La Inspecci\u00f3 de Treball es posiciona a la vista de les darreres sent\u00e8ncies publicades\u00bb"},"content":{"rendered":"<p style=\"text-align: justify;\">La Direcci\u00f3 General de la Inspecci\u00f3 de Treball i Seguretat Social ha elaborat una nova instrucci\u00f3 sobre control del temps de treball a la vista de les sent\u00e8ncies del Tribunal Suprem de 23 de mar\u00e7 i 20 d&#8217;abril de 2017 que declaren que l&#8217;art. 35.5\u00a0 de l&#8217;Estatut dels Treballadors, \u00ab<strong>no exigeix haver de dur un registre de la jornada di\u00e0ria efectiva de tota la plantilla per poder comprovar el compliment dels horaris pactats\u00bb, i que el fet de no dur aquest registre no est\u00e0 tipificat com una infracci\u00f3 laboral.<\/strong><\/p>\n<p style=\"text-align: justify;\">La nova instrucci\u00f3, fent-se ress\u00f2 del que s&#8217;ha exposat en aquests pronunciaments judicials, vindria a recon\u00e8ixer<strong> que no \u00e9s exigible haver de dur un registre de la jornada di\u00e0ria efectiva de <span style=\"text-decoration: underline;\">tots<\/span> els treballadors, sens perjudici de que aquest registre sigui exigible <span style=\"text-decoration: underline;\">en els sup\u00f2sits concrets<\/span> en qu\u00e8 la normativa ho contempla, con es el cas dels treballadors contractats a\u00a0 temps parcial <\/strong>i sens perjudici, tamb\u00e9, de que la Inspecci\u00f3 de treball segueix-hi controlant i en el seu cas sancionant a les empreses per la realitzaci\u00f3 d&#8217;hores extraordin\u00e0ries no autoritzades per part dels seus treballadors.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_336534041.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-806\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_336534041.jpg\" alt=\"laboral7\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_336534041.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_336534041-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<p class=\"cs95E872D0\"><em><strong><span style=\"color: #800080;\">Som advocats i estem especialitzats en el dret laboral i de la Seguretat Social.
