El preu del lloguer haur\u00e0 de constar a la publicitat<\/h5>\n<p><span data-olk-copy-source=\"MessageBody\">Segons ens informa el Col\u00b7legi API de Girona, arran de la publicaci\u00f3 en el <a title=\"https:\/\/apigirona.us6.list-manage.com\/track\/click?u=c9fec421edc4397c1b3515da6&amp;id=64623a3e2d&amp;e=1758055e75\" href=\"https:\/\/apigirona.us6.list-manage.com\/track\/click?u=c9fec421edc4397c1b3515da6&amp;id=64623a3e2d&amp;e=1758055e75\" data-auth=\"NotApplicable\" data-linkindex=\"6\">DOGC del <strong><em>Decret llei 3\/2026 <\/em><\/strong><\/a>s&#8217;ha produ\u00eft canvis rellevants que afecten als agents que intervenen en el lloguer d&#8217;immobles i que varen entrar en vigor el passat dia 26 de mar\u00e7<\/span><span data-olk-copy-source=\"MessageBody\">.<\/span><\/p>\n<h3><span data-olk-copy-source=\"MessageBody\">Publicitat:<br \/>\n<\/span><\/h3>\n<p>S\u2019amplia la informaci\u00f3 obligat\u00f2ria que han d\u2019incloure tots els anuncis (portals web, xarxes socials, aparadors o premsa).<\/p>\n<ul>\n<li><strong>Preu de lloguer:<\/strong> Cal indicar el preu m\u00e0xim segons el sistema de refer\u00e8ncia o, si escau, l\u2019\u00faltima renda vigent en els darrers 5 anys.<\/li>\n<li><strong>Condici\u00f3 de Gran Tenidor<\/strong>: Cal especificar si el propietari t\u00e9 aquesta condici\u00f3 (en habitatges situats en zones de mercat residencial tensionat).<\/li>\n<li><strong>Dades de l\u2019immoble:<\/strong> Refer\u00e8ncia de la c\u00e8dula d\u2019habitabilitat i del certificat d\u2019efici\u00e8ncia energ\u00e8tica.<\/li>\n<li><strong>Superf\u00edcie<\/strong>: Cal fer constar la superf\u00edcie \u00fatil de l\u2019habitatge.<\/li>\n<\/ul>\n<h3>Informaci\u00f3 que ha de constar en tota oferta de lloguer:<\/h3>\n<ul>\n<li><strong>Caracter\u00edstiques<\/strong>, condicions de l\u2019habitatge i superf\u00edcie \u00fatil.<\/li>\n<li><strong>Preu<\/strong> total desglossat (renda i, si escau, despeses repercutibles).<\/li>\n<li><strong>Durada<\/strong> del contracte i sistema d\u2019actualitzaci\u00f3.<\/li>\n<li><strong>Import de la fian\u00e7a<\/strong> i garanties addicionals.<\/li>\n<li><strong>Document acreditatiu del preu anterior<\/strong> o de l&#8217;\u00edndex de refer\u00e8ncia.<\/li>\n<\/ul>\n<h3>Nous requisits que han de constar en els contractes de lloguer<\/h3>\n<ul>\n<li><strong>Justificaci\u00f3 del preu en contractes de zones tensionades:<\/strong> Cal annexar el document oficial de l\u2019\u00edndex de refer\u00e8ncia. Si la renda es fixa segons un contracte anterior, s&#8217;haur\u00e0 d\u2019indicar el n\u00famero de dip\u00f2sit de la fian\u00e7a a l&#8217;INCAS\u00d2L d&#8217;aquell contracte previ per acreditar-ne l\u2019import.<\/li>\n<li><strong>Declaraci\u00f3 de Gran Tenidor:<\/strong> Menci\u00f3 expressa de la condici\u00f3 del propietari.<\/li>\n<li><strong>Finalitat del contracte:<\/strong> Definici\u00f3 clara de l&#8217;\u00fas de l&#8217;habitatge.<\/li>\n<li><strong>Documentaci\u00f3 annexa:<\/strong> C\u00e8dula i certificat energ\u00e8tic vigents.<\/li>\n<\/ul>\n<h3>Enduriment de les sancions als agents que intervenen en el lloguer<\/h3>\n<p>La norma introdueix noves infraccions greus amb multes que oscil\u00b7len entre els 9.001 \u20ac i els 90.000 \u20ac.<br \/>\n<strong>Es considerar\u00e0 infracci\u00f3:<\/strong><\/p>\n<ul>\n<li>No indicar o falsejar el preu de refer\u00e8ncia o la condici\u00f3 de gran tenidor en la publicitat o el contracte.<\/li>\n<li>Fixar rendes per sobre dels l\u00edmits legals.<\/li>\n<li>No adjuntar la documentaci\u00f3 obligat\u00f2ria<\/li>\n<\/ul>\n<p><strong>Accions de control:\u00a0<\/strong><\/p>\n<p>Es creur\u00e0 dades entre l&#8217;INCAS\u00d2L i els subministraments (aigua, llum) per detectar d\u2019ofici si els contractes compleixen amb la normativa de preus.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-medium wp-image-2927\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Gran-Via-300x168.jpg\" alt=\"\" width=\"300\" height=\"168\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Gran-Via-300x168.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Gran-Via-600x337.jpg 600w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/04\/RM-Assessors-Gran-Via.jpg 752w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Noves obligacions que afecten al lloguer d&#8217;immobles.
