{"id":3694,"date":"2019-08-12T11:14:09","date_gmt":"2019-08-12T09:14:09","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/lextincio-del-contracte-de-relleu-suposa-que-lempresa-haura-de-satisfer-al-treballador-una-indemnitzacio-de-12-dies-per-any-treballat\/"},"modified":"2019-08-12T11:14:09","modified_gmt":"2019-08-12T09:14:09","slug":"lextincio-del-contracte-de-relleu-suposa-que-lempresa-haura-de-satisfer-al-treballador-una-indemnitzacio-de-12-dies-per-any-treballat","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/lextincio-del-contracte-de-relleu-suposa-que-lempresa-haura-de-satisfer-al-treballador-una-indemnitzacio-de-12-dies-per-any-treballat\/","title":{"rendered":"L&#8217;extinci\u00f3 del contracte de relleu suposa que l&#8217;empresa haur\u00e0 de satisfer al treballador una indemnitzaci\u00f3 de 12 dies per any treballat."},"content":{"rendered":"<p>El Tribunal Suprem en sent\u00e8ncia de 7 de maig del 2019, dictada per unificaci\u00f3 de doctrina,\u00a0 ha confirmat que en cas d&#8217;extinci\u00f3 del contracte de relleu opera la indemnitzaci\u00f3 prevista per als contractes temporals, \u00e9s a dir, la de 12 dies de salari per any treballat i no la de 20 dies que algunes sent\u00e8ncies havien reconegut a rel d&#8217;una sent\u00e8ncia del Tribunal de Just\u00edcia de la Uni\u00f3 Europea.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Recordem a continuaci\u00f3 quina es la indemnitzaci\u00f3 que correspon per les principals causes d&#8217;extinci\u00f3 dels contractes de treball:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Finalitzaci\u00f3 de contractes de relleu de treballadors jubilats parcialment:<\/span> 12 dies de salari per any treballat.<\/li>\n<li><span style=\"color: #0000ff;\">Finalitzaci\u00f3 de contractes per obra o servei determinat:<\/span> 12 dies de salari per any treballat.<\/li>\n<li><span style=\"color: #0000ff;\">Finalitzaci\u00f3 de contractes eventuals per circumst\u00e0ncies de la producci\u00f3:<\/span> 12 dies de salari per any treballat.<\/li>\n<li><span style=\"color: #0000ff;\">Finalitzaci\u00f3 de contractes d&#8217;interinitat:<\/span> Sense indemnitzaci\u00f3.<\/li>\n<li><span style=\"color: #0000ff;\">Finalitzaci\u00f3 de contractes formatius:<\/span> Sense indemnitzaci\u00f3. No obstant, l&#8217;extinci\u00f3 del contracte s&#8217;haur\u00e0 d&#8217;avisar amb 15 dies d&#8217;antelaci\u00f3 a la data prevista de finalitzaci\u00f3 del contracte, cas contrari l&#8217;empresa haur\u00e0 d&#8217;indemnitzar al treballador amb l&#8217;import equivalent al salari del temps que no hagu\u00e9s avisat.<\/li>\n<li><span style=\"color: #0000ff;\">Extinci\u00f3 de contractes\u00a0 per causa de mort, jubilaci\u00f3 o incapacitat de l&#8217;empresari persona f\u00edsica:<\/span> Un mes de salari en total.<\/li>\n<li><span style=\"color: #0000ff;\">Extinci\u00f3 de contractes\u00a0 per causes objectives de l&#8217;empresa (econ\u00f2miques, organitzatives o productives) o per for\u00e7a major que faci impossible seguir treballant:<\/span> 20 dies de salari per any treballat amb un m\u00e0xim de 12 mensualitats.<\/li>\n<li><span style=\"color: #0000ff;\">Extinci\u00f3 de contracte a inst\u00e0ncies del treballador en cas de modificaci\u00f3 substancial de les condicions de treball per causes justificades i en perjudici del treballador<\/span>: 20 dies de salari per any treballat amb un m\u00e0xim de 9 mensualitats.<\/li>\n<li><span style=\"color: #0000ff;\">Acomiadament improcedent:<\/span> 33 dies de salari per any treballat amb un m\u00e0xim de 24 mensualitats.
