Destaquem el seg\u00fcent d&#8217;aquesta regulaci\u00f3 que entrar\u00e0 en vigor el proper dia 13 d&#8217;octubre:<\/p>\n<p><strong><span style=\"color: #ff0000;\">Covid-19. Teletreball a causa de les mesures de contenci\u00f3 sanit\u00e0ria<\/span>:<br \/>\n<\/strong><\/p>\n<ul>\n<li>Al treball a dist\u00e0ncia implantat excepcionalment com a conseq\u00fc\u00e8ncia de les mesures de contenci\u00f3 sanit\u00e0ria derivades de la pand\u00e8mia i mentre aquestes es mantinguin, li continuar\u00e0 resultant d&#8217;aplicaci\u00f3 la normativa laboral ordin\u00e0ria.<\/li>\n<li>En tot cas, les empreses estaran obligades a dotar als treballadors dels mitjans, equips i eines que exigeix el desenvolupament de la feina a dist\u00e0ncia, aix\u00ed com al manteniment que resulti necessari.<\/li>\n<li>La negociaci\u00f3 col\u00b7lectiva, en el seu cas, establir\u00e0 la forma de compensaci\u00f3 de les despeses del \u00abteletreballador\u00bb durant la pand\u00e8mia, si existissin i no haguessin estat compensades.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Qu\u00e8 es considera com a treball a dist\u00e0ncia?<\/span>: <\/strong><\/p>\n<ul>\n<li>S&#8217;entendr\u00e0 com a\u00a0treball a dist\u00e0ncia regular\u00a0aquell que es presti, en un per\u00edode de refer\u00e8ncia de tres mesos, un m\u00ednim del 30% de la jornada o el percentatge proporcional equivalent en funci\u00f3 de la durada del contracte de treball.<\/li>\n<li>Treballar mitja jornada des de casa o fins i tot un dia sencer de tant en tant no ser\u00e0 considerat teletreball, sin\u00f3 un element de flexibilitat que es reconeix als treballadors.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Voluntari i reversible<\/span>: <\/strong><\/p>\n<ul>\n<li>La feina a dist\u00e0ncia ser\u00e0 volunt\u00e0ria i reversible i\u00a0requerir\u00e0 la signatura d&#8217;un acord per escrit, que podr\u00e0 formar part del contracte inicial o realitzar-se en un moment posterior, sense que aquesta modalitat pugui ser imposada.<\/li>\n<li>L&#8217;acord s&#8217;haur\u00e0 de registrar en l&#8217;oficina d&#8217;ocupaci\u00f3 i lliurar-se a la representaci\u00f3 legal dels treballadors.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Distinci\u00f3 entre treball a dist\u00e0ncia, teletreball i treball presencial<\/strong><\/span>:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Treball a dist\u00e0ncia<\/span>: activitat laboral des del domicili o el lloc triat pel treballador, amb car\u00e0cter regular.<\/li>\n<li><span style=\"color: #0000ff;\">T<\/span><span style=\"color: #0000ff;\">eletreball<\/span><strong><span style=\"color: #0000ff;\">:<\/span><\/strong> treball a dist\u00e0ncia realitzat exclusivament o de manera prevalent per mitjans i sistemes inform\u00e0tics o telem\u00e0tics.<\/li>\n<li><span style=\"color: #0000ff;\">Treball presencial<\/span>: el que es presta en el centre de treball o en el lloc que tri\u00ef l&#8217;empresa.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Contractes de treball amb menors, en pr\u00e0ctiques i per a la formaci\u00f3 i l&#8217;aprenentatge<\/strong><\/span>: nom\u00e9s es podr\u00e0 arribar a un acord de treball a dist\u00e0ncia que garanteixi almenys un percentatge del 50% de prestaci\u00f3 de serveis presencial, sense perjudici del desenvolupament telem\u00e0tic de la formaci\u00f3 te\u00f2rica vinculada a aquests \u00faltims.<\/p>\n<p><strong><span style=\"color: #ff0000;\">Compensaci\u00f3 de despeses<\/span>:<br \/>\n<\/strong><\/p>\n<ul>\n<li>El desenvolupament de la feina a dist\u00e0ncia haur\u00e0 de ser sufragat o compensat per l&#8217;empresa i no podr\u00e0 suposar l&#8217;assumpci\u00f3 per part del treballador de les despeses relacionades amb els equips, eines i mitjans vinculats al desenvolupament de la seva activitat laboral.<\/li>\n<li>Els convenis o acords col\u00b7lectius podran establir el mecanisme per determinar i abonar les compensacions de despeses corresponents.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Drets dels treballadors a dist\u00e0ncia<\/strong><\/span>:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Igualtat de drets<\/span>: Tindran els mateixos drets que els treballadors presencials. En especial tindran dret a la formaci\u00f3; a la promoci\u00f3 professional; a la\u00a0desconnexi\u00f3 digital;\u00a0 a la intimitat i protecci\u00f3 de dades; a la seguretat i salut en el treball, a rebre de l&#8217;empresa els mitjans adequats\u00a0per desenvolupar la seva activitat.<\/li>\n<li><span style=\"color: #0000ff;\">Dret a no ser acomiadat per causes relacionades amb el treball a dist\u00e0ncia<\/span>: La negativa d&#8217;un empleat a treballar a dist\u00e0ncia, l&#8217;exercici de la reversibilitat al treball presencial i les dificultats per al desenvolupament adequat de l&#8217;activitat laboral a dist\u00e0ncia exclusivament relacionades amb el canvi d&#8217;una prestaci\u00f3 presencial a una altra que inclogui treball a dist\u00e0ncia, no seran causes justificatives d&#8217;acomiadament ni de la modificaci\u00f3 substancial de les condicions de treball.<\/li>\n<li><span style=\"color: #0000ff;\">Prioritat per ocupar llocs de treball presencials<\/span>: Els qui treballin a dist\u00e0ncia des de l&#8217;inici de la relaci\u00f3 laboral durant la totalitat de la seva jornada tindran\u00a0prioritat per ocupar llocs de treball que es realitzin totalment o parcial de manera presencial, per la qual cosa l&#8217;empresa haur\u00e0 d&#8217;informar de les vacants disponibles.<\/li>\n<li><span style=\"color: #0000ff;\">Registre horari\u00a0adequat<\/span>: Haur\u00e0 d&#8217;incloure el moment d&#8217;inici i finalitzaci\u00f3 de la jornada.<\/li>\n<li><span style=\"color: #0000ff;\">Prevenci\u00f3 de riscos laborals<\/span>:\u00a0 L&#8217;avaluaci\u00f3 de riscos haur\u00e0 de tenir en compte els riscos caracter\u00edstics d&#8217;aquesta modalitat de treball, especialment factors psicosocials, ergon\u00f2mics i organitzatius.<\/li>\n<li><span style=\"color: #0000ff;\">Dret a la intimitat, a la protecci\u00f3 de dades i a la desconnexi\u00f3 digital<\/span>: La utilitzaci\u00f3 dels mitjans telem\u00e0tics i el control de la prestaci\u00f3 laboral mitjan\u00e7ant dispositius autom\u00e0tics garantiran el dret a la intimitat i a la protecci\u00f3 de dades, aix\u00ed com el dret a la desconnexi\u00f3 digital fora del seu horari de treball.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #ff0000;\">Aplicaci\u00f3 de la nova normativa<\/span><\/strong>:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\">Relacions laborals vigents en que el treball a dist\u00e0ncia ja est\u00e8s regulat amb anterioritat per acords o convenis col\u00b7lectius<\/span>: La nova normativa s&#8217;aplicar\u00e0 a partir del moment en que aquells acords o convenis perdin la seva vig\u00e8ncia.\u00a0 En el cas que aquests acords i convenis no estableixin un termini de durada, la norma ser\u00e0 aplicable \u00edntegrament una vegada transcorregut un any des de la seva publicaci\u00f3 en el BOE, tret que les parts acordin un termini superior, com a m\u00e0xim de tres anys.<\/li>\n<li><span style=\"color: #0000ff;\">Condicions m\u00e9s beneficioses<\/span>: En cap cas,\u00a0l&#8217;aplicaci\u00f3 de la norma podr\u00e0 tenir com a conseq\u00fc\u00e8ncia la compensaci\u00f3, absorci\u00f3 o desaparici\u00f3 dels drets o condicions m\u00e9s beneficioses\u00a0que estiguessin gaudint les persones que treballaven a dist\u00e0ncia abans de la nova llei.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2019\/01\/shutterstock_357697235-1.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-3234\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2019\/01\/shutterstock_357697235-1.jpg\" alt=\"\" width=\"600\" height=\"600\" \/><\/a><\/p>\n<\/div>\n<p><em><span style=\"color: #0000ff;\"><strong>Som assessors laborals i de la Seguretat Social.
