{"id":4131,"date":"2020-03-04T12:04:22","date_gmt":"2020-03-04T10:04:22","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/derogat-lacomiadament-objectiu-per-faltes-dassistencia-al-treball\/"},"modified":"2020-03-04T12:04:22","modified_gmt":"2020-03-04T10:04:22","slug":"derogat-lacomiadament-objectiu-per-faltes-dassistencia-al-treball","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/derogat-lacomiadament-objectiu-per-faltes-dassistencia-al-treball\/","title":{"rendered":"Derogat l&#8217;acomiadament objectiu per faltes d&#8217;assist\u00e8ncia al treball"},"content":{"rendered":"<p>A l&#8217;any 2012 es va modificar l&#8217;article 52.d) de l&#8217;Estatut dels Treballadors per tal de permetre a les empreses acomiadar per causes objectives i amb algunes excepcions, el personal que acumul\u00e9s abs\u00e8ncies de la feina, encara que fossin justificades per baixes m\u00e8diques, amb una indemnitzaci\u00f3 de tant sols 20 dies de salari per any treballat i fins a un m\u00e0xim de un any de salari.<\/p>\n<p>Aquesta modificaci\u00f3 va estar molt protestada pels agents socials i va motivar una sent\u00e8ncia en contra del Tribunal de Just\u00edcia de la Uni\u00f3 Europea per entendre que\u00a0 era contr\u00e0ria a la Directiva 2000\/78 que prohibeix la discriminaci\u00f3 per ra\u00f3 de discapacitat. La seva derogaci\u00f3 ha estat una de les primeres mesures adoptades pel nou govern de coalici\u00f3 entre el PSOE i Unidas Podemos.<\/p>\n<p>La derogaci\u00f3 s&#8217;ha publicat en el\u00a0 <span style=\"color: #ff0000;\"><em><a href=\"https:\/\/www.boe.es\/boe\/dias\/2020\/02\/19\/pdfs\/BOE-A-2020-2381.pdf\"><span style=\"color: #ff0000;\">Reial decret llei 4\/2020.<\/span><\/a><\/em><\/span><\/p>\n<p>La derogaci\u00f3 t\u00e9 efectes a partir del dia 20 de febrer del 2020 i la situaci\u00f3 de les empreses davant l&#8217;absentisme del seu personal queda ara en la forma seg\u00fcent:<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Les empreses ja no podran acomiadar per causes objectives en cas de<\/strong><\/span> faltes d&#8217;assist\u00e8ncia a la feina, fins i tot justificades per\u00f2 intermitents, que arribin al 20% de les jornades h\u00e0bils en dos mesos consecutius sempre que el total de faltes d&#8217;assist\u00e8ncia en els dotze mesos anteriors arribi al 5% de les jornades h\u00e0bils, o el 25% en quatre mesos discontinus dins d&#8217;un per\u00edode de dotze mesos.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Les empreses si que podran seguir acomiadant per causes disciplinaries el seu personal<\/strong><\/span>, per faltes repetides i injustificades d&#8217;assist\u00e8ncia o puntualitat a la feina.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Conclusi\u00f3<\/strong><\/span>: S&#8217;ha passat de comptar amb dues possibilitats a l&#8217;hora de realitzar un acomiadament per absentisme: per causes objectives (amb indemnitzaci\u00f3), basat en el precepte ara derogat,\u00a0 o per causes disciplin\u00e0ries (sense indemnitzaci\u00f3), a una sola possibilitat d&#8217;acomiadar per causa disciplin\u00e0ria acreditant que les abs\u00e8ncies del personal han estat repetides i injustificades.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/10\/shutterstock_423223252.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-2942\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/10\/shutterstock_423223252.jpg\" alt=\"\" width=\"600\" height=\"600\" \/><\/a><\/p>\n<p><em><span style=\"color: #800080;\"><strong>Som assessors laborals i advocats.
