{"id":7019,"date":"2022-12-30T14:57:39","date_gmt":"2022-12-30T13:57:39","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/el-2023-seguira-limitat-lincrement-del-lloguer-dels-habitatges\/"},"modified":"2023-04-24T10:28:28","modified_gmt":"2023-04-24T08:28:28","slug":"el-2023-seguira-limitat-lincrement-del-lloguer-dels-habitatges","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/el-2023-seguira-limitat-lincrement-del-lloguer-dels-habitatges\/","title":{"rendered":"El 2023 seguir\u00e0 limitat l&#8217;increment del lloguer dels habitatges"},"content":{"rendered":"<h5>Han estat prorrogades les mesures que es varen adoptar l&#8217;any passat per limitar els increments de les rendes de lloguers a causa d&#8217;un l&#8217;IPC disparat per la guerra d&#8217;Ucra\u00efna.<\/h5>\n<p>El<span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000;\" href=\"https:\/\/www.boe.es\/boe\/dias\/2022\/12\/28\/pdfs\/BOE-A-2022-22685.pdf\"> Reial decret llei 20\/2022, de 27 de desembre<\/a><\/em><\/span> prorroga diferents mesures urgents en mat\u00e8ria d&#8217;habitatge en resposta a les conseq\u00fc\u00e8ncies econ\u00f2miques de la guerra d&#8217;Ucra\u00efna. En concret, les seg\u00fcents:<\/p>\n<p>&nbsp;<\/p>\n<h3>Limitaci\u00f3 de l&#8217;increment de la renda del lloguer, mesura\u00a0 prorrogada fins el 31 de desembre de 2023:<\/h3>\n<ul>\n<li><strong>Grans tenidors<\/strong> (son aquells que siguin titulars de m\u00e9s de 10 immobles urbans d&#8217;\u00fas residencial o de una superf\u00edcie constru\u00efda de m\u00e9s de 1.500 m2. d&#8217;\u00fas residencial, exclosos garatges i trasters): No podran aplicar un increment superior\u00a0 al de l&#8217;\u00cdndex de garantia de competitivitat, que actualment es d&#8217;un <strong>2%<\/strong> .<\/li>\n<li><strong>NO grans tenidors<\/strong>: En cas d&#8217;acord amb l&#8217;arrendatari es podr\u00e0 aplicar l&#8217;increment\u00a0 que s&#8217;hagu\u00e9s pactat en el contracte d&#8217;arrendament. A falta d&#8217;acord, l&#8217;increment quedar\u00e0 limitat com en el cas anterior (actualment, <strong>2%<\/strong>).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>Suspensi\u00f3 extraordin\u00e0ria dels procediments de desnonament i dels llan\u00e7aments de llars vulnerables. Mesura prorrogada fins el 30 de juny de 2023:<\/h3>\n<ul>\n<li><strong>Arrendataris vulnerables<\/strong>: Quan l&#8217;arrendatari en proc\u00e9s de desnonament acrediti que es troba en situaci\u00f3 de vulnerabilitat social o econ\u00f2mica que l&#8217;impossibiliti trobar un altra habitatge, la dilig\u00e8ncia de llan\u00e7ament quedar\u00e0 suspesa durant el temps necessari que estimin els serveis socials i, com a m\u00e0xim, fins el 30 de juny de 2023.<\/li>\n<li><strong>Ocupants il\u00b7legals o a precari<\/strong>: El jutjat adoptar\u00e0 la mateixa mesura en cas d&#8217;habitatges ocupats il\u00b7legalment o a precari, sempre que existeixin persones dependents, v\u00edctimes de viol\u00e8ncia sobre la dona o menors d&#8217;edat a c\u00e0rrec que acreditin una situaci\u00f3 de vulnerabilitat econ\u00f2mica.<\/li>\n<li><strong>Arrendadors vulnerables<\/strong>: En cas que l&#8217;arrendador acrediti\u00a0 trobar-se igualment en situaci\u00f3 de vulnerabilitat econ\u00f2mica, o en risc de situar-se en ella, el jutge decidir\u00e0 quina de les dues situacions ha de prevaldre (si continua amb el desnonament o si el susp\u00e8n).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>Compensaci\u00f3 a la persona arrendadora:<\/h3>\n<ul>\n<li><strong>Dret a la compensaci\u00f3<\/strong>: Els arrendadors afectats per aquella suspensi\u00f3 extraordin\u00e0ria podran sol\u00b7licitar una compensaci\u00f3 econ\u00f2mica si en els tres mesos seg\u00fcents a la data de l&#8217;informe dels Serveis socials l&#8217;administraci\u00f3 competent no hagu\u00e9s facilitat un nou habitatge als arrendataris o ocupants en situaci\u00f3 de vulnerabilitat.<\/li>\n<li><strong>Import:<\/strong> La compensaci\u00f3 consistir\u00e0 en la renda deixada de percebre i tindr\u00e0 com a l\u00edmit el valor mitj\u00e0 en lloguer d&#8217;un habitatge de l&#8217;entorn, tenint en compte els l\u00edmits legals, m\u00e9s les despeses corrents.<\/li>\n<li><strong>Per\u00edode de percepci\u00f3<\/strong>: La compensaci\u00f3 es percebr\u00e0\u00a0 durant el per\u00edode compr\u00e9s entre el moment en que s&#8217;acordi la suspensi\u00f3 i el moment en que aquella s&#8217;aixequi pel jutjat o fins el 30 de juny de 2023, com a m\u00e0xim.<\/li>\n<li><strong>Termini de sol\u00b7licitud<\/strong>: La sol\u00b7licitud de compensaci\u00f3 es podr\u00e0 presentar fins el 31 de juliol de 2023.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>Pr\u00f2rroga extraordin\u00e0ria dels contractes de lloguer d&#8217;habitatge habitual:<\/h3>\n<ul>\n<li><strong>Sol\u00b7licitud de pr\u00f2rroga<\/strong>: Si el contracte d&#8217;arrendament ven\u00e7 abans del 30 de juny de 2023, l&#8217;arrendatari podr\u00e0 demanar una pr\u00f2rroga extraordin\u00e0ria de l&#8217;arrendament per un per\u00edode m\u00e0xim de 6 mesos en les mateixes condicions anteriors.<\/li>\n<li><strong>Acceptaci\u00f3 de la pr\u00f2rroga<\/strong>: L&#8217;arrendador haur\u00e0 d&#8217;acceptar la pr\u00f2rroga a no ser que les dues parts acordin altres condicions o que el propi arendador hagi acreditat la necessitat de ocupar la finca ell mateix o els seus familiars que hi tinguin dret.<\/li>\n<li><strong>Actualitzaci\u00f3 de la renda<\/strong>: Durant aquest per\u00edode la renda es podr\u00e0 actualitzar quan correspongui conforme al que s&#8217;ha dit anteriorment (2%).<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2022\/12\/Habitatges.jpeg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-7021\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2022\/12\/Habitatges.jpeg\" alt=\"\" width=\"1600\" height=\"2133\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2022\/12\/Habitatges.jpeg 1600w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2022\/12\/Habitatges-225x300.jpeg 225w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2022\/12\/Habitatges-768x1024.jpeg 768w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2022\/12\/Habitatges-1152x1536.jpeg 1152w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2022\/12\/Habitatges-1536x2048.jpeg 1536w\" sizes=\"(max-width: 1600px) 100vw, 1600px\" \/><\/a><\/p>\n<h3><em><strong>Som Agents immobiliaris, Administradors de Finques i API.
