Aquest dret s&#8217;ha anomenat col\u00b7loquialment \u00abjornada a la carta\u00bb i tamb\u00e9 \u00abhorari a la carta\u00bb.<\/p>\n<p>La principal novetat de la nova regulaci\u00f3 consisteix a recon\u00e8ixer el dret de sol\u00b7licitud d&#8217;adaptaci\u00f3 als treballadors i a deixar a la negociaci\u00f3 col\u00b7lectiva \u00fanicament la regulaci\u00f3 dels termes de l&#8217;exercici d&#8217;aquest dret.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Qu\u00e8 estableix la normativa?<\/strong><\/span><\/p>\n<ul>\n<li>Els treballadors tenen dret a sol\u00b7licitar les adaptacions de la durada i distribuci\u00f3 de la jornada de treball, en l&#8217;ordenaci\u00f3 del temps de treball i en la forma de prestaci\u00f3, inclosa la prestaci\u00f3 de la seva feina a dist\u00e0ncia, per a fer efectiu el seu dret a la conciliaci\u00f3 de la vida familiar i laboral.<\/li>\n<li>Les adaptacions sol\u00b7licitades hauran de ser raonables i proporcionades en relaci\u00f3 amb les necessitats del treballador i amb les necessitats organitzatives o productives de l&#8217;empresa.<\/li>\n<li>En el cas que tinguin fills, els treballadors tenen dret a efectuar aquesta sol\u00b7licitud fins que els fills compleixin dotze anys.<\/li>\n<li>En la negociaci\u00f3 col\u00b7lectiva es pactaran els termes del seu exercici. En la seva abs\u00e8ncia, l&#8217;empresa, obrir\u00e0 un proc\u00e9s de negociaci\u00f3 amb el treballador durant un per\u00edode m\u00e0xim de trenta dies. Finalitzat aquest per\u00edode, l&#8217;empresa, per escrit, comunicar\u00e0 l&#8217;acceptaci\u00f3 de la petici\u00f3, plantejar\u00e0 una proposta alternativa que possibiliti les necessitats de conciliaci\u00f3 del treballador o b\u00e9 manifestar\u00e0 la negativa al seu exercici. En aquest \u00faltim cas, s&#8217;indicaran les raons objectives en les quals se sustenta la decisi\u00f3.<\/li>\n<li>El treballador tindr\u00e0 dret a sol\u00b7licitar el retorn a la seva jornada o modalitat contractual anterior un cop concl\u00f2s el per\u00edode acordat o quan el canvi de les circumst\u00e0ncies aix\u00ed ho justifiqui, encara que no hagu\u00e9s transcorregut el per\u00edode previst.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Qu\u00e8 poden sol\u00b7licitar els treballadors?<\/span><\/strong><\/p>\n<ul>\n<li>La normativa permet sol\u00b7licitar l&#8217;adaptaci\u00f3 de la distribuci\u00f3 de la jornada i fins i tot la seva forma de prestaci\u00f3. En aquest sentit, s&#8217;inclou la sol\u00b7licitud de la reordenaci\u00f3 dins i fora de la jornada del treballador implicant per exemple, la possibilitat de sol\u00b7licitar canvis de torns de feina.<\/li>\n<li>Tamb\u00e9 es pot sol\u00b7licitar un canvi en la modalitat de la prestaci\u00f3 at\u00e8s que la norma fa un refer\u00e8ncia espec\u00edfica a la sol\u00b7licitud de teletreball.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Com ha de ser la sol\u00b7licitud?<\/strong><\/span><\/p>\n<ul>\n<li>\u00c9s requisit necessari per poder exercir la sol\u00b7licitud el fet de tenir familiars a c\u00e0rrec i justificar les raons de la sol\u00b7licitud concreta i com aix\u00f2 permet exercir la conciliaci\u00f3.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Com ha de ser el proc\u00e9s de negociaci\u00f3?<\/strong><\/span><\/p>\n<ul>\n<li>La norma permet mitjan\u00e7ant negociaci\u00f3 col\u00b7lectiva establir els termes de l&#8217;exercici d&#8217;aquest dret de sol\u00b7licitud, que poden establir terminis, unes causes taxades.<\/li>\n<li>En abs\u00e8ncia d&#8217;altres regles recollides en el conveni, l&#8217;empresa, davant la sol\u00b7licitud d&#8217;adaptaci\u00f3 de jornada, \u00abobrir\u00e0 un proc\u00e9s de negociaci\u00f3 amb el treballador durant un per\u00edode m\u00e0xim de trenta dies.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Algunes q\u00fcestions encara no resoltes, pendent del que vagin sentenciant els tribunals:<\/span> <\/strong><\/p>\n<ul>\n<li>Si l&#8217;adaptaci\u00f3 de jornada queda circumscrita als progenitors que tinguin fills menors de 12 anys.<\/li>\n<li>Si roman el dret una vegada el menor hagi arribat a aquesta edat.<\/li>\n<li>Les q\u00fcestions relatives a la compatibilitat de les reduccions de jornada sol\u00b7licitades a l&#8217;empara de l&#8217;article 37 de l&#8217;ET amb les quals es cursin a l&#8217;empara d&#8217;aquest nou precepte.<\/li>\n<li>Si l&#8217;amplitud de l&#8217;article 34.8\u00e8 de l&#8217;ET acabar\u00e0 afectant les reduccions de jornada.<\/li>\n<\/ul>\n<figure id=\"attachment_2198\" aria-describedby=\"caption-attachment-2198\" style=\"width: 900px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2017\/06\/RM_Assessors_Foto_16.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-2198\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2017\/06\/RM_Assessors_Foto_16.jpg\" alt=\"\" width=\"900\" height=\"600\" \/><\/a><figcaption id=\"caption-attachment-2198\" class=\"wp-caption-text\">Asian worker in production plant drilling at machine on the factory floor<\/figcaption><\/figure>\n<p><span style=\"color: #0000ff;\"><em><strong>Som assessors laborals i de la Seguretat Social.
