{"id":5920,"date":"2021-06-28T13:54:20","date_gmt":"2021-06-28T11:54:20","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/compensacions-als-propietaris-afectats-per-la-suspensio-de-desnonaments-a-causa-del-covid\/"},"modified":"2021-06-28T13:54:20","modified_gmt":"2021-06-28T11:54:20","slug":"compensacions-als-propietaris-afectats-per-la-suspensio-de-desnonaments-a-causa-del-covid","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/compensacions-als-propietaris-afectats-per-la-suspensio-de-desnonaments-a-causa-del-covid\/","title":{"rendered":"Compensacions als propietaris afectats per la suspensi\u00f3 de desnonaments a causa del Covid."},"content":{"rendered":"\n<h5 class=\"wp-block-heading\">El passat 10 de juny va entrar en vigor el <a href=\"https:\/\/www.boe.es\/boe\/dias\/2021\/06\/09\/pdfs\/BOE-A-2021-9560.pdf\"><em>Reial Decret 401\/2021<\/em><\/a>, de 8 de juny, que aprova les mesures per compensar als arrendadors d&#8217;habitatges afectats per la suspensi\u00f3 dels desnonaments i llan\u00e7ament d&#8217;arrendataris que tinguin la condici\u00f3 de persones vulnerables<\/h5>\n\n\n\n<p>Reprodu\u00efm la informaci\u00f3 obtinguda del Col\u00b7legi d&#8217;Agents de la propietat immobili\u00e0ria de Girona:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Objectius: <\/h3>\n\n\n\n<p>\u00a0L\u2019objectiu d\u2019aquest Reial decret \u00e9s establir les mesures necess\u00e0ries per compensar a aquells arrendadors o propietaris d\u2019habitatges que hagin estat afectats per la suspensi\u00f3 generalitzada de procediments de desnonament i\/o llan\u00e7ament que protegeixen les persones vulnerables i establir-ne el procediment per a la presentaci\u00f3, tramitaci\u00f3 i resoluci\u00f3 de les resolucions de compensacions.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Procediment i requisits<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>Sol\u00b7licitud a inst\u00e0ncia de part, dirigida a l\u2019\u00f2rgan competent en mat\u00e8ria d\u2019habitatge de la Comunitat Aut\u00f2noma que a Catalunya pertoca a l\u2019Ag\u00e8ncia de l\u2019Habitatge de Catalunya.<\/li><li>Data m\u00e0xima de presentaci\u00f3:&nbsp;<strong>9 setembre 2021<\/strong>.<\/li><li>Documentaci\u00f3 que cal acompanyar a la sol\u00b7licitud. Una exposici\u00f3 raonada i justificada de la compensaci\u00f3 prenent com a criteris:<ul><li>El valor mitj\u00e0 que correspondria a un lloguer d\u2019habitatge en l\u2019entorn on es trobi l\u2019habitatge, determinat a partir de l\u2019\u00cdndex de Refer\u00e8ncia o altres refer\u00e8ncies objectives del mercat d\u2019arrendaments. Si el valor result\u00e9s superior a la renda que es venia cobrant, la compensaci\u00f3 ser\u00e0 aquesta renda no cobrada.<\/li><li>Les despeses corrents de l\u2019habitatge que acrediti haver assumit l\u2019arrendador o propietari.<\/li><li>En els sup\u00f2sits de suspensi\u00f3 del llan\u00e7ament, el propietari haur\u00e0 d\u2019acreditar el prejudici econ\u00f2mic que li ha ocasionat al trobar-se l\u2019habitatge ofertat en venda o arrendament amb anterioritat a l\u2019entrada a l\u2019immoble.<\/li><\/ul><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Tramitaci\u00f3<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>Les persones jur\u00eddiques, les entitats sense personalitat jur\u00eddica i els professionals que requereixen per la seva activitat col\u00b7legiaci\u00f3 obligat\u00f2ria han de presentar la sol\u00b7licitud i la resta de tr\u00e0mits del procediment per mitjans electr\u00f2nics.<\/li><li>Les persones f\u00edsiques poden presentar la sol\u00b7licitud per mitjans No electr\u00f2nics.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Resoluci\u00f3<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>El termini per resoldre i notificar la resoluci\u00f3 a l\u2019interessat \u00e9s de 3 mesos.<\/li><li>Excepcionalment, es pot ampliar per 3 mesos m\u00e9s si l\u2019\u00f2rgan competent ho acorda de forma motivada.<\/li><li>En cas de silenci durant aquests terminis, l\u2019interessat podr\u00e0 entendre per estimada la sol\u00b7licitud per silenci administratiu.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/10\/shutterstock_561749380.jpg\"><img fetchpriority=\"high\" decoding=\"async\" width=\"600\" height=\"600\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/10\/shutterstock_561749380.jpg\" alt=\"\" class=\"wp-image-4898\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/10\/shutterstock_561749380.jpg 600w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/10\/shutterstock_561749380-300x300.jpg 300w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2020\/10\/shutterstock_561749380-150x150.jpg 150w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/a><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Som agents immobiliaris, API i Administradors de finques.
