{"id":5523,"date":"2021-02-18T13:57:51","date_gmt":"2021-02-18T11:57:51","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/erto-per-impediment-o-per-limitacio-quin-es-mes-avantatjos-per-a-locupador\/"},"modified":"2021-02-18T13:57:51","modified_gmt":"2021-02-18T11:57:51","slug":"erto-per-impediment-o-per-limitacio-quin-es-mes-avantatjos-per-a-locupador","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/erto-per-impediment-o-per-limitacio-quin-es-mes-avantatjos-per-a-locupador\/","title":{"rendered":"ERTO per impediment o per limitaci\u00f3, quin \u00e9s m\u00e9s avantatj\u00f3s per a l&#8217;ocupador?"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\">Els avantatges de les dues modalitats d&#8217;ERTO son diferents per\u00f2 l&#8217;elecci\u00f3 d&#8217;una o altra modalitat no es lliure i s&#8217;haur\u00e0 d&#8217;optar per una o altra en funci\u00f3 del que resulti de la normativa aplicable en cada cas. <\/h4>\n\n\n\n<h5 class=\"wp-block-heading\">Segurament ho entendrem millor en un exemple: <\/h5>\n\n\n\n<p>Si vost\u00e8 \u00e9s el propietari d&#8217;un restaurant que va haver de tancar el seu negoci perqu\u00e8 les autoritats no li permetien obrir, va haver de tramitar un ERTO per impediment. Doncs b\u00e9, si les mesures de restricci\u00f3 sanit\u00e0ria s&#8217;han rebaixat i ara s\u00ed que li permeten obrir amb un aforament limitat (oferint menys taules, per la qual cosa igualment necessita mantenir a alguns treballadors en l&#8217;ERTO), haur\u00e0 de tenir en compte el seg\u00fcent:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Podr\u00e0 passar a un ERTO per limitacions&nbsp;<\/em>(o viceversa)&nbsp;<em>sense haver de tramitar un ERTO nou<\/em>.<\/li><li>Haur\u00e0 de comunicar el canvi d&#8217;ERTO als representants dels treballadors i a la Seguretat Social.<\/li><\/ul>\n\n\n\n<p>Sense perjudici de l&#8217;anterior, resultaran aplicables, a cada moment, els&nbsp;<strong>percentatges d&#8217;exoneraci\u00f3<\/strong>&nbsp;corresponents, en funci\u00f3 de la naturalesa impeditiva o limitativa de la situaci\u00f3 de for\u00e7a major en la qual es trobi l&#8217;empresa.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Quines difer\u00e8ncies existeixen entre totes dues figures?<\/strong><\/h5>\n\n\n\n<p>Hi ha dues difer\u00e8ncies fonamentals:<\/p>\n\n\n\n<p>a) En l&#8217;ERTO per impediment, l&#8217;empresa es veu obligada a tancar. En l&#8217;ERTO per limitacions l&#8217;empresa nom\u00e9s restringeix la seva activitat, per\u00f2 no tanca.<\/p>\n\n\n\n<p>b) Les exoneracions en la cotitzaci\u00f3.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">ERTO per for\u00e7a major: <\/h5>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2021\/02\/erto.png\"><img fetchpriority=\"high\" decoding=\"async\" width=\"622\" height=\"418\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2021\/02\/erto.png\" alt=\"\" class=\"wp-image-5524\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2021\/02\/erto.png 622w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2021\/02\/erto-300x202.png 300w\" sizes=\"(max-width: 622px) 100vw, 622px\" \/><\/a><\/figure>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>ERTO per impediment<\/strong><\/h5>\n\n\n\n<p>Afecten empreses i entitats de qualsevol sector o activitat que, a partir del 1 de febrer de 2021 (o, des del 1 d&#8217;octubre de 2020, per als vigents a l&#8217;entrada en vigor del RDL 2\/2021) i fins al 31 de maig, vegin&nbsp;<strong>impedit<\/strong>&nbsp;el desenvolupament de la seva activitat per l&#8217;adopci\u00f3 de noves restriccions o mesures de contenci\u00f3 sanit\u00e0ria adoptades. Requereixen, si s\u00f3n nous, l&#8217;autoritzaci\u00f3 d&#8217;un nou ERTO, i la seva durada queda restringida a les mesures d&#8217;impediment citades.<\/p>\n\n\n\n<p>Aquests expedients es beneficien dels seg\u00fcents percentatges d&#8217;exoneraci\u00f3:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>El 100% de l&#8217;aportaci\u00f3 empresarial reportada durant el per\u00edode de tancament, i fins al 31 de maig de 2021, quan l&#8217;empresa hagu\u00e9s tingut menys de 50 treballadors o assimilats en situaci\u00f3 d&#8217;alta a la Seguretat Social a 29 de febrer de 2020.<\/li><li>Si en aquesta data l&#8217;empresa hagu\u00e9s tingut 50 treballadors o m\u00e9s o assimilats en alta, l&#8217;exempci\u00f3 arribar\u00e0 al 90% de l&#8217;aportaci\u00f3 empresarial durant el per\u00edode de tancament i fins al 31 de maig de 2021.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>ERTO<\/strong><\/td><td><strong>Plantilla de l&#8217;empresa<\/strong><\/td><td><strong>Beneficis<br \/>(mesos de febrer a maig del 2021)<\/strong><\/td><\/tr><tr><td><strong>For\u00e7a major, ERTO per impediment<\/strong><\/td><td>Menys de 50 treballadors<\/td><td>100% de l&#8217;aportaci\u00f3 empresarial meritada<\/td><\/tr><tr><td>50 treballadors o m\u00e9s<\/td><td>90% de l&#8217;aportaci\u00f3 empresarial meritada<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>ERTO per limitacions d&#8217;activitat<\/strong><\/h5>\n\n\n\n<p>Empreses i entitats de qualsevol sector o activitat que vegin&nbsp;<strong>limitat<\/strong>&nbsp;el desenvolupament normalitzat de la seva activitat a conseq\u00fc\u00e8ncia de decisions o mesures adoptades per les autoritats espanyoles.
