{"id":3823,"date":"2019-10-23T11:33:43","date_gmt":"2019-10-23T09:33:43","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/les-comunitats-de-propietaris-tenen-els-beneficis-que-la-llei-els-hi-reconeix-als-consumidors-persones-fisiques\/"},"modified":"2019-10-23T11:33:43","modified_gmt":"2019-10-23T09:33:43","slug":"les-comunitats-de-propietaris-tenen-els-beneficis-que-la-llei-els-hi-reconeix-als-consumidors-persones-fisiques","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/les-comunitats-de-propietaris-tenen-els-beneficis-que-la-llei-els-hi-reconeix-als-consumidors-persones-fisiques\/","title":{"rendered":"Les comunitats de propietaris tenen els beneficis que la llei els hi reconeix als consumidors persones f\u00edsiques."},"content":{"rendered":"<p>La<a href=\"http:\/\/www.poderjudicial.es\/search\/openDocument\/5b4b39619ff24e46\/20190923\"><span style=\"color: #ff0000;\"><em> sent\u00e8ncia del Tribunal Suprem de 17 de setembre del 2019<\/em><\/span>\u00a0<\/a><a href=\"http:\/\/www.poderjudicial.es\/search\/openDocument\/5b4b39619ff24e46\/20190923\"><\/a>reconeix en un litigi a les comunitats de propietaris la condici\u00f3 de consumidors\u00a0 i declara que la cl\u00e0usula d&#8217;un contracte que lliga a la comunitat\u00a0 amb una empresa de manteniment d&#8217;ascensors per un per\u00edode de cinc anys es abusiva i l&#8217;anul\u00b7la en considerar que atempta contra la llei que defensa els consumidors i usuaris.<\/p>\n<p>A Catalunya, la defensa dels consumidors i usuaris est\u00e0 regulada en el Codi de Consum, aprovat per Llei 22\/2010, de 20 de juliol.<\/p>\n<p><span style=\"color: #0000ff;\"><strong>Destaquem els seg\u00fcents drets dels consumidors, incloses les comunitats de propietaris,<\/strong> <\/span>pel que fa als serveis que de tracte continuat que tinguin contractats (electricitat, manteniment d&#8217;ascensors, etc.):<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Procediment de baixa:<\/strong><\/span><\/p>\n<ul>\n<li>El procediment per donar-se de baixa no pot ser m\u00e9s complicat que el procediment per donar-se d&#8217;alta.<\/li>\n<li>En el moment de contractar un servei l&#8217;empresa que el subministri haur\u00e0 d&#8217;informar del procediment per a donar-se de baixa i de les indemnitzacions i penalitzacions que comporti la baixa.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Continu\u00eftat o qualitat del servei:<\/strong> <\/span><\/p>\n<ul>\n<li>L&#8217;empresa\u00a0 ha de garantir la continu\u00eftat i la qualitat del servei.<\/li>\n<li>L&#8217;empresa ha de garantir l&#8217;atenci\u00f3 personal al consumidor que ho desitgi, sense procediments o mecanismes autom\u00e0tics.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Conseq\u00fc\u00e8ncies de la manca de pagament:<\/strong> <\/span><\/p>\n<ul>\n<li>L&#8217;empresa no podr\u00e0 deixar de donar el servei per manca de pagament si el consumidor hagu\u00e9s presentat una reclamaci\u00f3 en relaci\u00f3 al rebut o factura.<\/li>\n<li>No es pot interrompre el servei sense haver comunicat fefaentment les conseq\u00fc\u00e8ncies de l&#8217;impagament.<\/li>\n<li>Per incloure els consumidors en fitxers d&#8217;impagats cal que existeix-hi abans un deute cert, ven\u00e7ut i exigible.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Prohibici\u00f3 de cl\u00e0usules abusives:<\/span><\/strong> L&#8217;empresa subministradora no podr\u00e0 aplicar les cl\u00e0usules del contracte que es pugui considerar que son abusives. Seran cl\u00e0usules abusives les que:<\/p>\n<ul>\n<li>Vinculin el contracte a la voluntat de l&#8217;empresa.<\/li>\n<li>Limitin els drets dels consumidors.<\/li>\n<li>Determinin la falta de reciprocitat en el contracte.<\/li>\n<li>Imposin al consumidor garanties desproporcionades o l&#8217;imposin la c\u00e0rrega de la prova.<\/li>\n<li>Resultin desproporcionades en relaci\u00f3\u00a0 al perfeccionament i execuci\u00f3 del contracte.<\/li>\n<li>Siguin contr\u00e0ries a la normes sobre compet\u00e8ncia i el dret aplicable.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/08\/shutterstock_790695424.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-2861\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/08\/shutterstock_790695424.jpg\" alt=\"\" width=\"600\" height=\"600\" \/><\/a><\/p>\n<p><span style=\"color: #ff6600;\"><em><strong>Som administradors de finques i gestionem comunitat de propietaris.
