Reducci\u00f3 de cotitzacions a la Seguretat Social."},"content":{"rendered":"<p class=\"csC4290383\"><span class=\"csB59941D2\">Aq<\/span><span class=\"cs71C8385E\">uest dissabte el Butllet\u00ed Oficial de l\u2019Estat (BOE) ha publicat el\u00a0<em><a class=\"cs8FD64B08\" href=\"https:\/\/www.boe.es\/boe\/dias\/2020\/06\/27\/pdfs\/BOE-A-2020-6838.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"cs4FCC079E\">Reial Decret-Llei 24\/2020<\/span><\/a><\/em><\/span><span class=\"cs71C8385E\">\u00a0de mesures socials de reactivaci\u00f3 de l\u2019ocupaci\u00f3, de protecci\u00f3 del treball aut\u00f2nom i de competitivitat del sector industrial. Tot seguit els fem un petit resum dels detalls de la pr\u00f2rroga dels ERTO i d&#8217;algunes mesures extraordin\u00e0ries que inclou aquesta publicaci\u00f3.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #0000ff;\">Expedients de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3 (ERTO)<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p class=\"csC4290383\"><span style=\"color: #ff0000;\"><strong><span class=\"cs71C8385E\">\u00a0<\/span><span class=\"csEBBE23DD\">E<\/span><span class=\"csEA77FC07\">xpedients basats en la for\u00e7a major\u00a0 (ERTO per for\u00e7a major):<br \/>\n<\/span><\/strong><\/span><\/p>\n<ul>\n<li class=\"cs66A70F71\"><span class=\"cs71C8385E\">La pr\u00f2rroga ser\u00e0, com a m\u00e0xim, fins el 30 de setembre del 2020 i nom\u00e9s s\u2019aplicar\u00e0 als expedients que hagin estat sol\u00b7licitats abans de l\u2019entrada en vigor de la norma.<\/span><\/li>\n<li class=\"cs66A70F71\"><span class=\"cs71C8385E\">S\u2019hauran d\u2019anar incorporant els treballadors afectats per l&#8217;expedient en la mesura que siguin necessaris <\/span><span class=\"cs71C8385E\">per al desenvolupament de l\u2019activitat. <\/span><\/li>\n<li class=\"cs66A70F71\"><span class=\"cs71C8385E\">En les reincorporacions es prioritzar\u00e0 la reducci\u00f3 de jornada laboral.<\/span><\/li>\n<li class=\"cs13202434\"><span class=\"cs71C8385E\">E<\/span><span class=\"csB9D89947\">ls contractes temporals (inclosos els formatius, de relleu i interinitat) s\u2019entenen interromputs i, per tant, el temps en que els treballadors hagin estat en ERTO s&#8217;afegir\u00e0 a la durada del contracte.<br \/>\n<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p class=\"csC4290383\"><span class=\"csEA77FC07\"><strong><span style=\"color: #ff0000;\">Expedients basats en causes econ\u00f2miques, t\u00e8cniques, organitzatives i de producci\u00f3:<\/span><\/strong><br \/>\n<\/span><\/p>\n<ul>\n<li><span class=\"cs71C8385E\">Els expedients tramitats i vigents a data 27 de juny, seguiran sent v\u00e0lids i aplicables en els termes i per\u00edode previstos en la comunicaci\u00f3 final de l\u2019empresa.<\/span><\/li>\n<li class=\"cs66A70F71\">Es podr\u00e0 iniciar nous expedients entre el 27 de juny i el 30 de setembre de 2020<span class=\"cs71C8385E\"> mentre sigui vigent un expedient de for\u00e7a major que el precedeixi. <\/span><span class=\"cs71C8385E\">Si l\u2019expedient s\u2019inicia un cop l\u2019expedient de for\u00e7a major ha perdut vig\u00e8ncia, la seva data d\u2019efectes ser\u00e0 la de fi de l\u2019expedient de for\u00e7a major.<\/span><\/li>\n<li class=\"cs66A70F71\"><span class=\"cs71C8385E\">Els contractes temporals (inclosos els formatius, de relleu i interinitat) suspesos per ERTO de for\u00e7a major s\u2019entenen interromputs <span class=\"csB9D89947\">i, per tant, el temps en que els treballadors hagin estat en ERTO s&#8217;afegir\u00e0 a la durada del contracte. <\/span><\/span><\/li>\n<\/ul>\n<p class=\"csF8110AD8\"><span class=\"cs71C8385E\">\u00a0<\/span><\/p>\n<p class=\"csC4290383\"><span class=\"csEA77FC07\"><strong><span style=\"color: #ff0000;\">Prohibicions per ambd\u00f3s tipus d&#8217;expedients durant la seva vig\u00e8ncia<\/span><\/strong>:<\/span><\/p>\n<ul>\n<li><span class=\"csB9D89947\">No es podran fer hores extraordin\u00e0ries ni establir noves externalitzacions de l\u2019activitat\u00a0 (directes o indirectes).<br \/>\n<\/span><\/li>\n<li><span class=\"csB9D89947\">Es podr\u00e0 realitzar<\/span><span class=\"cs71C8385E\">\u00a0noves contractacions i\/o externalitzacions\u00a0<\/span><span class=\"csB9D89947\">en el cas que els treballadors en ERTO no tinguin formaci\u00f3 i\/o capacitaci\u00f3 per dur a terme les funcions necess\u00e0ries.<\/span><span class=\"cs71C8385E\">\u00a0Per procedir, l\u2019empresa haur\u00e0 d\u2019informar la representaci\u00f3 legal dels treballadors.<\/span><\/li>\n<li>No es podr\u00e0 extingir contractes de treball ni acomiadar treballadors per les causes en que s&#8217;empari els expedients vigents.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Obligacions comuns als dos tipus d&#8217;expedients<\/strong><\/span>:<\/p>\n<ul>\n<li>En cas de ren\u00fancia total (reincorporaci\u00f3 de tota la plantilla), e<span class=\"csB9D89947\">s mant\u00e9 l\u2019obligaci\u00f3 de comunicar-la a l\u2019autoritat laboral en el termini de 15 dies\u00a0<\/span><span class=\"cs71C8385E\">a comptar des de la data d\u2019efectes de la ren\u00fancia <\/span><\/li>\n<li><span class=\"cs71C8385E\">En tot cas s\u2019haur\u00e0 de comunicar al SEPE (Servei d&#8217;ocupaci\u00f3) la finalitzaci\u00f3 i\/o variaci\u00f3 de les mesures respecte de les persones afectades a mesura que es vagin reincorporant al treball efectiu i en proporci\u00f3 d\u2019aquesta reincorporaci\u00f3, \u00e9s a dir, la reincorporaci\u00f3 total o parcial. Aquesta comunicaci\u00f3 haur\u00e0 de ser pr\u00e8via a l\u2019efectivitat de la modificaci\u00f3.<\/span><\/li>\n<li><span class=\"csB9D89947\">La ren\u00fancia a l\u2019expedient comporta, des de la seva data d\u2019efectes, la ren\u00fancia de les exempcions de cotitzacions de la quota empresarial a la Seguretat Social.<\/span><\/li>\n<li><span class=\"cs71C8385E\">Es mant\u00e9 l\u2019obligaci\u00f3 per part de l\u2019empresa de notificar al SEPE, per mes ven\u00e7ut, els per\u00edodes d\u2019activitat de les persones treballadores afectades pels expedients.<\/span><\/li>\n<li><span class=\"cs71C8385E\">En el cas de reducci\u00f3 de jornada s\u2019hauran de dividir les hores treballades entre el nombre d\u2019hores de jornada habitual i el resultat obtingut \u00e9s el nombre de dies complets equivalents a l\u2019activitat.<\/span><\/li>\n<li><span class=\"cs71C8385E\">E<\/span><span class=\"csB9D89947\">n cas de gaudir de les exempcions de cotitzaci\u00f3 de\u00a0 quota empresarial de la Seguretat Social, hi haur\u00e0 l\u2019obligaci\u00f3 relativa al manteniment del treball durant els 6 mesos posteriors a la vig\u00e8ncia dels expedients.<br \/>\n<\/span><\/li>\n<li><span class=\"cs71C8385E\">Per a les empreses que accedeixin a les exempcions per primer cop, el c\u00f2mput d\u2019aquests 6 mesos es comptar\u00e0 a partir de la data d\u2019entrada en vigor de la norma (27 de juny)<br \/>\n<\/span><\/li>\n<\/ul>\n<p class=\"csC4290383\"><span class=\"cs71C8385E\">\u00a0<\/span><\/p>\n<p class=\"csC4290383\"><span class=\"csEA77FC07\"><span style=\"color: #ff0000;\"><strong>Mesures en mat\u00e8ria de protecci\u00f3 d\u2019atur<\/strong><\/span>:<\/span><\/p>\n<ul>\n<li><span class=\"csB9D89947\">La protecci\u00f3 en mat\u00e8ria de prestaci\u00f3 d\u2019atur pels treballadors afectats per expedients de regulaci\u00f3 temporal d\u2019ocupaci\u00f3 es prorrogar\u00e0 fins al 30 de setembre de 202<\/span><span class=\"cs71C8385E\">0.<\/span><\/li>\n<li><span class=\"cs71C8385E\">E<\/span><span class=\"csB9D89947\">n el cas de les persones amb contracte fix discontinu i\/o que realitzen treballs fixos en per\u00edodes de temps fixos i en dates certes, es prorrogar\u00e0 la prestaci\u00f3 d\u2019atur fins al 31 de desembre de 2020.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 class=\"csC4290383\" style=\"text-align: center;\"><span class=\"cs71C8385E\"><span style=\"color: #0000ff;\">\u00a0<strong>Mesures en mat\u00e8ria de cotitzaci\u00f3 a la Seguretat Social a partir del dia 1 de juliol del 2020:<\/strong><\/span><br \/>\n<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Empreses amb ERTO de for\u00e7a major, amb menys de 50 treballadors a data 29.2.2020<\/span><\/strong>:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">En situaci\u00f3 de for\u00e7a major parcial<\/span>:\n<ol>\n<li class=\"cs13202434\"><span class=\"csB9D89947\">Sup\u00f2sits de reactivaci\u00f3 de treballadors: Exempci\u00f3 del 60% de l\u2019aportaci\u00f3 empresarial a la cotitzaci\u00f3 de Seguretat Social dels mesos de juliol, agost i setembre pels treballadors que reinici\u00efn la seva activitat i segons per\u00edodes i percentatge de jornada treballada.<\/span><\/li>\n<li class=\"cs13202434\"><span class=\"csB9D89947\">Sup\u00f2sits de suspensi\u00f3 de l\u2019activitat: Exempci\u00f3 del 35% de l\u2019aportaci\u00f3 empresarial a la cotitzaci\u00f3 de Seguretat Social dels mesos de juliol, agost i setembre.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<ul>\n<li>E<span style=\"color: #0000ff;\">n situaci\u00f3 de for\u00e7a major total<\/span>: <span class=\"csB9D89947\">Pels treballadors <\/span><span class=\"csB9D89947\">que continu\u00efn suspesos a 1 de juliol del 2020, i segons els seus per\u00edodes i percentatges de jornada, hi haur\u00e0 una exempci\u00f3 del 70% de la quota empresarial de Seguretat Social. <\/span><span class=\"csB9D89947\">En el mes d\u2019agost l\u2019exempci\u00f3 ser\u00e0 del 60%. En <\/span><span class=\"csB9D89947\">el mes de setembre l\u2019exempci\u00f3 ser\u00e0 del 35%.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Empreses amb ERTO de for\u00e7a major, amb 50 treballadors o m\u00e9s a <\/span><\/strong><span class=\"cs71C8385E\"><strong><span style=\"color: #ff0000;\">29 de febrer de 2020<\/span><\/strong>:<\/span><\/p>\n<ul>\n<li><span class=\"csB9D89947\"><span style=\"color: #0000ff;\">En situaci\u00f3 de for\u00e7a major parcial<\/span>:<\/span>\n<ol>\n<li><span class=\"cs71C8385E\">Sup\u00f2sits de reactivaci\u00f3 de treballadors: Exempci\u00f3 del 40% de l\u2019aportaci\u00f3 empresarial a la cotitzaci\u00f3 de Seguretat Social dels mesos de juliol, agost i setembre pels treballadors que reinici\u00efn la seva activitat i segons per\u00edodes i percentatge de jornada treballada.<\/span><\/li>\n<li><span class=\"cs71C8385E\">Sup\u00f2sits de suspensi\u00f3 de l\u2019activitat: Exempci\u00f3 del 25% de l\u2019aportaci\u00f3 empresarial a la cotitzaci\u00f3 de Seguretat Social dels mesos de juliol, agost i setembre.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<ul>\n<li><span style=\"color: #0000ff;\">En situaci\u00f3 de <\/span><span class=\"cs71C8385E\"><span style=\"color: #0000ff;\">de for\u00e7a major total<\/span>: <\/span><span class=\"cs71C8385E\">Pels treballadors que continu\u00efn suspeses a 1 de juliol del 2020, i segons els seus per\u00edodes i percentatges de jornada, hi haur\u00e0 una exempci\u00f3 del 50% de la quota empresarial de Seguretat Social. <\/span><span class=\"cs71C8385E\">En el mes d\u2019agost l\u2019exempci\u00f3 ser\u00e0 del 40%. <\/span><span class=\"cs71C8385E\">En el mes de setembre l\u2019exempci\u00f3 ser\u00e0 del 25%<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Empreses amb ERTO per causes econ\u00f2miques, t\u00e8cniques, organitzatives i de producci\u00f3<\/span><\/strong>:<\/p>\n<ul>\n<li><span class=\"cs71C8385E\"><span style=\"color: #0000ff;\">Empreses amb menys de 50 treballadors a 29 de febrer de 2020<\/span>:<\/span>\n<ol>\n<li><span class=\"cs71C8385E\">Sup\u00f2sits de reactivaci\u00f3 de treballadors: Exempci\u00f3 del 60% de l\u2019aportaci\u00f3 empresarial a la cotitzaci\u00f3 de Seguretat Social dels mesos de juliol, agost i setembre pels treballadors que reinici\u00efn la seva activitat i segons per\u00edodes i percentatge de jornada l\u2019autoritzaci\u00f3 d\u2019un nou expedient<\/span><span class=\"cs71C8385E\">\u00a0de for\u00e7a major, podran accedir, fins al 30 de setembre de 2020, als seg\u00fcents percentatges d\u2019exoneraci\u00f3 per a cada treballadors adscrit\u00a0 al\/s centre\/s de treball afectat\/s:<\/span><\/p>\n<ul>\n<li><span class=\"cs71C8385E\"><span style=\"color: #0000ff;\">Empreses amb menys de 50\u00a0 treballadors a 29 de febrer de 2020<\/span>: <\/span><span class=\"cs71C8385E\">Exoneraci\u00f3 del 80% de l\u2019aportaci\u00f3 empresarial a la quota de Seguretat Social.<\/span><\/li>\n<li><span class=\"cs71C8385E\"><span style=\"color: #0000ff;\">Empreses amb 50 o m\u00e9s treballadors a 29 de febrer de 2020<\/span>: <\/span><span class=\"cs71C8385E\">Exoneraci\u00f3 del 60% de l\u2019aportaci\u00f3 empresarial a la quota de Seguretat Social.<\/span><\/li>\n<\/ul>\n<p><a
