{"id":13342,"date":"2025-01-31T11:31:27","date_gmt":"2025-01-31T10:31:27","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/?p=13342"},"modified":"2025-01-31T11:31:27","modified_gmt":"2025-01-31T10:31:27","slug":"mesures-urgents-en-materia-de-contencio-de-rendes-darrendament-dhabitatges","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/mesures-urgents-en-materia-de-contencio-de-rendes-darrendament-dhabitatges\/","title":{"rendered":"Mesures urgents en mat\u00e8ria de contenci\u00f3 de rendes d&#8217;arrendament d&#8217;habitatges"},"content":{"rendered":"<h5>Segons ens informa al Col\u00b7legi API de Girona, El DOGC del 29 de gener publica el <a class=\"safe---anchor---wc\" href=\"https:\/\/apigirona.us6.list-manage.com\/track\/click?u=c9fec421edc4397c1b3515da6&amp;id=0de01c1438&amp;e=1758055e75\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Decret llei 1\/2025, de 28 de gener<\/a>, de mesures urgents en mat\u00e8ria de contenci\u00f3 de rendes.<\/h5>\n<hr \/>\n<p>Destaquem les seg\u00fcents novetats en mat\u00e8ria de contenci\u00f3 de rendes:<\/p>\n<h3><b>Qualsevol oferta d&#8217;arrendament d&#8217;immobles ha d&#8217;incloure, com a m\u00ednim, els seg\u00fcents par\u00e0metres<\/b>:<\/h3>\n<ul>\n<li>El preu de l\u2019\u00faltima renda del contracte d\u2019arrendament que hagi estat vigent en els darrers cinc anys en el mateix habitatge o, si escau, el preu del lloguer que resulta d\u2019aplicar el sistema de refer\u00e8ncia dels preus del lloguer d\u2019habitatges, justificat mitjan\u00e7ant el document acreditatiu obtingut a aquest efecte mitjan\u00e7ant el sistema de consulta p\u00fablica establert per l\u2019administraci\u00f3 competent.<\/li>\n<li>La condici\u00f3 de gran tenidor de la propietat de l\u2019habitatge, sempre que l\u2019habitatge estigui ubicat en una zona de mercat residencial tensat, dins del per\u00edode de vig\u00e8ncia de la declaraci\u00f3 de la zona esmentada.<\/li>\n<li>Les dades previstes per la legislaci\u00f3 civil.<\/li>\n<\/ul>\n<h3><strong>Al contracte d\u2019arrendament dels habitatges<\/strong>\u00a0que estiguin ubicats en una zona de mercat residencial tensat en vigor, s\u2019hi ha de fer constar:<\/h3>\n<ul>\n<li>El preu de l\u2019\u00faltima renda del contracte d\u2019arrendament que hagi estat vigent en els darrers cinc anys en el mateix habitatge o, escau, el preu de lloguer que resulta d\u2019aplicaci\u00f3 el sistema de refer\u00e8ncia dels preus del lloguer d\u2019habitatges.<\/li>\n<li>La condici\u00f3 de gran tenidor de la propietat de l\u2019habitatge.<\/li>\n<li>La finalitat del contracte. Si no es fa constar que el contracte d\u2019arrendament t\u00e9 una finalitat de car\u00e0cter temporal, es presumeix que \u00e9s per satisfer la necessitat primordial d\u2019habitatge de car\u00e0cter permanent.<\/li>\n<\/ul>\n<p>En la formalitzaci\u00f3 del contracte, els arrendataris tenen dret a rebre el document acreditatiu del preu de lloguer en aplicaci\u00f3 del sistema de refer\u00e8ncia dels preus del lloguer d\u2019habitatges, aix\u00ed com la c\u00e8dula d\u2019habitabilitat o l\u2019acreditaci\u00f3 equivalent i, si escau, el certificat d\u2019efici\u00e8ncia energ\u00e8tica. Tamb\u00e9 hi ha de constar l\u2019acreditaci\u00f3 de la finalitat del contracte.<\/p>\n<h3><strong>Sistema d\u2019infraccions i sancions<\/strong>:<\/h3>\n<p><strong><u>S\u00f3n considerades infraccions greus:<\/u><\/strong><\/p>\n<ul>\n<li>Establir en el contracte d\u2019arrendament d\u2019un habitatge subjecte al r\u00e8gim de contenci\u00f3 de preus del lloguer una renda que ultrapassi el l\u00edmit perm\u00e8s, per\u00f2 que estigui per sota del 30% l\u2019import m\u00e0xim perm\u00e8s.<\/li>\n<li>No fer constar la renda que resulta d\u2019aplicar del sistema de refer\u00e8ncia dels preus de l\u2019arrendament d\u2019habitatges o, si escau, l\u2019import de la renda del contracte d\u2019arrendament anterior, aix\u00ed com la condici\u00f3 de gran tenidor de la propietat de l\u2019habitatge en els contractes d\u2019arrendament d\u2019habitatges.<\/li>\n<li>S\u00f3n considerades infraccions greus en mat\u00e8ria de protecci\u00f3 dels consumidors i usuaris d\u2019habitatges en el mercat immobiliari quan \u201cno fer constar, en la publicitat o en les ofertes d\u2019habitatges per llogar, la renda que resulta d\u2019aplicar el sistema de refer\u00e8ncia dels preus de l\u2019arrendament d\u2019habitatges, o si escau, l\u2019import de la renda del contracte d\u2019arrendament anterior, aix\u00ed com la condici\u00f3 de gran tenidor de la propietat de l\u2019habitatge\u201d.<\/li>\n<\/ul>\n<p><strong><u>S\u00f3n considerades infraccions molt greus:<\/u><\/strong><\/p>\n<ul>\n<li>Establir en el contracte d\u2019arrendament d\u2019un habitatge subjecte al r\u00e8gim de contenci\u00f3 de preus del lloguer una renda que ultrapassi en un 30% l\u2019import m\u00e0xim perm\u00e8s.<\/li>\n<li>No fer constar la finalitat del contracte d\u2019arrendament, o fer-ho amb finalitat simulada, falsa o fraudulenta.<\/li>\n<li>Repercutir en l\u2019arrendatari les despeses de gesti\u00f3 immobili\u00e0ria i\/o les despeses de formalitzaci\u00f3 del contracte d\u2019arrendament de l\u2019habitatge quan no siguin procedents de conformitat amb la normativa aplicable.<\/li>\n<\/ul>\n<p><strong>Quantia de les sancions<\/strong><\/p>\n<p>Aquest nou marc legal castigar\u00e0 amb sancions d&#8217;entre 90.000 i 900.000 euros els propietaris, professionals i plataformes immobili\u00e0ries que cometin infraccions considerades greus o molt greus amb relaci\u00f3 a aquesta normativa.<\/p>\n<h3><strong>Entrada en vigor<\/strong><\/h3>\n<p>El 30 de gener de 2025.<\/p>\n<p>La norma estableix un termini de 5 dies a partir de l\u2019entrada en vigor, per adaptar el contingut dels anuncis i ofertes d\u2019arrendament d\u2019habitatge publicats abans d\u2019aquest Decret llei.<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-medium wp-image-11670\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/02\/Hero-RM-Assegurances-300x141.jpg\" alt=\"\" width=\"300\" height=\"141\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/02\/Hero-RM-Assegurances-300x141.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/02\/Hero-RM-Assegurances-1024x480.jpg 1024w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/02\/Hero-RM-Assegurances-768x360.jpg 768w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/02\/Hero-RM-Assegurances-1536x720.jpg 1536w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2024\/02\/Hero-RM-Assegurances.jpg 1920w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<h3><span style=\"color: #3366ff;\"><em>Som Agents immobiliaris, API i Administradors de Finques.
