2025, s&#8217;implementa una quota addicional de solidaritat per a aquells salaris que excedeixin la base m\u00e0xima de cotitzaci\u00f3 establerta. Aquesta mesura t\u00e9 com a objectiu incrementar els recursos del sistema de Seguretat Social, garantint la seva sostenibilitat.<\/p>\n<ul>\n<li><strong>Funcionament:<\/strong> la quota s&#8217;aplica exclusivament a la fracci\u00f3 del salari que supera el topall m\u00e0xim de cotitzaci\u00f3, sense alterar la base habitual.<\/li>\n<li><strong>Distribuci\u00f3:<\/strong> la quota ser\u00e0 compartida entre l&#8217;ocupador i el treballador en proporcions que s&#8217;establiran reglament\u00e0riament, seguint criteris d&#8217;equitat.<\/li>\n<li><strong>Impacte:<\/strong> afectar\u00e0 principalment empleats amb salaris m\u00e9s alts, mentre que la resta dels treballadors no es veur\u00e0 impactat.<\/li>\n<\/ul>\n<h3><strong>7. Pr\u00f2rroga del salari m\u00ednim interprofessional (SMI)<\/strong><\/h3>\n<p>El <span style=\"color: #ff0000;\"><a style=\"color: #ff0000;\" href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2024-26915\"><em>Reial decret llei<\/em> <strong>9\/2024<\/strong> e<\/a><\/span>stableix la <strong>pr\u00f2rroga de l&#8217;SMI de 2024<\/strong> fins que s&#8217;aprovi un nou decret per a l&#8217;any 2025.<\/p>\n<ul>\n<li><strong>Quantitat actual de l&#8217;SMI (2024)<\/strong>:\n<ul>\n<li><strong>Mensual:<\/strong> 1.134\u00a0euros en 14 pagues (15.876\u00a0euros bruts anuals).<\/li>\n<li><strong>Diari:<\/strong> 37,80\u00a0euros.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Encara que l&#8217;SMI per a 2025 no ha estat aprovat, s&#8217;espera que el seu increment sigui <strong>alineat amb la inflaci\u00f3 i les recomanacions del di\u00e0leg social<\/strong>, garantint que el poder adquisitiu dels treballadors no es deteriori. Mentrestant, l&#8217;SMI vigent en 2024 continua aplicant-se de manera autom\u00e0tica.<\/p>\n<h3><strong>8. Mesures per a empreses en ERTO i benefici\u00e0ries d&#8217;ajudes p\u00fabliques<\/strong><\/h3>\n<p>El <strong>Reial decret llei 9\/2024<\/strong> estableix una s\u00e8rie d&#8217;obligacions i restriccions per a les empreses que accedeixin a <strong>ERTO<\/strong> o rebin <strong>ajudes p\u00fabliques<\/strong>. Aquestes mesures busquen garantir l&#8217;estabilitat laboral i protegir l&#8217;ocupaci\u00f3 davant situacions de crisis.<\/p>\n<ul>\n<li><strong>Comprom\u00eds de manteniment de l&#8217;ocupaci\u00f3<\/strong>\n<ul>\n<li>Les empreses hauran de mantenir l&#8217;ocupaci\u00f3 dels treballadors afectats per l&#8217;ERTO durant un per\u00edode que oscil\u00b7la entre sis mesos i dos anys.<\/li>\n<li>Si l&#8217;empresa no compleix aquest comprom\u00eds, haur\u00e0 de retornar les ajudes o exempcions obtingudes, juntament amb els interessos de demora i rec\u00e0rrecs corresponents.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Limitacions a l&#8217;acomiadament<\/strong>\n<ul>\n<li>Les empreses benefici\u00e0ries d&#8217;ajudes no podran justificar acomiadaments objectius basats en l&#8217;<strong>increment de costos energ\u00e8tics<\/strong> fins al <strong>31 de desembre de 2025<\/strong>.<\/li>\n<li>Si aquesta limitaci\u00f3 \u00e9s incomplerta, l&#8217;empresa estar\u00e0 obligada a reintegrar les ajudes p\u00fabliques rebudes.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Condicions addicionals en els ERTO:<\/strong>\n<ul>\n<li>Les <strong>exoneracions en cotitzacions<\/strong> aplicables als treballadors en ERTO estaran subjectes al compliment del comprom\u00eds d&#8217;ocupaci\u00f3.<\/li>\n<li>Les empreses hauran de justificar la necessitat de l&#8217;ERTO per causes econ\u00f2miques, t\u00e8cniques, organitzatives, de producci\u00f3 o de for\u00e7a major, seguint els requisits legals.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Excepcions a l&#8217;incompliment del comprom\u00eds d&#8217;ocupaci\u00f3.\u00a0<\/strong>El comprom\u00eds de manteniment de l&#8217;ocupaci\u00f3 no es considerar\u00e0 incomplert en els seg\u00fcents casos:\n<ol>\n<li>Acomiadaments disciplinaris declarats procedents.<\/li>\n<li>Dimissi\u00f3, jubilaci\u00f3, defunci\u00f3 o incapacitat permanent del treballador.<\/li>\n<li>Finalitzaci\u00f3 de contractes temporals per compliment de la seva causa<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<h3><strong>9. Empreses benefici\u00e0ries d&#8217;ajudes relacionades amb Ucra\u00efna<\/strong><\/h3>\n<p>Les empreses que accedeixin a ajudes vinculades amb els efectes de la invasi\u00f3 d&#8217;Ucra\u00efna:<\/p>\n<ul>\n<li>No podran realitzar acomiadaments objectius basats en aquesta causa.<\/li>\n<li>Hauran de justificar qualsevol reducci\u00f3 de jornada o suspensi\u00f3 de contractes per causes econ\u00f2miques o productives relacionades amb la crisi.<\/li>\n<\/ul>\n<h3><strong>10. Modificacions per a treballadors fixos discontinus i a temps parcial<\/strong><\/h3>\n<p><strong>A partir de l&#8217;1 d&#8217;abril de 2025 e<\/strong><span style=\"font-size: 16px;\">s reintrodueix el coeficient d&#8217;1,5 per al c\u00e0lcul dels per\u00edodes de cotitzaci\u00f3 de treballadors fixos-discontinus i s<\/span><span style=\"font-size: 16px;\">&#8216;ajusta el c\u00e0lcul del complement de pensi\u00f3 de jubilaci\u00f3 per a treballadors a temps parcial.<\/span><\/p>\n<h3><strong>11. <\/strong><strong>Pensionistes amb incapacitat permanent (IP) absoluta o gran invalidesa<\/strong><\/h3>\n<p>La disposici\u00f3 final tretzena de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2024-26694\"><em><span style=\"color: #ff0000;\">Llei 7\/2024<\/span><\/em><\/a> introdueix una nova redacci\u00f3 per a l&#8217;apartat 2 de l&#8217;article 198 de la Llei General de la Seguretat Social (Reial decret legislatiu 8\/2015), que regula les pensions per incapacitat permanent absoluta i gran invalidesa. Els canvis m\u00e9s rellevants s\u00f3n:<\/p>\n<ul>\n<li><strong>Compatibilitat amb activitats laborals<\/strong>: Les pensions per incapacitat permanent absoluta o gran invalidesa no impediran l&#8217;exercici d&#8217;activitats compatibles amb l&#8217;estat del pensionista, sempre que no representin un canvi en la seva capacitat de treball que motivi una revisi\u00f3.<\/li>\n<li><strong>Suspensi\u00f3 de la pensi\u00f3 per alta laboral:<\/strong> Si el pensionista fa una feina o activitat que generi alta en un r\u00e8gim de la Seguretat Social, l&#8217;entitat gestora:\n<ul>\n<li>Suspendr\u00e0 el pagament de la pensi\u00f3 mentre duri l&#8217;activitat laboral.<\/li>\n<li>Reprendr\u00e0 el pagament una vegada que cessi aquesta activitat, sempre que es mantingui el grau d&#8217;incapacitat.<\/li>\n<\/ul>\n<\/li>\n<li><strong>\u00a0Complement per gran invalidesa<\/strong>: El complement destinat a remunerar a la persona que assisteixi al pensionista no se suspendr\u00e0, fins i tot si l&#8217;activitat laboral realitzada \u00e9s incompatible amb la percepci\u00f3 de la pensi\u00f3 principal.<\/li>\n<li><strong>Revisi\u00f3 del grau d&#8217;incapacitat<\/strong>: L&#8217;entitat gestora podr\u00e0 revisar el grau d&#8217;incapacitat permanent si l&#8217;activitat laboral suggereix una millora en la capacitat del beneficiari.<\/li>\n<\/ul>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-medium wp-image-11204\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/01\/Novetats-Laborals-2024-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/01\/Novetats-Laborals-2024-300x200.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/01\/Novetats-Laborals-2024.jpg 750w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<h3><span style=\"color: #3366ff;\"><em>Som assessors laborals i de la Seguretat Social.
