Inspeccions t\u00e8cniques d&#8217;edificis:<\/span><\/h2>\n<p>El 7.5.3015 es va publicar en el Diari Oficial de la Generalitat el <em><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><a style=\"color: #ff0000; text-decoration: underline;\" href=\"http:\/\/portaldogc.gencat.cat\/utilsEADOP\/PDF\/6866\/1423273.pdf\">Decret 67\/2015<\/a><\/span><\/span><\/em>, que modifica la regulaci\u00f3 anterior del 2010 sobre les inspeccions t\u00e8cniques dels edificis d&#8217;habitatges i el llibre de l&#8217;edifici. Destaquem:<\/p>\n<ul>\n<li>La regulaci\u00f3 tamb\u00e9 afectar\u00e0 al habitatges unifamiliars i no \u00fanicament als blocs de pisos, com fins ara.<\/li>\n<li>Terminis per a passar la inspecci\u00f3 t\u00e8cnica dels edificis en funci\u00f3 de la seva antiguitat. <span style=\"text-decoration: underline; color: #800080;\">Edificis plurifamiliars<\/span>:\n<ul>\n<li>Anteriors a 1951: Ja l&#8217;haurien d&#8217;haver passat.<\/li>\n<li>Entre 1951 i 1960: Fins el\u00a0 31.12.2015.<\/li>\n<li>Entre 1961 i 1971: Fins el 31.12.2016.<\/li>\n<li>A partir del 1971: L&#8217;hauran de passar l&#8217;any en que l&#8217;edifici compleixi 45 d&#8217;antiguitat.<\/li>\n<\/ul>\n<\/li>\n<li>Terminis per a passar la inspecci\u00f3 t\u00e8cnica dels <span style=\"text-decoration: underline; color: #800080;\">edificis unifamiliars<\/span>:\n<ul>\n<li>Anteriors al 1900: Fins el 31.12.2016.<\/li>\n<li>Entre 1901 i 1930; Fins el 31.12.2017.<\/li>\n<li>Entre 1931 i 1950: Fins el 31.12.2018<\/li>\n<li>Entre 1951 i 1960: Fins el 31.12.2019<\/li>\n<li>Entre 1961 i 1975: Fins el 31.12.2020<\/li>\n<li>A partir del 1975: L&#8217;hauran de passar l&#8217;any en qu\u00e8 l&#8217;edifici compleixi 45 anys d&#8217;antiguitat.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"color: #800080;\">Mecanisme de segona oportunitat, reducci\u00f3 de la c\u00e0rrega financera i altres mesures d&#8217;odre social:<\/span><\/h2>\n<p>El 19.7.2015 es va publicar en el BOE la<span style=\"text-decoration: underline;\"><em><span style=\"color: #ff0000;\"><a style=\"color: #ff0000; text-decoration: underline;\" href=\"http:\/\/www.boe.es\/boe\/dias\/2015\/07\/29\/pdfs\/BOE-A-2015-8469.pdf\"> Llei 25\/2015<\/a><\/span><\/em><\/span>, de la que destaquem el seg\u00fcent:<\/p>\n<ul>\n<li>Aquesta llei estableix els mecanismes pels quals una persona f\u00edsica que tingui un frac\u00e0s econ\u00f2mic empresarial o personal pugui encarrilar de nou la seva vida i arriscar-se a noves iniciatives sense que hagi d&#8217;arrastrar indefinidament el pes dels seus deutes, mitjan\u00e7ant:\n<ul>\n<li>Flexibilitzaci\u00f3 d&#8217;acords extrajudicials de pagament.<\/li>\n<li>Regim d&#8217;exoneraci\u00f3 de deutes de les persones f\u00edsiques.<\/li>\n<li>Pla de pagament a 5 anys de l&#8217;exc\u00e9s de deutes.<\/li>\n<li>Suspensi\u00f3 fins el 2017 de llan\u00e7aments sobre l&#8217;habitatge habitual de persones vulnerables.<\/li>\n<\/ul>\n<\/li>\n<li>Estableix incentius per a fomentar la ocupaci\u00f3:\n<ul>\n<li>M\u00ednim exempt en la cotitzaci\u00f3 empresarial per a conting\u00e8ncies comuns en els nous contractes indefinits de treballadors.<\/li>\n<li>Beneficis de la Seguretat social als treballadors aut\u00f2noms que hagin d&#8217;atendre obligacions familiars.<\/li>\n<\/ul>\n<\/li>\n<li>Les persones f\u00edsiques ja no hauran de pagar taxes judicials.<\/li>\n<\/ul>\n<h2><span style=\"color: #800080;\">Jurisdicci\u00f3 volunt\u00e0ria:<\/span><\/h2>\n<p>El 3.7.2015 es va publicar en el BOE la <span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><em><a style=\"color: #ff0000; text-decoration: underline;\" href=\"http:\/\/www.boe.es\/boe\/dias\/2015\/07\/03\/pdfs\/BOE-A-2015-7391.pdf\">Llei 15\/2015,<\/a><\/em><\/span><\/span> de la jurisdicci\u00f3 volunt\u00e0ria. Va entrar en vigor el dia 23.7.2015. Destaquem el seg\u00fcent:<\/p>\n<ul>\n<li>A partir del 30.6.2017 els notaris i els secretaris judicials podran celebrar matrimonis i autoritzar divorcis en cas de mutu acord dels c\u00f2njuges sense fills menors d&#8217;edat.<\/li>\n<li>L&#8217;edat a partir de la qual es permet contraure matrimoni s&#8217;eleva del 14 als 16 anys.<\/li>\n<li>En mat\u00e8ria de dret successori la compet\u00e8ncia ser\u00e0 dels notaris que la compartiran al algunes q\u00fcestions amb els secretaris judicials.<\/li>\n<li>Les subhastes volunt\u00e0ries les dur\u00e0 a terme el secretari judicial en forma electr\u00f2nica.<\/li>\n<li>En mat\u00e8ria de societats, la convocat\u00f2ria de juntes generals, reducci\u00f3 de capital social, nomenament de liquidador &#8230; la compet\u00e8ncia ser\u00e0 dels secretaris judicials compatida amb els registradors mercantils.<\/li>\n<li>El nomenament de p\u00e8rit en contractes d&#8217;asseguran\u00e7a correspondr\u00e0 als notaris.<\/li>\n<li>Notaris i Registradors podran intervenir en els actes de conciliaci\u00f3.<\/li>\n<li>Es podr\u00e0 cancel\u00b7lar els assentaments de fide\u00efcomisos condicionals en el Registre de la Propietat, sense haver d&#8217;acudir al Jutjat, quan hagi transcorregut m\u00e9s de 90 anys des de la transmissi\u00f3 de la finca pel fiduciari, sempre que no consti en el Registre inscripci\u00f3 o anotaci\u00f3 en sentir contrari.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica6_27632675.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-703\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica6_27632675.jpg\" alt=\"juridica6\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica6_27632675.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/juridica6_27632675-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<h2><span style=\"color: #800080;\"><em>\u00a0Som\u00a0 assessors jur\u00eddics.
