No obstant es convenient que l&#8217;empresa els hi notifiqui per escrit la data en que hauran de tornar a la feina. <\/h5>\n\n\n\n<p>Si vareu tramitar un ERTO ETOP (expedient de regulaci\u00f3 temporal d&#8217;ocupaci\u00f3 per causes econ\u00f2miques, t\u00e8cniques, organitzatives o de producci\u00f3), la data de finalitzaci\u00f3 de la mesura ser\u00e0 la que va pactar en el seu moment amb els representants dels treballadors (en el per\u00edode de consultes. A aquest efecte informem el seg\u00fcent:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Es pot prorrogar l&#8217;ERTO fins el 31 de maig: <\/h3>\n\n\n\n<p>Si arribada la data en que finalitzi l&#8217;ERTO la vostra empresa continua travessant dificultats, fins al 31 de maig&nbsp;podreu pactar una pr\u00f2rroga de l&#8217;ERTO amb els representants dels treballadors. Per a aix\u00f2, l&#8217;empresa s&#8217;ha de reunir amb els treballadors i arribar a un acord amb ells en el per\u00edode de consultes.<\/p>\n\n\n\n<p>A partir de l&#8217;1 de juny no ser\u00e0 possible prorrogar la vig\u00e8ncia d&#8217;un ERTO per causes objectives, per la qual cosa s&#8217;haur\u00e0 d&#8217;iniciar tot el procediment per tramitar-ne un de nou si es vol seguir amb aquesta mesura (tret que el Govern prorrogui la possibilitat d&#8217;allargar un ERTO m\u00e9s enll\u00e0 del 31 de maig).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Recuperaci\u00f3 de l&#8217;activitat abans no finalitzi l&#8217;ERTO:<\/h3>\n\n\n\n<p>Si despr\u00e9s de tramitat l&#8217;ERTO la vostre empresa s&#8217;ha recuperat, podreu donar per acabada aquesta mesura. En aquest cas,&nbsp;els vostres empleats estaran obligats a reincorporar-se&nbsp;en les mateixes condicions que tenien abans.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Av\u00eds als treballadors que s&#8217;hagin de reincorporar en finalitzar l&#8217;ERTO: <\/h3>\n\n\n\n<p>At\u00e8s que al final del per\u00edode de consultes la vostra empresa va comunicar als treballadors les dates d&#8217;inici i finalitzaci\u00f3 de l&#8217;ERTO, els afectats&nbsp;s&#8217;haurien de reincorporar al final de l&#8217;ERTO sense m\u00e9s perqu\u00e8 ja coneixen la data de reingr\u00e9s. No obstant aix\u00f2, com que l&#8217;ERTO haur\u00e0 durat mesos, \u00e9s recomanable que l&#8217;empresa els comuniqui per escrit la seva obligaci\u00f3 de reincorporar-se l&#8217;endem\u00e0 de la finalitzaci\u00f3 de l&#8217;ERTO. A aquest efecte:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Si reitereu aquesta obligaci\u00f3 de reincorporar-se i un treballador no es presenta al seu lloc de treball, el podreu requerir perqu\u00e8 justifiqui aquestes abs\u00e8ncies i el podreu sancionar-lo si no ho fa.<\/li><li>Si l&#8217;afectat segueix sense presentar-se,&nbsp;el podreu acomiadar per les abs\u00e8ncies no justificades.
