Aquest tipus de producte assegura al banc el cobrament dels diners prestats en la hipoteca en cas de defunci\u00f3 o situaci\u00f3 d\u2019incapacitat del titular del pr\u00e9stec.<\/p>\n<p>S\u00f3n productes l\u00edcits i les entitats financeres poden obligar-te a contractar-lo. En aquest sentit, la Llei de contractes de cr\u00e8dit immobiliari, permet la pr\u00e0ctica de vendes vinculades. Ara b\u00e9, <strong>es considera abusiu que exigeixin al prestatari que la subscripci\u00f3 de la p\u00f2lissa d\u2019asseguran\u00e7a en garantia del deute sigui contractat amb la mateixa entitat banc\u00e0ria que va concedir el pr\u00e9stec hipotecari \u00a0o amb una empresa vinculada a la mateixa, aix\u00ed com tamb\u00e9 es considera abusiu que s\u2019obligui a satisfer la prima amb un pagament \u00fanic, i s\u2019obligui a incloure-la dins del finan\u00e7ament del pr\u00e9stec hipotecari, com a major import del mateix.<\/strong><\/p>\n<h3>Es nul\u00b7la la obligaci\u00f3 de contractar l&#8217;asseguran\u00e7a de vida amb amb la pr\u00f2pia entitat prestadora o amb asseguradores vinculades a la mateixa ?<\/h3>\n<p>Aquesta pr\u00e0ctica es considera clarament perjudicial per l\u2019assegurat, qui apart de no poder-se desvincular de l\u2019asseguran\u00e7a, es veu obligada a finan\u00e7ar el pagament \u00fanic, suposant aquest fet la inclusi\u00f3 d\u2019aquesta quantitat com a major import del pr\u00e9stec.<\/p>\n<p>En aquest sentit, existeixen algunes sent\u00e8ncies que ja s\u2019han posicionat al respecte i han declarat aquest tipus de cl\u00e0usules com abusives, condemnant el banc a retornar part de la prima no consumida fins el venciment, compensar per les primes excessives pel temps transcorregut, aix\u00ed com pels interessos pel finan\u00e7ament de la senyada prima.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/asseguranca-de-vida.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-7241\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/asseguranca-de-vida.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/asseguranca-de-vida.jpg 640w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2023\/03\/asseguranca-de-vida-300x200.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<h3><em><span style=\"color: #3366ff;\">Creus que pots ser un dels afectats?
