Resumin i destaquem el seg\u00fcent:<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Pr\u00f2rroga dels ERTO per for\u00e7a major i for\u00e7a major parcial<\/strong><\/span>:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Pr\u00f2rroga fins el 30 de juny<\/span>: Seguiran en situaci\u00f3 de for\u00e7a major derivada del COVID-19 les empreses que haguessin presentat un expedient de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3 (ERTO) per for\u00e7a major basada en el coronavirus, mentre durin les causes que no permetin la recuperaci\u00f3 total o parcial de la seva activitat.<\/li>\n<li><span style=\"color: #0000ff;\">Reincorporaci\u00f3<\/span>: Les empreses que puguin recuperar parcialment la seva activitat hauran d&#8217;anar reincorporant els treballadors en la mesura que siguin necessaris, prioritzant els ajustos en reducci\u00f3 de jornada.<\/li>\n<li><span style=\"color: #0000ff;\">Comunicaci\u00f3<\/span>: Les empreses hauran de comunicar les reincorporacions a l&#8217;autoritat laboral en el termini de 15 dies. Tamb\u00e9 ho hauran de comunicar al servei d&#8217;ocupaci\u00f3 (SEPE).<\/li>\n<li><span style=\"color: #0000ff;\">Beneficis<\/span>: Les empreses i els aut\u00f2noms seguiran gaudint d&#8217;una exoneraci\u00f3 de les quotes a la Seguretat Social.<\/li>\n<li><span style=\"color: #0000ff;\">Comprom\u00eds de manteniment de la ocupaci\u00f3<\/span>:\u00a0 Amb la reincorporaci\u00f3 a la feina de persones afectades per l&#8217;expedient, tot i que aquesta sigui parcial o nom\u00e9s afecti part de la plantilla, s&#8217;entendr\u00e0 que l&#8217;empresa ha complert la obligaci\u00f3 de mantenir l&#8217;ocupaci\u00f3 en un termini de sis mesos des de la data de represa de la seva activitat.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Expedients de suspensi\u00f3 i de reducci\u00f3 de jornada per causes econ\u00f2miques, t\u00e8cniques, organitzatives i de producci\u00f3 iniciats entre el 13 de maig i el 30 de juny del 2020 per causes relacionades amb el coronavirus<\/span><\/strong>: Es continuaran tramitant amb aquestes especialitats:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Iniciaci\u00f3<\/span>: La tramitaci\u00f3 d&#8217;aquests expedients podr\u00e0 iniciar mentre estigui vigent un ERTO per for\u00e7a major.<\/li>\n<li><span style=\"color: #0000ff;\">Efectes<\/span>: Quan l&#8217;expedient de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3 per ETOP s&#8217;inici\u00ef despr\u00e9s de la finalitzaci\u00f3 d&#8217;un ERTO per for\u00e7a major, la data d&#8217;efectes d&#8217;aquell es retrotreu a la data de final de l&#8217;ERTO.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Mesures extraordin\u00e0ries en mat\u00e8ria de protecci\u00f3 per desocupaci\u00f3<\/strong><\/span>:\u00a0 Es prorroguen fins el 30 de juny del 2020 les mesures de protecci\u00f3 als treballadors afectats pels ERTO basats en el coronavirus i fins el 31 de desembre del 2020 les mesures en favor dels treballadors fixes discontinus i dels que realitzin treballs fixes i peri\u00f2dics.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Exoneraci\u00f3 de les quotes empresarials a la Seguretat Social dels mesos de maig i juny en ERTO per for\u00e7a major TOTAL a causa del coronavirus:<\/span><\/strong><\/p>\n<ul>\n<li>\u00a0Empreses amb menys de 50 treballadors:\u00a0 100%.<\/li>\n<li>Empreses amb m\u00e9s de 50 treballadors: 75%.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Exoneraci\u00f3 de les quotes empresarials a la Seguretat Social dels mesos de maig i juny en ERTO per for\u00e7a major PARCIAL a causa del coronavirus<\/span>:<\/strong><\/p>\n<ul>\n<li>Pels treballadors que tornin a la seva activitat:\n<ul>\n<li>Empreses amb menys de 50 treballadors: Es produir\u00e0 una exoneraci\u00f3 de l&#8217;85% al \u200b\u200bmaig i de l&#8217;70% al juny.<\/li>\n<li>Empreses amb m\u00e9s de 50 treballadors: Es produir\u00e0 una exoneraci\u00f3 de l&#8217;60% al maig i de l&#8217;45% al \u200b\u200bjuny.<\/li>\n<\/ul>\n<\/li>\n<li>Pels treballadors que no tornin a la seva activitat:\n<ul>\n<li>Empreses amb menys de 50 treballadors: Es produir\u00e0 una exoneraci\u00f3 de l&#8217;60% al maig i de l&#8217;45% al \u200b\u200bjuny.<\/li>\n<li>Empreses amb m\u00e9s de 50 treballadors: Es produir\u00e0 una exoneraci\u00f3 de l&#8217;45% al \u200b\u200bmaig i de l&#8217;30% al juny.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Comprom\u00eds empresarial de manteniment de la ocupaci\u00f3<\/span><\/strong>:<\/p>\n<ul>\n<li>Aquestes mesures extraordin\u00e0ries quedaran \u00a0subjectes a el comprom\u00eds de l&#8217;empresa de mantenir l&#8217;ocupaci\u00f3 durant el termini de sis mesos des de la data de represa de l&#8217;activitat, entenent per tal la reincorporaci\u00f3 a la feina efectiu de persones afectades per l&#8217;expedient, tot i que aquesta sigui parcial o nom\u00e9s afecti part de la plantilla.<\/li>\n<li>Aquest comprom\u00eds s&#8217;entendr\u00e0 incomplert si es produeix l&#8217;acomiadament o extinci\u00f3 dels contractes de qualsevol de les persones afectades per aquests expedients.<\/li>\n<li>No es considera incomplert aquest comprom\u00eds quan el contracte de treball s&#8217;extingeixi per acomiadament disciplinari declarat com a procedent, dimissi\u00f3, mort, jubilaci\u00f3 o incapacitat permanent total, absoluta o gran invalidesa de la persona treballadora, ni per la fi de la crida de les persones amb contracte fix-discontinu, quan aquest no suposi un acomiadament sin\u00f3 una interrupci\u00f3 del mateix. En particular, en el cas de contractes temporals el comprom\u00eds de manteniment de l&#8217;ocupaci\u00f3 no s&#8217;entendr\u00e0 incomplert quan el contracte s&#8217;extingeixi per expiraci\u00f3n de el temps convingut o la realitzaci\u00f3 de l&#8217;obra o servei que constitueix el seu objecte o quan no pugui realitzar-se de forma immediata la activitat objecte de contractaci\u00f3.<\/li>\n<li>No \u00e9s aplicable el comprom\u00eds de manteniment de l&#8217;ocupaci\u00f3 en aquelles empreses en qu\u00e8 concorri un risc de concurs de creditors en els termes de l&#8217;article 5.2 de la Llei 22\/2003, de 9 de juliol, concursal.<\/li>\n<li>Les empreses que incompleixin aquest comprom\u00eds hauran de reintegrar la totalitat de l&#8217;import de les cotitzacions del pagament de resultar exonerades, amb el rec\u00e0rrec i els interessos de demora corresponents.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/rmassessors5_168999001.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-813\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/rmassessors5_168999001.jpg\" alt=\"\" width=\"658\" height=\"325\" \/><\/a><\/p>\n<p><span style=\"color: #0000ff;\"><em><strong>Som assessors laborals i de la Seguretat Social.
