Qu\u00e8 implica per als afectats?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Tribunal Suprem ha tornat a posar el focus en un dels productes financers m\u00e9s controvertits dels darrers anys: les hipoteques multidivisa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> En una sent\u00e8ncia recent, el Tribunal ha declarat abusives les cl\u00e0usules utilitzades en aquest tipus de pr\u00e9stecs comercialitzats per Barclays, actualment integrats en Caixabank, per manca de transpar\u00e8ncia en la seva contractaci\u00f3.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquesta decisi\u00f3 suposa un pas important en la protecci\u00f3 dels consumidors i consolida una l\u00ednia jurisprudencial cada vegada m\u00e9s estricta amb les entitats financeres quan no acrediten una informaci\u00f3 clara i comprensible sobre els riscos dels productes que comercialitzen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Qu\u00e8 eren les hipoteques multidivisa?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les hipoteques multidivisa permetien contractar el pr\u00e9stec en monedes estrangeres, com el ien japon\u00e8s o el franc su\u00eds, amb la idea inicial d\u2019aprofitar tipus d\u2019inter\u00e8s m\u00e9s baixos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El problema \u00e9s que aquest \u201cestalvi aparent\u201d amagava un risc important: la fluctuaci\u00f3 del tipus de canvi. Aix\u00f2 feia que, tot i pagar les quotes mensuals amb normalitat, el capital pendent pogu\u00e9s augmentar en lloc de reduir-se.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Per qu\u00e8 el Tribunal Suprem les considera abusives?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Tribunal centra la seva decisi\u00f3 en la falta de transpar\u00e8ncia en la comercialitzaci\u00f3 d\u2019aquestes hipoteques. En concret, considera que:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00b7 Els clients no van rebre informaci\u00f3 suficient sobre el risc real del tipus de canvi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00b7 No es va explicar de forma clara l\u2019impacte econ\u00f2mic que podia tenir la divisa sobre el deute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00b7 El consumidor mitj\u00e0 no podia comprendre plenament les conseq\u00fc\u00e8ncies del producte contractat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sense aquesta informaci\u00f3 essencial, el Tribunal conclou que la cl\u00e0usula no supera el control de transpar\u00e8ncia i, per tant, \u00e9s abusiva.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Quines conseq\u00fc\u00e8ncies t\u00e9 la sent\u00e8ncia?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La resoluci\u00f3 del Tribunal Suprem t\u00e9 efectes rellevants:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00b7 Les entitats han de deixar d\u2019aplicar aquestes cl\u00e0usules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00b7 Els contractes afectats s\u2019han de convertir a euros.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00b7 S\u2019ordena l\u2019eliminaci\u00f3 de les refer\u00e8ncies a divises estrangeres.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aix\u00f2 pot suposar una revisi\u00f3 important de molts pr\u00e9stecs hipotecaris encara vigents sota aquesta estructura.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Es poden reclamar quantitats?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La sent\u00e8ncia refor\u00e7a la posici\u00f3 dels consumidors, per\u00f2 cada cas s\u2019ha d\u2019analitzar individualment.
